COUNCIL MEMBER SCOTT AND THE MAYOR AND I WERE AT FIRE STATION 16 READY FOR THE NEW YEAR WHEN WE FLIPPED A BIG GIANT SWITCH AND NOTHING HAPPENED, THANK GOODNESS, WHICH WE TURNED ON OUR AMBULANCES.

SO THAT WAS PRETTY AWESOME.

AND WE HAD A GOOD TURNOUT FROM WE HAD SOME ALL THE FIRE DEPARTMENT WAS THERE AND THEN CAREFLIGHT WAS THERE AND THEY BROUGHT THEIR NEW BOX AS WELL AND SHOWED US THAT AND WE WERE JUST GLAD TO BE THERE.

AND I THINK IT WASN'T UNTIL 9, ALMOST 9 IN THE MORNING THAT WE GOT THE FIRST CALL.

SO WE WERE GLAD WE DIDN'T STAY TO WAIT FOR THAT.

BUT WE'RE JUST I JUST WANT TO COMMEND THE FIRE DEPARTMENT AND CITY STAFF FOR JUST I MEAN, THAT WAS A MASSIVE PROJECT.

AND OF COURSE, I GOT ON COUNCIL JUST A FEW MONTHS AGO, BUT AND SO Y'ALL WERE ALREADY IN THE WORKS.

BUT JUST TO HAVE EVERYTHING READY TO GO FOR THAT MOMENT IN TIME.

AND THEN IT HAPPENED EXACTLY WHAT NEEDED TO HAPPEN.

I JUST COMMEND THEM SO MUCH.

THEN THERE'S A BALLOT PUT OUT AFTER THE 15TH DISSEMINATED TO THOSE THAT ARE AVAILABLE TO VOTE OR HAVE EARNED THE RIGHT TO VOTE BECAUSE YOU CHARGE A TAX AND THEN YOU'RE ASSIGNED VOTES AND THEN YOU CAST THOSE VOTES FROM OCTOBER 31ST TO DECEMBER 15TH.

YOU HAVE TO HAVE YOUR NOMINATIONS IN BEFORE THE 15TH AND YOU HAVE TO HAVE YOUR BALLOT IN BEFORE DECEMBER 15TH.

OUR VOTE DOESN'T MATTER.

WELL, IT DOES, BUT I CAN MAKE IT EVEN MORE POWERFUL.

THEY JUST DID AN AT-LARGE THING FOR THE CITIZENS TO CHOOSE 3 PEOPLE TO EXPAND THE BOARD.

UNDER THE CURRENT PROPERTY TAX CODE, YOU CAN EXPAND UP TO 13 PEOPLE ALREADY.

WE DON'T NEED THE LEGISLATURE COME AND TELL US HOW TO DO OUR BUSINESS.

WHAT WE COULD DO AS GOVERNING BODY IS AGREE TO A PROCESS WHERE WE HAVE THE TYPICAL 5 AND THEN WE HAVE 3 AT LARGE WHERE EVERY COUNCIL BODY GETS 3 VOTES.

SO WE HAVE 73 BODIES IN THIS COUNTY, THERE WOULD BE 3 TIMES 73.

YOU CAST YOUR ONE VOTE FOR ONE OF THOSE 3 PEOPLE, OR IF THERE'S 10 PEOPLE ON THE BALLOT, YOU CAST FOR ONE OF THE TEN.

SO WE WENT ALMOST A BICAMERAL SYSTEM.

YOU REPRESENT BY HOW MUCH TAX YOU CHARGE NOW VERSUS A COUNTY.

THEN WE CAN HAVE 3 AT LARGE WHERE YOU GET ONE VOTE AND YOU CAST THAT ONE VOTE FOR THAT PERSON.

THAT MAKES YOU AS POWERFUL AS FORT WORTH, AS POWERFUL AS ARLINGTON.

AND I CHECKED WITH THE CITY, WITH THE BOARD'S ATTORNEY FOR THE APPRAISAL DISTRICT.

HE REVIEWED IT. HE SAYS IT MEETS THE [INAUDIBLE] LAW.

SO WHAT DID I DO? I TURNED IT OVER TO TIM O'HARE, HOPING THAT HE WOULD DISCUSS IT AMONGST COMMISSIONERS, PASS IT AND THEN SEND IT OUT FOR A VOTE FOR ALL THE PEOPLE WHO PARTICIPATE AT THE APPRAISAL DISTRICT, THAT FELL ON DEAF EARS THAT WAS IN MARCH.

