AS YOU KNOW, THERE HAVE BEEN SOME INTEREST FROM VARIOUS ENTITIES REGARDING DOING DEVELOPMENTS IN AND AROUND THE CITY, SOME OF WHICH ARE ENTERTAINING, UTILIZING US OR MMDS AS A VEHICLE TO FACILITATE THAT DEVELOPMENT. WITH REGARD TO STRATEGIC PARTNERSHIP AGREEMENTS, SPAS, AS WE CALL THEM, TYPICALLY PROVIDE SOME TYPE OF FRAMEWORK WHERE NEGOTIATIONS AND DISCUSSIONS CAN OCCUR BETWEEN A DEVELOPER AND A CITY, AND IT LAYS OUT EXPECTATIONS OF EACH GROUP. THOSE TWO COMPANIES DID REACH OUT TO CITY STAFF, AND WE MET WITH THEM TO UNDERSTAND THEIR SERVICES AND WHO THEY WERE. LITTLE COMPANY BACKGROUND. TOGETHER, THEY DO HAVE 25 YEARS OF EXPERIENCE. THEY PROVIDE ASSISTANCE IN SERVICES THAT HELPS US FROM A FEDERAL PERSPECTIVE, NOT JUST A STATE PERSPECTIVE. THEY HELP IN BEING IN BETWEEN BETWEEN THE FEDERAL GOVERNMENT AND US. THEY DO HELP WITH FEDERAL FUNDING, SO THEY WILL HELP STAFF IDENTIFY GRANTS, EARMARKS, AND FEMA REIMBURSEMENTS. THEY ARE DIRECT ADVOCACY. IF WE DON'T FIGHT TO BRING SOME OF THOSE DOLLARS BACK, THEN SOMEONE WILL. THEY WILL GO SOMEWHERE, WHETHER IT'S IN THE STATE OF TEXAS AND IN ANOTHER STATE. THE HESITATION I HAVE IS THAT OUR CONGRESSIONAL REPRESENTATIVE DOES NOT CURRENTLY PARTICIPATE IN THE APPROPRIATIONS PROCESS. YOU HAVE TO HAVE SOMEBODY WHO'S REALLY GOING TO GO FOR IT. AS A STAFF MEMBER, IT WAS MY JOB TO DO ALL THE LEG WORK, MAKE A PRESENTATION FOR [00:40:01] THE CONGRESSIONAL REPRESENTATIVE TO GO TO THE FLOOR AND FIGHT FOR. WE JUST WANT THEM TO COME HERE BECAUSE THEY'RE GOING TO BE SENT SOMEWHERE, A PIECE OF INFRASTRUCTURE OR A HEALTH AND HUMAN SERVICES. IT DEPENDS WHERE WE'RE TRYING TO GET FUNDING FROM. SOME BILLS ARE EASIER TO GET FUNDING OUT OF, AND THEN OTHERS, LIKE HEALTH AND HUMAN SERVICES IS A BIG BILL. IT COVERS A LOT OF DIFFERENT AREAS, AND SO IT'S VERY HARD TO GET MONEY OUT OF THERE. BUT THE CONGRESSIONAL MEMBER I WORKED FOR, WE SECURED THE FUNDING FOR THE HUGLEY MOBILE BUS, FOR EXAMPLE. THEN THERE'S CRIMINAL JUSTICE FUNDS. THE FIRST ARMORED VEHICLE THAT OUR POLICE DEPARTMENT HAS CAME FROM APPROPRIATED DOLLARS. WE HAVE A HISTORY IN BURLESON OF SEEING THOSE DOLLARS, BUT WE ALSO HAD A CONGRESSIONAL MEMBER WHO WAS VERY FAMILIAR WITH THE PROCESS, AND HE SERVED ON THE APPROPRIATION SUBCOMMITTEE. HE WAS CHAIRMAN OF IT., IT REALLY DEPENDS ON COMMITTEE ASSIGNMENTS, WHO YOU KNOW AND THEIR STAFF, AND WHETHER OR NOT YOUR CONGRESSIONAL REPRESENTATIVE IS TRULY COMFORTABLE