FIRST ITEM ON OUR AGENDA IS CITIZENS APPEARANCES.

IF WE HAVE ANY CITIZENS IN THE AUDIENCE WHO WOULD LIKE TO ADDRESS THE BOARD, THIS WOULD BE YOUR TIME.

I SEE NO SUCH REQUESTS, AND I'M MADE AWARE THERE ARE NONE.

SO WE'LL MOVE ON TO ITEM 3.

ITEM 3A IS TO CONSIDER APPROVAL OF THE MINUTES FROM THE JANUARY 22ND, 2024 ECONOMIC DEVELOPMENT CORPORATION TYPE A MEETING.

YOU GENTLEMEN ALL HAVE THESE ON YOUR DAIS THERE.

IF YOU'RE FAMILIAR WITH THEM AND READY TO MAKE A MOTION, I'M READY.

MOVE TO APPROVE THE MINUTES.

SECOND. A MOTION BY RUSSELL, SECOND BY JOHNSON TO APPROVE ALL THOSE IN FAVOR.

AND THAT MOTION PASSES WITH A UNANIMOUS VOTE.

[3.B. Consider approval of a request for a permanent pipeline and aboveground facilities easement with Atmos Energy Corporation within the Hooper Business Park property. (Staff Contact: Michelle McCullough, Assistant Director/City Engineer)]

THIS IS TO CONSIDER APPROVAL OF A REQUEST FOR A PERMANENT PIPELINE AND ABOVE GROUND FACILITIES EASEMENT WITH ATMOS ENERGY CORPORATION WITHIN THE HOOPER BUSINESS PARK PROPERTY. THIS WILL BE PRESENTED BY MICHELLE MCCULLOUGH, ASSISTANT DIRECTOR AND CITY ENGINEER.

GOOD EVENING. HOPE YOU GUYS ARE DOING WELL.

MY NAME IS MICHELLE MCCULLOUGH, ASSISTANT DIRECTOR OF PUBLIC WORKS AND ENGINEERING AND CITY ENGINEER.

SO TODAY, BEFORE YOU IS CONSIDERATION OF AN ATMOS ENERGY PIPELINE AND ABOVE GROUND FACILITIES EASEMENT.

NOW YOU'VE SEEN THIS SLIDE BEFORE.

THIS IS JUST A LITTLE BACKGROUND.

SO LAKEWOOD DRIVE IS CURRENTLY UNDER CONSTRUCTION.

THERE WILL BE A TEMPORARY CONNECTION TO FM 1902.

WE'RE CURRENTLY WORKING WITH TXDOT ON THAT.

THE LONGER TERM IS A PERMANENT EXTENSION OF LAKEWOOD OUT TO THE TOLLWAY, AND THAT IS CURRENTLY UNDER DESIGN.

AND WE'RE ALSO WORKING WITH TXDOT AND NTTA AND COG, AND THEN THE SEWER LIFT STATION AND FORCE MAIN THAT'S GOING TO SERVE THE BUSINESS PARK IN THE SURROUNDING AREA.

THE CONSTRUCTION PROCUREMENT IS UNDERWAY RIGHT NOW, AND WE SHOULD BE RECEIVING THOSE PROPOSALS NEXT WEEK.

STORM WATER RETENTION DETENTION.

IT'S ACTUALLY GOING TO BE A RETENTION POND.

THAT DESIGN IS UNDERWAY.

IT IS ABOUT 90% COMPLETE.

AND WE DO ANTICIPATE THAT IT WILL BID MAYBE MAY TIME FRAME JUNE AND BE UNDER CONSTRUCTION THIS SUMMER.

AND AGAIN, LIKE I SAID, YOU HAVE SEEN THIS IN THE PAST.

THIS THE ATMOS FACILITIES.

THE NEAREST SOURCE IS ABOUT TWO AND A HALF MILES AWAY.

IT IS AN EXISTING HIGH PRESSURE TRANSMISSION LINE THAT WILL BE EXTENDED FROM FM 917 AND 1902.

ATMOS DOES REQUIRE A MINIMUM EXCLUSIVE 30 FOOT EASEMENT RIGHT OF WAY FOR THAT LINE, BUT LIKE I SAID, IT IS AN EXISTING AND IT'S GOING TO COME UP 1902.