SO AFTER THIS CYCLE, I'M GOING TO GO BACK TO YOU ALL AND SAY I HAVE SOMETHING BETTER THAN WHAT THE STATE DID, AND WE DON'T NEED THEM IN OUR BUSINESS.

THIS FIRST ITEM INVOLVES THE ZONING REQUEST THAT THEY SUBMIT TO CITY STAFF.

IT'S FOR A LITTLE MORE THAN A THIRD OF AN ACRE OF LAND THAT THEY OWN LOCALLY ADDRESS AT 255 CENTER DRIVE.

I BELIEVE WE HAVE TWO INDIVIDUALS IN ATTENDANCE TONIGHT REPRESENTING THE COMPANY IF THERE ARE ANY QUESTIONS.

JUST BY WAY OF WHAT'S BEING REQUESTED, THERE IS THE MAJORITY OF A 4.4 ACRE SITE THAT'S ALREADY ZONED INDUSTRIAL, AND WE HAVE THIS LITTLE SMALL PORTION OF LAND THAT WAS LEFT OUT OF THAT ZONING AND THEY'RE TRYING TO INTEGRATE IT IN FOR CONSISTENCY PURPOSES, TO HAVE ALL INDUSTRIAL ZONING, BECAUSE THE INTENT IS TO MAKE USE OF THE PROPERTY.

THEY'VE ALSO SUBMITTED A COMMERCIAL SITE PLAN IN CONJUNCTION WITH THE ZONING CASE THAT I'LL BE PRESENTING TO YOU FOLLOWING YOUR ACTION ON THIS ITEM. AS YOU ALL KNOW, THEY RUN A CONCRETE BATCHING PLANT, WHICH IS A USE THAT IS ALLOWED BY RIGHT.

AS IT PERTAINS TO OUR COMPREHENSIVE PLAN.

IT SITS IN AN AREA FOR REGIONAL OFFICE COMMERCIAL.

WE REALIZE THIS USE IS NOT EXACTLY CONSISTENT WITH THAT, BUT THE MAJORITY OF THE BUSINESS HAS BEEN IN THIS AREA OF THE CITY FOR YEARS.

AND SO THE LAND USE PLAN ALREADY AFFECTS THE EXISTING PORTION OF THEIR BUSINESS AND THEY'RE SIMPLY LOOKING TO EXPAND IT.

WE DID PROVIDE NOTICES TO INDIVIDUAL PROPERTY OWNERS WITHIN 300FT OF THE SUBJECT SITE.

DURING OUR PRESENTATION OF THE ITEM TO THE PLANNING AND ZONING COMMISSION THEY TOOK A VOTE AND RECOMMEND APPROVAL OF THE ZONING REQUEST BY A UNANIMOUS DECISION. THERE WERE NO SPEAKERS.

STAFF IS SUPPORTIVE OF THE CHANGE FROM AGRICULTURAL TO INDUSTRIAL ZONING.

THIS THIS BASICALLY UNIFIES THE ENTIRETY OF THEIR LAND HOLDINGS WITHIN ONE BASIC INDUSTRIAL ZONING DISTRICT.

SO PRIOR TO OPENING THE PUBLIC HEARING, I'LL ANSWER ANY QUESTIONS THAT YOU HAVE, IF THERE ARE ANY.

SO THEY AREN'T NECESSARILY DOING ANYTHING DIFFERENT WITH THIS LITTLE CUTOUT THAT IS STILL ZONED AGRICULTURAL.

THEY'RE JUST GOING TO UTILIZE THAT SPACE.

THE FIRST WAIVER IS ONE THAT'S DEALING WITH ARCHITECTURAL DESIGN.

BASICALLY, WE REQUIRE A PRIMARY ENTRYWAY FACING A PRINCIPAL STREET AND THEN A SIDEWALK.

THE PROPERTY OWNER WOULD LIKE TO ORIENT THE BUSINESS SO THAT THE PRIMARY ENTRYWAY DOESN'T FACE THE STREET, BUT FACES RATHER THE SIDE OF THE PROPERTY TO ALLOW A BETTER VANTAGE POINT FOR THE OPERATIONS GOING ON, SIDEWALK WOULD BE PROVIDED.

THE JUSTIFICATION IS WITH IT BEING AN INDUSTRIAL SITE, THEY ARE LOOKING TO ORIENT THE BUILDING, AS YOU SEE IN THE LIGHT BLUE SHADING AWAY FROM THE FRONT OF

SO THE ILLUSTRATION THAT YOU SEE IS ESSENTIALLY THE BUILDING.