WITH GOING FOR THAT. UNDER FILING AN ADOPTION OF THE OPERATING BUDGET, WE ADDED THE FOLLOWING SENTENCE IF A TAX RATE IS NOT ADOPTED BY SEPTEMBER 30TH. THE TAX RATE FOR THAT YEAR WOULD BE THE LOWER OF THE NO-NEW-REVENUE TAX RATE CALCULATED FOR THE TAX YEAR OR THE TAX RATE ADOPTED BY THE TAXING UNIT FOR THE PRECEDING TAX YEAR IN ACCORDANCE WITH STATE LAW. AGAIN, THAT IS JUST IN COMPLIANCE WITH STATE LAW IF A TAX RATE HAD NOT BEEN ADOPTED BY THAT DATE. WE DID INCORPORATE INTO THE POLICY THAT SPECIFIC REFERENCE TO THE LAW AS RECOMMENDED. ADDITIONALLY, THE REPORTING SECTION CHANGE, THE SUMMARY FINANCIAL REPORTS ARE PRESENTED TO THE DEPARTMENTS FOR REVIEW, AND THEN CITY COUNCIL WILL RECEIVE A FINANCIAL SUMMARY OF THE KEY FUNDS WITHIN 30 DAYS AFTER THE END OF EACH MONTH. WE DID ADD THAT THERE IS AN EXCEPTION AT THE END OF THE FIRST QUARTER OF THE FISCAL YEAR, AND THIS IS TO ALLOW FOR THE CLOSING OF THE FISCAL YEAR WITHIN OUR FINANCIAL SOFTWARE, AND THE REPORT WILL BE PROVIDED WITHIN 30 DAYS AFTER THE FIRST QUARTER OF THE FISCAL YEAR. WE CHANGED THAT TO AT FAIR MARKET VALUE FOR ANY GIVEN YEAR BASED ON THE CURRENT APPRAISAL SUPPLIED SUPPLIED TO THE CITY BY THE CENTRAL APPRAISAL DISTRICT OF JOHNSON COUNTY AND TERRAN APPRAISAL DISTRICT IN LINE WITH CURRENT PRACTICE. WE DID UPDATE PAYMENT IN LIEU OF TAXES, THAT A FEE WILL BE CHARGED TO THE UTILITY FUND TO EQUATE TO PROPERTY TAXES LOSS DUE TO MUNICIPAL OWNERSHIP. TOTAL ASSETS FROM THE MOST RECENT AUDITED FINANCIALS WILL BE USED AS THE BASIS, BARRING THE ABSENCE OF NON-MARKET VALUE, AND USED WITH THE TAX RATE FROM THE SAME FISCAL YEAR AS THE MOST RECENT AUDITED FINANCIALS. >> EX-CHANGE WIRE TRANSFERS TO ELECTRONIC TRANSFERS THROUGHOUT THE POLICIES SO THAT THESE WOULD ALSO INCLUDE ACH TRANSFERS AND BANK TRANSFERS, SO WE WEREN'T JUST SECLUDING THOSE WIRE TRANSFERS. WE UPDATED THE GENERAL OBLIGATION DEBT SERVICE FUNDS RESERVE TO RECOMMEND APPROXIMATELY $1,000,000. THE POLICY DOES NOT INCLUDE THE DEBT SERVICE RESERVES NORMALLY ESTABLISHED TO MARKET REVENUE BONDS. THOSE ARE USUALLY SET BY THOSE BOND COVENANTS. WE DID RECOMMEND UPDATING THE AUTHORIZATION OF PAYMENTS AND INVESTMENTS TO BE REQUIRED BY SIGNATURES BY BOTH THE CITY MANAGER AND THE DIRECTOR OF FINANCE OR THEIR DESIGNEES. ELECTRONIC TRANSFERS AUTHORIZED WOULD BE PROCEDURES WOULD BE SET BY THE DIRECTOR OF FINANCE IN ACCORDANCE WITH BANKING RESOLUTIONS THAT ARE ADOPTED BY THE COUNCIL. THE