4A05202024BLACKROCKCOFFEE A PERFORMANCE AGREEMENT BETWEEN THE BURLESON 4A ECONOMIC.ECONOMIC DEVELOPMENT CORPORATION AND C&C BURLESON, LLC FOR DESIGN AND CONSTRUCTION OF THE MODIFICATION OF AN EXISTING HOODED LEFT TURN LANE ALONG SOUTHWEST WILSHIRE BOULEVARD, PRESENTED BY MICHELLE MCCULLOUGH.

I'M MOVING ON TO THE EVENING, I GUESS. I HOPE EVERYONE HAD A GOOD HOLIDAY SEASON.
AND SO WHAT I'M GOING TO DO IS TALK A LITTLE BIT ABOUT PROJECT BACKGROUND.
GOT A COUPLE SLIDES ON THAT JUST AS A REFRESHER.
AND THEN HOW WE GOT HERE. AND THEN DOWN TO THE REQUEST.
SO THAT BUILDING WHICH WAS A KIND OF AN EYESORE ALONG 174 WAS PROPOSED TO BE TORN DOWN.
AND INITIALLY BLACK ROCK COFFEE TO BE CONSTRUCTED AND THEN A COUPLE OTHER BUSINESSES THAT CAME IN.
AND ON JUNE 19TH, I'M GOING A LITTLE OUT OF ORDER.
JUNE 19TH, THE SITE PLAN WAS ADMINISTRATIVELY APPROVED.
AND THEN IN OCTOBER OF 2023, THE INITIAL 4A ECONOMIC DEVELOPMENT BOARD APPROVED, OR THE 4A ECONOMIC DEVELOPMENT BOARD INITIALLY APPROVED A PERFORMANCE AGREEMENT RELATED TO THE REDEVELOPMENT OF THE SITE, AND THEN ON NOVEMBER 3RD, A NOTICE TO PROCEED WAS ISSUED FOR THE PUBLIC IMPROVEMENTS.
THE INITIAL ONE INCLUDED THE RIGHT TURN LANE CONSTRUCTION.
AND SO ASK STAFF REVIEWS THESE DEVELOPMENTS. WE LOOK FOR OPPORTUNITIES TO CLOSE DRIVEWAYS.
AND I'LL JUST GO AND JUMP TO THE NEXT SLIDE BECAUSE IT HAS A LITTLE BIT MORE INFORMATION ON IT.
SO WE DO HAVE A SCHEMATIC FOR 174 THAT WAS PREPARED BY ONE OF OUR CONSULTANTS.
ALONG 174, WE LOOK FOR OPPORTUNITIES TO CLOSE EXISTING DRIVEWAYS TO HELP REDUCE THE NUMBER OF CONNECTIONS, WHICH MAKES THE ROAD SAFER. IT INCREASES THE LEVEL OF SERVICE ALONG 174.
WE ALL KNOW HOW MUCH TRAFFIC IS ON THAT ROADWAY, SO ANY LITTLE BIT HELPS.
SO WHEN THIS DEVELOPMENT CAME IN, WE TOOK A LOOK AT IT.
THIS LITTLE DRIVEWAY WHERE YOU SEE THE YELLOW ARROW THAT IS A SHARED ACCESS DRIVE, AND THEN THE DRIVEWAY WITH THE RED ARROW THAT IS AN INDEPENDENT DRIVE, NO ACCESS EASEMENT. AND SO WHEN WE TALKED WITH THE DEVELOPER, THEY WERE AGREEABLE TO CONSIDERING CLOSING THE DRIVEWAY WHERE THE RED ARROW IS AND LEAVING THE ONE WITH THE YELLOW AREA. YELLOW ARROW, WHICH PROVIDED ACCESS TO BOTH PROPERTIES THAT ARE THERE.
AND THE DEVELOPMENTS THAT ARE, THAT EXIST. TXDOT DID NOT REQUIRE THE CLOSURE OF THAT DRIVE, BUT THEY DID SUPPORT IT. WHAT BUT THEY DID REQUIRE IS A RIGHT TURN LANE.
SO THE COMPLETED IMPROVEMENTS INCLUDE THE REMOVAL OF THE EXISTING SOUTH DRIVEWAY.
AS I MENTIONED, THE MODIFICATION OF THE HOODED LEFT, WHICH WAS IN I'LL GO BACK ONE.
THAT DOES NOT SERVE THIS PROPERTY OVER HERE. SO WHAT WE WANTED TO DO WAS PULL THIS HOODED LEFT BACK, AND THEN THAT WAY THAT HOODED LEFT WOULD SERVE THIS DRIVEWAY FOR BOTH PROPERTIES.