BUT ON THE SOUTH FACADE, THEY'RE NOT INTERESTED IN LOOKING TO PROVIDING THE GLAZING AND THAT'S THAT SOUTH ELEVATION THAT WE HAVE ON THE SCREEN IN FRONT OF YOU.

AND AS SUCH, STAFF FEELS THAT THIS IS AN APPROPRIATE DESIGN FOR THE BUILDING WITH THE AMOUNT OF WINDOWS THAT WE HAVE, WHICH IS BASICALLY LOW TENANT IN NATURE WITH THE THERMAL BREAK ALUMINUM FRAME THAT YOU SEE ON THE CALL OUT OF THE ELEVATION.

AND THEN A GUARD RAIL THAT'S ELEVATED.

YOUR NEXT IS A BUILDING DESIGN REQUIREMENT WHERE WE NEED TO HAVE THREE BUILDING DESIGN ELEMENTS AS PROVIDED IN OUR CODE.

SO JUST TO GIVE YOU SOME RUNDOWN OF THE TYPES OF THINGS THAT OUR CODE REQUIRES, WE'RE LOOKING FOR THINGS SUCH AS CANOPIES OR PORTICOS, OVERHANGS, ARCADES, SCULPTURED ARTWORK, PEAKED ROOF FORMS, ARCHES AND DISPLAY WINDOWS, NONE OF WHICH TYPICALLY APPLY TO A BATCHING PLANT. THEY ARE NOT GOING TO BE ABLE TO MEET THAT REQUIREMENT BASED ON THE SITE PLAN THAT HAS BEEN SUBMITTED BY STAFF.

PERMANENT SPEED LIMITS ARE TYPICALLY DETERMINED THROUGH AN ACTUAL TRAFFIC STUDY, AND IT'S OBVIOUSLY BEST TO DO THAT TRAFFIC STUDY AFTER THE ROAD HAS ACTUALLY BEEN CONSTRUCTED AND IN OPERATION SO THAT IT CAN ACTUALLY BE OBSERVED.

AS A RESULT OF THE DEVELOPMENT CITY HIRED KIMLEY-HORN AND ASSOCIATES TO CONDUCT THAT STUDY.

THAT STUDY WAS COMPLETED EARLIER THIS SUMMER, SO WE'RE BRINGING IT FORWARD TO YOU NOW TO OFFICIALLY SET THE PERMANENT AND OFFICIAL SPEED LIMIT BASED ON THOSE INDUSTRY STANDARD TRAFFIC ENGINEERING PROCEDURES AND ANALYSIS.

THE RESULTS OF THE STUDY? WELL, A LITTLE BIT ABOUT THE STUDIES GENERALLY RECOMMEND THAT THE 85TH PERCENTILE SPEED BE SET AS A SPEED LIMIT OR THEREABOUT TECHNICAL SPEED. BUT BASICALLY THEY MONITOR TRAFFIC ALONG ALL THE LEGS OF THE ROADWAY RECORDING THE SPEED THAT EACH INDIVIDUAL VEHICLE TRAVELS AT.

AND THEN WE'RE BASICALLY LOOKING FOR AT WHAT SPEED DO 15% OF THE VEHICLES DRIVE FASTER THAN.

THAT BASICALLY GIVES YOU THE 85TH PERCENTILE SPEED, WHICH COINCIDES WITH THE RECOMMENDATION THAT CAME OUT OF THE STUDY.

SO AS INDICATED ON THE SLIDE HERE, THE 85TH PERCENTILE SPEEDS RANGE FROM 33 TO 37MPH.

AND THE PROFESSIONAL TRAFFIC ENGINEERS RECOMMENDATION IS THAT WE ESTABLISH A 35 MILE PER HOUR SPEED LIMIT.

CHAPTER 380 OF THE LOCAL GOVERNMENT CODE REQUIRES THAT THE CITY ADOPTS THEIR INCENTIVE POLICY EVERY TWO YEARS.

BACK IN 2020, CITY COUNCIL APPROVED THE POLICY WITHOUT ANY CHANGES TO THE LAST UPDATED POLICY IN 18, AND THOSE INCLUDED MORE CLEAR AND CONCISE APPLICATION TO INCLUDE WAGE INFORMATION, CAPITAL INVESTMENT, SALES TAX GENERATION.