INVESTMENT POLICY, OF COURSE, TO BE IN LINE WITH THESE. PROCESSES WOULD REQUIRE TWO INDIVIDUALS ASSIGNED BY THE DIRECTOR OF FINANCE TO SEPARATE THE DUTIES OF INITIATING A TRANSACTION AND APPROVAL OF A TRANSACTION. THIS WAS UPDATED REALLY JUST SO THAT WE WOULDN'T BE BRINGING THIS BACK TO YOU EVERY TIME THAT WE HAD TO MAKE SOME TYPE OF PROCESS CHANGE. THERE WERE A LOT OF POSITIONS THAT WERE LISTED IN THE PREVIOUS POLICY, AND THOSE POSITION NAMES HAVE ALREADY BEEN OUTDATED. THEN ALSO, BASED ON THE TWO SECTIONS, ATTACHMENTS A-D, THESE WERE ALLOWING WIRE TRANSFER, AUTHORIZATION, SAFEKEEPING AGENTS, INVESTMENTS, AND PAYING AGENTS WERE REMOVED AND HANDLED ADMINISTRATIVELY. THOSE ARE THE RECOMMENDED UPDATES TO THE FINANCIAL POLICY. THE DEBT POLICY UPDATES, WE REALLY ADDED TO THAT PURPOSE. AGAIN, THIS WAS CREATED IN 2023 AND ADOPTED AT THAT TIME. WE WANTED TO PUT IN A MORE COMPREHENSIVE PURPOSE FOR THE POLICY, OUTLINING THESE DETAILS. THEN, OF COURSE, ADDING TO THE POLICY STATEMENT THAT THIS POLICY UPDATE APPLIES TO DEBT INSTRUMENTS ISSUED BY THE CITY REGARDLESS OF THE FUNDING SOURCE. THESE WOULD BE ALL FUNDING SOURCES FROM DEBT SECURED BY AVERM TAXES, GENERAL CITY REVENUES, ENTERPRISE FUND REVENUES, OR ANY OTHER IDENTIFIABLE SOURCE OF REVENUE FOR APPROPRIATE PLEDGING FOR BONDED INDEBTEDNESS. OF COURSE, THE DEBT WOULD BE STRUCTURED TO THE GREATEST EXTENT POSSIBLE FOR THESE GOALS, TARGET PROJECTED CASH FLOWS AND PLEDGED REVENUES, MINIMIZE THE IMPACT ON FUTURE TAX LEVIES, TARGET A CONSISTENT AND AS RAPID AS FEASIBLE, PAYMENT OF PRINCIPAL, MAINTAIN A LEVEL OVERALL ANNUAL DEBT SERVICE PAYMENT STRUCTURE, AND TARGET THE EQUAL OR THE LESSER OF THE USEFUL LIFE OF THE ASSET BEING FINANCED SO THAT WE CAN HAVE THOSE ASSET LIVES IN LINE WITH OUR AMORTIZATION SCHEDULES FOR THAT DEBT. WE INCLUDED THE FIXED INTEREST VERSUS VARIABLE RATE INTEREST THAT BOTH ARE ALLOWABLE, AND THE CITY HAS THE OPTION TO ISSUE IF MARKET CONDITIONS WARRANT, AND THE COUNCIL APPROVES THEM. WE ALSO INCLUDED THE DEFINITIONS HERE OF THE COMPETITIVE SALE AND THE NEGOTIATED SALE, AS WELL AS PRIVATE PLACEMENT METHODS OF SALE. WE ALSO INCLUDED SOME ADDITIONAL LANGUAGE OF WHEN WE MIGHT FIND THESE BENEFICIAL. THE CITY'S DATA OBLIGATIONS MAY BE SOLD BY ANY OF THESE TYPES, COMPETITIVE NEGOTIATED OR PRIVATE PLACEMENT METHODS, AND THESE MAY DEPEND UPON THE EXPECTED MARKET RESULTS, LOWEST COST, AND MOST FAVORABLE TERMS. THE CITY GIVEN TO