THE LOW PRESSURE GAS LINE WILL BE EXTENDED THROUGH THE BUSINESS PARK ALONG LAKEWOOD DRIVE IN THE RIGHT OF WAY, AND THE REGULATOR STATION THAT IS PROPOSED TO BE CONSTRUCTED WILL CONVERT THE HIGH PRESSURE TO LOW PRESSURE FOR THE DISTRIBUTION LINES.

WE DID LOOK AT FOUR POTENTIAL LOCATIONS.

AND THE ONE THAT WAS PREFERRED WAS LOCATION NUMBER ONE IN THE BUSINESS PARK.

SO THE GAS WOULD BE PROVIDED TO THE HOOPER BUSINESS PARK, CHISHOLM SUMMIT, CRAFT MASTERS AND ANY FUTURE DEVELOPMENT.

AND THE OPTIONS WERE PRESENTED TO BOTH THE INFRASTRUCTURE AND DEVELOPMENT COMMITTEE AND CITY COUNCIL.

AS I MENTIONED I&D COMMITTEE, DID SUPPORT OPTION NUMBER ONE, WHICH IS THE CITY OWNED PROPERTY.

CITY COUNCIL DID DIRECT STAFF TO PROCEED WITH THIS LOCATION.

AND RA DEVELOPMENT IS PREPARED TO FUND THE LOW PRESSURE LINE DOWN LAKEWOOD DRIVE TO SERVE CHISHOLM SUMMIT AND GAS WILL BE AVAILABLE TO THE BUSINESS PARK.

AND OUR CONTRIBUTION THE CITY'S CONTRIBUTION IS ONLY THE EASEMENT FOR THE REGULATOR STATION.

ATMOS HAS COMMITTED TO USE THE SAME SCREENING FENCE AND LANDSCAPING PROPOSED FOR LAKEWOOD.

CONSISTENCY. AT LEAST SIX FOOT TALL ORNAMENTAL FENCES WITH THREE INCH DIAMETER STEEL POST TO EIGHT FOOT TALL.

TWO CABLES WOULD BE PLACED ON THE TOP OF THE FENCE.

LANDSCAPE TO BE CONSISTENT WITH LAKEWOOD DRIVE AND THE SANITARY SEWER LIFT STATION, THAT'S ONE THING WE ARE LOOKING AT RIGHT NOW.

THE THE LANDSCAPING IS CURRENTLY UNDER DESIGN, SO WE WILL HOPEFULLY HAVE A SUBMITTAL FROM RA DEVELOPMENT SOON TO TAKE A LOOK AT THAT.

SO THE ACTION REQUESTED TODAY IS TO PREVIEW IS TO APPROVE THE REQUEST FOR THE PERMANENT PIPELINE AND ABOVE GROUND FACILITIES, AND ALSO TO IN ORDER TO THE EASEMENT DOES NOT INCLUDE LANGUAGE FOR THE SCREENING.

AND SO WE WOULD ASK THAT YOU APPROVE THIS REQUEST CONTINGENT ON THE ATTORNEY APPROVING LANGUAGE FOR A SEPARATE AGREEMENT.

OKAY AS YOU MENTIONED, THIS IS A 20 FOOT WATER LINE EASEMENT TO JOHNSON COUNTY SPECIAL UTILITY DISTRICT.

THIS IS THE SAME SLIDE, UNLESS YOU WANT ME TO TALK ABOUT IT AGAIN, I'M JUST GOING TO SKIP IT.

SO THE 20 FOOT WATER LINE EASEMENT RA DEVELOPMENT IS GOING TO IS CONSTRUCTING THIS WATER LINE ALONG THE NORTHEASTERN PORTION OF THE HOOPER BUSINESS PARK.

AND THIS WILL SERVE NOT ONLY CRAFT MASTERS, BUT THE FUTURE DEVELOPMENT IN THE BUSINESS PARK, AS WELL AS CHISHOLM SUMMIT MASTER PLAN DEVELOPMENT AND ANY OF THE SURROUNDING DEVELOPMENT THAT WILL COME FROM THIS.

AND AGAIN RA DEVELOPMENT IS PAYING FOR THIS AND THE CITY'S CONTRIBUTION FOR THIS IS JUST THE 20 FOOT WIDE WATER LINE EASEMENT.

SO THE ACTION REQUESTED IS TO APPROVE THE 20 FOOT WIDE WATER LINE EASEMENT TO JOHNSON COUNTY SPECIAL UTILITY DISTRICT.