IN 2022, THE COUNCIL UPDATED THE POLICY TO INCLUDE THE BURLESON HOME IMPROVEMENT REBATE PROGRAM.

THAT PROGRAM PROVIDES INCENTIVES UP TO $5,000 TO CERTAIN ELIGIBLE OWNER OCCUPIED HOME OWNERS TO MAKE IMPROVEMENTS TO THEIR HOME.

HOMES MUST BE 25 YEARS OR OLDER.

THE CAD APPRAISED VALUE MUST BE LESS OR EQUAL TO 70% OF THE FHA SINGLE FAMILY MORTGAGE LIMIT IN THE COUNTY FOR THE CURRENT YEAR OF THE APPLICATION.

SOME OF THE OTHER POLICY REQUIREMENTS THEY REQUIRE COMMERCIAL OR RETAIL DEVELOPMENT TO ADD NEW TO MARKET USES AND USERS AND EXCEED $5 MILLION IN TAXABLE SALES TO QUALIFY FOR INCENTIVES.

VALUE OF ANY ABATEMENT SHALL NOT EXCEED 50% OF INVESTMENT BY THE BUSINESS IN ELIGIBLE PROPERTY.

ALSO MEETING THE REQUIREMENT OF THE JOHNSON COUNTY MEDIAN WAGE AS WELL AS THE LIVING WAGE REQUIREMENT.

MINIMUM CAPITAL INVESTMENT OF $10 MILLION ON PROJECT.

THE PROJECT ALSO NEEDS TO EXPAND THE LOCAL TAX BASE.

THE PROJECT CREATES PERMANENT FULL TIME EMPLOYMENT OPPORTUNITIES, WITH 25% OF THOSE EMPLOYEES BEING PAID ABOVE THE JOHNSON COUNTY MEDIAN WAGE IS CALCULATED BY THE BUREAU OF LABOR STATISTICS AND ALL EMPLOYEES ABOVE THE GREATER OF AVERAGE LIVING WAGE.

LOOKING AT TWO ADULTS, TWO CHILDREN FOR JOHNSON COUNTY, AS CALCULATED BY THE FOLLOWING GOING TO THE LINK THROUGH THE MIT.

THEY HAVE A CALCULATOR THERE THAT YOU CAN SEE WHAT THE LIVING WAGE IS AND IT CHANGES FROM YEAR TO YEAR.

OVER 65% OF THE JOHNSON COUNTY MEDIAN WAGE AS CALCULATED BY THE BUREAU OF LABOR STATISTICS.

ALSO, THE PROJECT IN ALL LIKELIHOOD, WOULD NOT OTHERWISE BE DEVELOPED.

FIRST, I'D LIKE TO ASK YOU FOR SUPPORT FOR ME ON THE CAD BOARD.

MANY SEE THIS AS A CLEVER WAY TO RAISE TAXES WHEN THEIR ACTUAL TAX RATES ARE FIXED.

YOU SEE, IT IS IMPORTANT TO CONSIDER THE FEELINGS OF THOSE WE REPRESENT AND THEIR RIGHTS OF OWNERSHIP.

RECENTLY, I HEAR FROM MANY SOURCES STATEMENTS OF DISCONTENT BY RESIDENTS OF APPRAISED VALUES OF THEIR REAL PROPERTY, INCLUDING OUR REAL PROPERTY.

I FEEL THE PINCH MYSELF SOMETIMES.

IN VIEW OF THE PUBLIC INTEREST IN RECENT TAX LEGISLATION IN THIS STATE.

THE NEXT PUBLIC TARGET WILL SURELY BE THE APPRAISALS AND THE BOARD THAT SETS THE PROCESS AND AFFECTS THE APPRAISAL OF THEIR PROPERTIES.

I FEEL THAT, ABOVE ALL ELSE, KEEPING THE TAXPAYERS INFORMED ON THE BENEFITS OF HAVING ROBUST COUNTY SERVICES AND SCHOOLS TO SUPPORT OUR CITIZENS IS CRITICAL.

IT'S ALSO CRITICAL THAT OUR COMMUNITY IS ABLE TO FEEL THAT THEY HAVE A CONDUIT TO THE APPRAISAL BOARD AND THAT ITS DECISION MAKING PROCESS.

IN OTHER WORDS, I WANT TO ENROLL THE PEOPLE, THE TAXPAYERS, IN THE PROCESS OF THE CAD BOARD, NOT TO SHUT THEM OUT, BUT TO BRING THEM IN.