THE FINANCIAL STRUCTURE USED, MARKET CONDITIONS, AND PRIOR EXPERIENCE. WE WOULD WANT TO CONSIDER ALL OF THESE METHODS. ADHERENCE TO A DEBT MANAGEMENT POLICY HELPS TO ENSURE THAT THE CITY MAINTAINS THE CURRENT OR AN IMPROVED BOND RATING IN ORDER TO [02:10:01] MINIMIZE BORROWING COSTS AND PRESERVE ACCESS TO CREDIT. THIS IS VERY IMPORTANT. WE WOULD TAKE THE FOLLOWING STEPS TO MAINTAIN GOOD RELATIONSHIPS WITH OUR BOND RATING AGENCIES, AS WELL AS DISCLOSE FINANCIAL REPORTS AND INFORMATION TO THESE AGENCIES IN THE PUBLIC, OBTAIN A RATING FROM AT LEAST ONE NATIONALLY RECOGNIZED BOND RATING AGENCY ON ALL ISSUES BEING SOLD IN THE PUBLIC MARKET AND MAKE TIMELY DISCLOSURE OF ANNUAL FINANCIAL INFORMATION OR OTHER REQUESTED INFORMATION TO THE RATING AGENCIES. IN REGARDS TO CONTINUING DISCLOSURE, THE CITY WOULD TAKE ALL APPROPRIATE STEPS TO COMPLY WITH THE FEDERAL SECURITIES LAWS, INCLUDING BUT NOT LIMITED TO SECURITIES AND EXCHANGE COMMISSION RULE 15 C 2-12, THE CITY WOULD MAKE ANNUAL AND EVENT DISCLOSURE FILINGS TO THE MSRB VIA MA SO THAT WE ARE IN COMPLIANCE WITH CONTINUING DISCLOSURE REQUIREMENTS. AS REGARDS TO SELECTION OF THE FINANCIAL ADVISOR. WE WOULD AS THE CITY RETAIN AN INDEPENDENT FINANCIAL ADVISOR TO ADVISE US IN VARIOUS SITUATIONS IN ISSUING DEBT AND REFUNDING OPPORTUNITIES, THE RATING REVIEW PROCESS, MARKETABILITY OF THE CITY DEBT OBLIGATIONS, AND PREPARING OFFERING DOCUMENTS. THE CITY DOES SEEK THE ADVICE OF THE FINANCIAL ADVISOR ON AN ONGOING BASIS. THEY ALSO PERFORM OTHER SERVICES AS DEFINED BY THE AGREEMENT AND APPROVED BY CITY COUNCIL. THE FINANCIAL ADVISOR WOULD NOT BID ON ANY OR UNDERWRITE ANY CITY DEBT ISSUANCES. SIMILARLY, THE SELECTION FOR BOND COUNSEL SO THAT WE CAN RETAIN LEGAL AND PROCEDURAL ADVICE ON ALL DEBT ISSUANCES AND REMAIN COMPLIANCE IN ALL MATTERS PERTAINING TO THE BOND ORDINANCES AND RESOLUTIONS, AND THE CITY WILL NOT TAKE ANY ACTION UNTIL A WRITTEN INSTRUMENT CERTIFYING THE LEGALITY OF THE PROPOSAL HAS BEEN PROVIDED. THE CITY ALSO WOULD SEEK THE ADVICE OF BOND COUNSEL AND OTHER TYPES OF DEBT AND ANY OTHER QUESTIONS INVOLVING STATE LAW AND FEDERAL TAX OR ARBITRAGE LAW. BECAUSE NO ONE WOULD ARGUE THAT INSTALLING THE DEPOT ON MAINE IN THE MIDDLE OF OLD TOWN DIDN'T CHANGE THE CHARACTER OF THE COMMUNITY. NOBODY'S GOING TO MAKE THAT ARGUMENT. WHEN IT'S APPROPRIATE, THAT NEEDS TO HAPPEN. WHEN IT'S NOT APPROPRIATE, IT DOESN'T. I ALSO UNDERSTAND JUST FROM THE