AND SO THAT MODIFICATION OF THE HOODED LEFT DID TAKE PLACE.
THE LEVEL OF SERVICE WITH THE RIGHT TURN LANE INCREASE IN FRONT OF THIS DEVELOPMENT.
I KNOW IT'S NEGLIGIBLE, BUT IT DOES HELP. LIKE I SAID, EVERY LITTLE BIT HELPS.

AND THE RIGHT TURN LANE ALLOWED THE VEHICLES TO MOVE OFF OF THE MAIN LANES AND INTO THE SITE.AND AGAIN, WE JUST LIMITED THE POINTS WHERE VEHICLE SLOWED DOWN AND TURN INTO THE SITE.
SO THE ORIGINAL ESTIMATED COST WAS AROUND $409,000.
AND AS WE GOT FURTHER INTO. THAT WENT TOO FAR AS WE GOT FURTHER INTO THE REVIEW. WHAT WE DID NOT ANTICIPATE WAS TXDOT REQUIRED A TRAFFIC STUDY.
THAT WASN'T ANTICIPATED BECAUSE WE KNEW A RIGHT TURN LANE WAS GOING TO BE REQUIRED, AND STAFF DID NOT SEE ANY OTHER REASON WHY A TIA WOULD BENEFIT THIS, BUT TXDOT STILL REQUIRED IT. WE DID OBJECT.
BUT THEY STILL REQUIRED THE DEVELOPER TO PROVIDE IT.
ALSO, AS PART OF THE REVIEW OF THE PLANS, TXDOT DID REQUIRE ADDITIONAL TRAFFIC CONTROL.
THIS WAS ALSO NOT INITIALLY ANTICIPATED. AT THAT TIME THEY HAD SEEN AN INCREASE IN ACCIDENTS AND DEATHS ALONG MAJOR ROADWAYS WITH CONSTRUCTION. SO THEY HAD ADDED ADDITIONAL TRAFFIC CONTROL MEASURES.
ONE THING THAT WAS AN OVERSIGHT THAT WE HAD IS THE IRRIGATION.
THE IRRIGATION WAS NOT INCLUDED IN THE ORIGINAL COST ESTIMATE, SO THAT DID HAVE TO BE INCLUDED BECAUSE WE DID REMOVE EXISTING IRRIGATION AND LANDSCAPE, AND WE DID REPLACE. THAT WHEN THE HOODED LEFT WAS MOVED BACK AND CONSTRUCTION COSTS, THE CONTRACTOR CAME BACK TO THE DEVELOPER BECAUSE THE TXDOT DELAYS CREATED A SIX. OR THE TXDOT STUDY CREATED ABOUT A 6 TO 8 MONTH DELAY WHICH INCREASED CONSTRUCTION COST OVER THAT TIME. SO THE TOTAL ESTIMATED ADDITIONAL COST FOR DESIGN WAS AROUND $9,500, AND THEN THE CONSTRUCTION COST WAS AROUND $43,000.
SO THE COUNCIL ACTION REQUESTED FOR THIS EVENING IS TO APPROVE AN AMENDMENT TO THE RESOLUTION FOR THE PERFORMANCE AGREEMENT FOR THE MODIFICATION OF THE HOODED LEFT ALONG SOUTHWEST WILTSHIRE. AND I AM HERE FOR ANY QUESTIONS.
QUESTIONS ANYONE? I DON'T HAVE ANY. I MEAN, I UNDERSTAND THIS.
THIS IS WHAT I DO EVERY DAY. SO I GET THAT THINGS DON'T ALWAYS WORK OUT THE WAY YOU THINK.
WE'RE STILL MEETING THE ORIGINAL THRUST OF THE AGREEMENT, WHICH WAS TO MAKE IT POSSIBLE FOR THIS SITE TO REDEVELOP, AND WE DID IT MUCH MORE SAFELY BY KILLING THE EXTRA DRIVEWAY.
AND ALSO NOTE THAT THE BLACK ROCK CAFE PEOPLE OR COFFEE PEOPLE, HAVE ACTUALLY GAINED SOME PARKING SPACES BY CLOSING THE DRIVEWAY, WHICH EVEN HELPS MORE. SO A LITTLE BIT MORE COST $43,000 MORE THAN ORIGINALLY PLANNED, RIGHT? THAT'S THE DRIVE OUT PRICE. THE $43,000 AND THE $95,000.
YES, YES. SO YEAH. I DON'T HAVE ANY ISSUES WITH MAKING THIS WORK.