AS A BOARD MEMBER, I WILL STRIVE TO MEET THE GOALS AND NEEDS OF BOTH MY BOARD AND THE PEOPLE WE BURDEN.

AT WHAT POINT CAN THESE PEOPLE AND THE REST OF US RELAX AND OWN OUR OWN HOMES AND PROPERTIES.

AS THINGS ARE NOW THE PROPERTY TAX MAN OWNS OUR HOMES IN PERPETUITY.

I'M ALL FOR ENDING PROPERTY TAXES, BUT IN THE MEANTIME, I WANT TO BE ON THE CENTRAL APPRAISAL BOARD IN ORDER TO DO MY PART IN TRYING TO KEEP OUR PROPERTY TAXES AS LOW AS POSSIBLE. THE PROPERTY TAX RATES WE ARE SEEING LATELY ARE UNSUSTAINABLE AND WE JUST CAN'T KEEP TURNING A BLIND EYE TO THE PAIN BEING CAUSED TO THOSE WHO JUST CAN'T AFFORD THE PROPERTY TAX MAN'S ONGOING HUNGER FOR MORE AND MORE PROPERTY TAXES.

WE'RE A JANITORIAL COMPANY, SO ACTUALLY STEPPED OUT AND AWAY FROM BANKING WHEN I RETIRED JUST TO HAVE A COMPLETELY DIFFERENT PERSPECTIVE ON LIFE.

TALK ABOUT WATER PROJECTS IN A TEN YEAR LOOK AHEAD, AND THEN ALSO WASTEWATER PROJECTS.

MASTER PLANNING CONSIDERS A NUMBER OF DRIVERS FUNDAMENTALLY ALL WITH THE GOAL OF TRYING TO MAXIMIZE LIMITED CAPITAL INVESTMENT DOLLARS.

SO I WON'T READ MOST OF THESE SLIDES.

AGAIN, THE INTENT IS TO GIVE YOU A VERY HIGH LEVEL OVERVIEW.

ONE, THAT THE POPULATION SERVE FOR WATER SERVICES IS NOT THE SAME AS THE POPULATION FOR WASTEWATER.

SO WE HAVE TWO DIFFERENT CERTIFICATE OF CONVENIENCE OR NOT CONVENIENCE, BUT TWO DIFFERENT SERVICE AREAS FOR WATER AND WASTEWATER. SO THESE MASTER PLANS ARE BUILT BASED ON THE CORRESPONDING LAND AREA.

BUT IT'S ALSO IMPORTANT TO KNOW THAT BOTH OF THESE POPULATIONS ARE EXPECTED TO MORE THAN DOUBLE BETWEEN TODAY WHEN THEY'RE BOTH AROUND 46 TO 50,000 PEOPLE TO BUILD OUT OR 40 YEARS OUT, WHICH WILL BE WELL OVER 100,000 FOR BOTH.

THAT'S NOT TO SAY THE POPULATION OF BURLESON WILL BE WELL OVER 100,000, BUT THE AREA IS SERVED BY BURLESON FOR WATER AND IN THE AREA SERVED FOR SEWER THAT THOSE POPULATIONS WILL EXCEED 100,000 BASED ON CURRENT PROJECTIONS.

SO THIS NEXT SLIDE GIVES KIND OF A VISUAL PRESENTATION OF THAT SAME INFORMATION.

THAT'S ANOTHER PROJECT THAT IS ACTUALLY BEING DESIGNED RIGHT NOW AS PART OF THE HULEN STREET WIDENING PROJECT.

AND THEN THERE ARE ALSO PROJECTS THAT FOCUS STRICTLY ON GROWTH AND DEVELOPMENT, LIKE SOME PROJECTS RELATED TO HYDER RANCH.

OVER ON THE WASTEWATER SIDE.

WE'RE LOOKING AT SLIGHTLY LARGER NUMBER, $126 MILLION.

AGAIN, HIGH LEVEL, BUT A FEW OF THOSE EXAMPLES INCLUDE THE VILLAGE CREEK PARALLEL INTERCEPTOR.

AGAIN, THAT'S A PROJECT THAT YOU AWARDED A DESIGN CONTRACT EARLIER THIS YEAR, THIS SPRING ON.

SO THAT WILL BE HEADING INTO CONSTRUCTION, PROBABLY THE LATTER PART OF 2024.

AND THEN OTHER PROJECTS RELATED TO CHISHOLM SUMMIT, CRAFTMASTERS, AND HYDER RANCH.