PERSPECTIVE OF WHERE WE ARE WITH BUDGET, A $500,000 SUPPLEMENTAL PLUS MAY NOT BE SOMETHING THAT RISES TO THE TOP OF THE COUNCIL'S LIST, OR IT MAY. IT'S CERTAINLY IMPORTANT. YOU CAN'T UNDERSTATE THE IMPORTANCE OF IT, PARTICULARLY AS WE GROW. WITH THAT SAID, I THINK YOU HAVE OPTIONS THAT DOESN'T NECESSITATE A FULL UPDATE TO THE COMP PLAN RIGHT NOW. YOU ALWAYS RESERVE THE RIGHT TO UPDATE THE FUTURE LAND USE MAP TO BE MORE REFLECTIVE OF WHAT THE CURRENT COUNCIL SEES. I RECOMMEND IF YOU DO THAT, YOU DO IT IN CONJUNCTION WITH AN ADDENDUM TO THE MIDPOINT 2020 PLAN WITH THE INTENTION THAT THIS IS A STOPGAP UNTIL SUCH TIME AS YOU DO A FULL COMP PLAN, WHICH COULD STILL BE A FEW YEARS AWAY. HOW THE COUNCIL OR IF THE COUNCIL WANTS TO PURSUE THAT IS CERTAINLY 100% OF POLICY DECISION AND UP TO YOU. WHETHER YOU SUBMIT THIS TO A COUNCIL COMMITTEE FOR FURTHER DELIBERATION AND RECOMMENDATIONS TO THE FULL COUNCIL AND THEN TO P&Z OR YOU WANT TO TAKE ANOTHER APPROACH AT THAT. I THINK WHAT STAFF NEEDS IS JUST GENERAL DIRECTION ON ARE THERE ELEMENTS ASSOCIATED WITH THIS THAT YOU WANT TO SEE US FURTHER DISCUSS. IS THAT DONE AT THE COMMITTEE LEVEL AND BACK TO FULL COUNCIL AND P&Z OR SOME OTHER ITERATION OF THAT? THAT WAS LEFT IN COMMITTEE, SO THAT IS DEAD AS WELL, REQUIRING OUR POLICE AND FIRE TO BE CIVIL SERVICE. THAT WAS ALSO LEFT IN COMMITTEE. ANIMAL CONTROL OFFICERS BEING CONSIDERED FIRST RESPONDERS THAT ALSO HAS DIED. IT WAS ASSIGNED TO THE ECONOMIC DEVELOPMENT COMMITTEE THAT IS THE SAME COMMITTEE THAT OUR ORIGINAL SENATE BILL WAS ASSIGNED TO. THE CHAIR OF THAT COMMITTEE IS SENATOR KING. STAFF HAS SENT A LETTER TO HIS OFFICE FROM COUNCIL THAT IS IN SUPPORT OF THAT BILL AND ASKED HIM TO SUPPORT IT THROUGH THE PROCESS. THE ANNUAL APPRAISAL BILL HOUSE BILL 2786 THAT DID PASS THE HOUSE 84-50. THERE WAS QUITE A BIG DEBATE ON THAT. THERE WAS A LOT OF GOOD TESTIMONY THAT SPOKE FOR THAT BILL. THERE WAS ACTUALLY A VERY GOOD TESTIMONY BY SOMEONE THAT IS PART OF THE TARRANT COUNTY SCHOOL DISTRICT. HE TALKED ABOUT THE SCHOOL DISTRICT STRUGGLING TO MAINTAIN TO CODE DUE TO LACK OF FUNDING. HE ALSO STATED THAT HIS SCHOOL DISTRICT DIRECTLY IS FILING BANKRUPTCY BECAUSE OF NOT BEING REAPPRAISED EVERY YEAR. THAT WAS GOOD FOR US. IT HAS BEEN SENT TO THE SENATE, BUT IT HAS NOT BEEN ASSIGNED A COMMITTEE YET. SENATE BILL 1209. IT TALKS ABOUT UNIFORM ELECTIONS. THAT PASSED THE NEXT STEP AS WELL. IT PASS THE SENATE 20-10.