SO THE SECOND PIECE WOULD BE THE MOBILITY PLAN.

THE SECOND MASTER PLAN THAT WE WANTED TO TALK ABOUT TONIGHT.

SO THE DRAFT MOBILITY PLAN SEEKS TO REPLACE THE 2015 WHAT WAS THEN WHAT'S NOW CALLED THE MASTER MOBILITY PLAN.

IT'S THE LAST ONE ADOPTED BY COUNCIL.

THIS PLAN WOULD ALSO UPDATE THE THOROUGHFARE PLAN.

AND THEN IMPORTANTLY, IT PROVIDES A FRAMEWORK FOR ADDRESSING THE MULTIMODAL TRANSPORTATION NEEDS FOR THE CITY.

THAT'S BICYCLES, SIDEWALKS, TRAILS AND ROADS.

THE NEXT SLIDE PROVIDES A VERY HIGH LEVEL OVERVIEW OF KIND OF AN OUTLINE OF THAT DOCUMENT.

WELL, WE COULD, BUT WHAT IT WOULDN'T RESULT IN, IT WOULDN'T HELP US, RIGHT? SO AS YOU SEE AT THE VERY BOTTOM HERE, THE THOROUGHFARE PLAN THAT'S INCLUDED IN THE DRAFT MOBILITY PLAN INCLUDES KEY ETJ CONNECTIONS IN THE MODEL SO THAT WE HAVE DECENT, ACCEPTABLE LEVEL OF SERVICE.

SO NOT TOO MUCH TRAFFIC OR CONGESTION.

THIS SLIDE FOCUSES ON THE CURRENT THOROUGHFARE PLAN.

SO IF YOU FOCUS OVER ON THE RIGHT HAND SIDE, THESE YELLOW LINES AND THEN THE DARK LINES THAT

THIS SLIDE IS JUST A LIST OF THOSE ROADS THAT ARE FAILING OR NEAR FAILING WITH THE CURRENT THOROUGHFARE PLAN.

SO AS YOU CAN SEE FROM THIS LONG LIST, THERE ARE SEVERAL CORRIDORS THAT WILL HAVE SIGNIFICANT CONGESTION JUST BASED ON THE ROADS THAT ARE INCLUDED IN THE CURRENT THOROUGHFARE PLAN.

END RESULT BEING THAT WE WILL PROBABLY NEED MORE THOROUGHFARES TO BE CONSTRUCTED.

AND WITH ALL THE GROWTH THAT'S HAPPENING, THAT'S PROBABLY NOT A SURPRISE TO YOU.

AND THAT'S PARAPHRASING BUT OUT OF THE STATE LOCAL GOVERNMENT CODE, WHICH REALLY DICTATES HOW IF A CITY IS GOING TO HAVE IMPACT FEES, IT PRETTY MUCH TELLS US HOW WE'RE GOING TO IMPLEMENT THEM.

SO MORE ABOUT THE LOCAL GOVERNMENT CODE.

AGAIN, THEY ESTABLISHED VERY SPECIFIC REQUIREMENTS FOR THE ADOPTION OF IMPACT FEES, REQUIREMENTS FOR LAND USE ASSUMPTIONS.

THE CITY ACCOMPLISHES THAT THROUGH THE COMPREHENSIVE PLAN AND MORE RECENTLY, THE MID-POINT UPDATE TO THE COMPREHENSIVE PLAN, IT REQUIRES THAT WE HAVE ADOPTED CAPITAL IMPROVEMENT PLANS THAT ARE SPECIFIC TO THE IMPACT FEES AND THAT WE ESTABLISH SERVICE UNITS.

AND THIS IS WHERE WE START TO GET INTO THE MATH AND ALL THE ANALYSIS.

IT EVEN ESTABLISHES PROCESSES FOR HOW YOU CHANGE THE FEES.

SO YOU HAVE TO HAVE PROVIDE CERTAIN NOTICES TO THE PUBLIC AND THEN YOU HAVE TO HAVE PUBLIC HEARINGS.

SO EARLIER TONIGHT, IN THE CONSENT AGENDA, YOU APPROVED AN ITEM THAT ESTABLISHED THE PUBLIC HEARING FOR NOVEMBER 13TH TO LOOK AT IMPACT FEES FOR BOTH WATER WASTEWATER AND FOR ROADWAY IMPACT FEES.

THE STATE LAW ALSO TELLS YOU HOW TO APPOINT AN ADVISORY COMMITTEE.

AND THEN ALSO GETS INTO, YOU KNOW, THE REQUIREMENTS FOR HOW YOU COLLECT THE IMPACT FEES.

HERE IN BURLESON, THE FEES ARE ASSESSED WHEN THE PLAT IS RECORDED, BUT THEY'RE NOT COLLECTED UNTIL LATER WHEN A BUILDING PERMIT IS ISSUED OR A CONNECTION IS MADE TO THE WATER SEWER SYSTEM.

THE STATE LAW ALLOWS FOR IMPACT FEES TO COVER WATER, SEWER, DRAINAGE AND ROADWAYS AND BURLESON HAS IMPACT FEES FOR ALL OF THOSE EXCEPT DRAINAGE CURRENTLY.

THIS IS A LITTLE SNAPSHOT OF IMPACT FEES ACTUALLY COLLECTED BETWEEN MARCH OF 2019 AND A COUPLE OF WEEKS AGO.

SO YOU SEE IT'S A LITTLE OVER $10 MILLION WITH A BREAKDOWN BETWEEN ROADWAY AND THEN WATER WASTEWATER.

THERE'S A NOTE AT THE BOTTOM ABOUT FORT WORTH IMPACT FEES NOT BEING INCLUDED BECAUSE THERE'S PASS THROUGH IMPACT FEES FOR THE CITY OF FORT WORTH ON THE WATER WASTEWATER SIDE THAT ALSO HAVE TO BE PAID BY DEVELOPMENT IN BURLESON. SO I MENTIONED EARLIER THAT EARLIER THIS YEAR, SO MARCH OF 2023, CITY COUNCIL APPOINTED A NEW AND EXPANDED ADVISORY COMMITTEE OF EIGHT MEMBERS.

I THINK WE HAVE OUR CHAIRWOMAN IN THE AUDIENCE TONIGHT.

I THINK YOU'LL HEAR FROM HER SHORTLY.

SO THERE ARE EIGHT OF THE NINE SEATS FILLED BACK IN MARCH AND THEN RECENTLY, JUST A FEW LESS THAN A MONTH AGO, THE NINTH MEMBER WAS APPOINTED. SO SHE WILL JOIN THE GROUP AT ITS NEXT MEETING, WHICH IS LIKELY TO BE IN NOVEMBER.

STATE LAW REQUIRES THAT AT LEAST FIVE MEMBERS AND 40% OF THE MEMBERS BE FROM THE REAL ESTATE DEVELOPMENT OR BUILDING INDUSTRY AND YOUR APPOINTMENTS MORE THAN MEET THAT REQUIREMENT. SO A LITTLE BIT ABOUT THE SCOPE OF THE COMMITTEE.

THE COMMITTEE HAS TO MEET AT LEAST TWICE ANNUALLY TO FILE SEMIANNUAL REPORTS ON THE IMPACT FEE PROGRAMS. SO AGAIN, WE HAVE ONE PROGRAM FOR WATER WASTEWATER AND A SECOND PROGRAM FOR ROADWAY.

THEY ALSO REVIEW THE ANALYSIS OF THE VARIOUS CONSULTANTS RESPONSIBLE FOR UPDATING THE FEES EVERY FIVE YEARS.

AT LEAST LOOKING AT WE DON'T HAVE TO CHANGE THE FEES, BUT WE AT LEAST HAVE TO DO THE ANALYSIS TO DETERMINE IF CHANGES ARE NEEDED.

THAT INCLUDES LOOKING AT OUR LAND USE ASSUMPTIONS, DEVELOPING A CAPITAL IMPROVEMENT PROGRAM THAT MATCHES THE IMPACT

AND THEN MOST IMPORTANTLY, THE CONSULTANT, THE COMMITTEE, THE ADVISORY COMMITTEE HAS TO PROVIDE RECOMMENDATIONS TO YOU FOR POTENTIAL UPDATES TO THE IMPACT FEES.

SO AS AN EXHIBIT TO THIS ITEM IN YOUR PACKET WAS A FEW PAGE LETTER OR MEMO FROM THE COMMITTEE PROVIDING THEIR RECOMMENDATIONS AND IN A FEW SLIDES WE'LL KIND OF TALK THROUGH THEIR RECOMMENDATIONS, BUT I WANTED TO PROVIDE YOU THAT THAT COMMUNICATION FROM THEM AS WELL.

AND THROUGH THESE MEETINGS I GAVE THEM OR THE INTENT WAS TO GIVE THEM THE BACKGROUND AND AN UNDERSTANDING.

THEY WERE VERY INTERACTIVE MEETINGS.

SO I WAS VERY HAPPY TO WORK WITH THE COMMITTEE JUST BECAUSE EVERY MEMBER WAS VERY ACTIVE AND PARTICIPATED.

BUT EVERYTHING HAS INCREASED IN COST OVER THE LAST SEVERAL YEARS WITH SIGNIFICANT INFLATION, ETCETERA.

IT'S BASICALLY AN INDEX THAT THEY KEEP ON HIGHWAY OR PUBLIC INFRASTRUCTURE COSTS.

ROADWAY IMPACT FEES ARE ASSESSED BY SERVICE AREA, SO THE CITY IS DIVIDED INTO FOUR ZONES, IF YOU WILL, A THROUGH D, THE SECOND COLUMN GIVES YOU THE MAXIMUM ALLOWABLE FEE.

SO AGAIN, THAT'S SOMETHING THAT'S PRESCRIBED BY STATE LAW THAT HAS TO BE ANALYZED AND DETERMINED.

AND THIS IS WAS ONE OF THE INTENTIONAL CHANGES OR RECOMMENDATIONS THAT THE COMMITTEE WANTED TO MAKE WAS THAT WE WOULD BASE ALL OF THE FEES ON THE ANALYSIS FOR EACH OF THE AREAS.

SO ALLOWABLE FEES WE USE THAT ACROSS THE BOARD, IT LOOKS LIKE.

IS THAT ENOUGH MONEY FOR US TO AT LEAST BREAK EVEN ON ON WHAT'S COSTING US? I MEAN, HOW DOES THAT SHOW UP ON THE CHARTS YOU HAD? WELL, SO THE ALLOWABLE IS THE MAXIMUM THAT THE PROCESS PRESCRIBED BY STATE LAW WOULD ALLOW US TO CHARGE.

RIGHT. AND WE'RE TAKING ADVANTAGE OF THAT.

I UNDERSTAND THAT. AND THIS IS.

BUT IS THAT ENOUGH? ARE YOU LOOKING AT YOUR CHART WHERE WE'RE DIPPING DOWN, IF WE EVEN GO TO THIS? IS THAT GOING TO BE ENOUGH TO GET US IN THE BLACK? SO I WOULD EXPECT NEWER AND LARGER NUMBERS FROM SOME OF THESE CITIES IN THE NEXT FEW MONTHS.

MANSFIELD KIND OF IN THE MIDDLE, THEIR NEW NUMBER IS $4,900 AND JUST THREE MONTHS.

FOUR MONTHS AGO, I THINK IT WAS LESS THAN HALF THAT.

WE HAD SOME DEVELOPER OUTREACH IN AUGUST OF 2023 PRESENTING THEIR RECOMMENDATIONS TO YOU TONIGHT.

YOU ALSO VOTED TO ESTABLISH A PUBLIC HEARING NEXT MONTH, NEXT MONTH ON THE 13TH, WE'LL GET THE POSTING OUT IN THE PAPER TO HAVE A PUBLIC HEARING ON POTENTIALLY CHANGING THE FEES.

THERE WILL ALSO BE ITEMS TO ADOPT THE WATER AND WASTEWATER MASTER PLAN AND TO ADOPT THE MOBILITY PLAN.

DECEMBER 11TH WOULD BE SECOND OR FINAL READING OF THAT ORDINANCE TO POTENTIALLY UPDATE OR CHANGE THE FEE IMPACT FEES.

AND THEN IN THAT ORDINANCE, YOU WOULD ALSO SET AN EFFECTIVE DATE FOR THE NEW FEES.

SO IN LESS THAN SIX HOURS.

THERE WERE NINE BURLESON RESIDENTS, ALL OF US HAVING BACKGROUND IN BUSINESS REAL ESTATE DEVELOPMENT, INCLUDING ENGINEERING.

SO WE WERE PRETTY KNOWLEDGEABLE ABOUT WHAT'S GOING ON IN THE AREA.

AS FAR AS ONE, FOR ME, THE DEVELOPMENT COMING IN, THE HOUSING PROCESS AND THINGS THAT OUR POTENTIAL BUYERS ARE LOOKING FOR.

THE GENERAL PHILOSOPHY OF THE IMPACT FEE PROGRAM IS THAT NEW DEVELOPMENT SHOULD PAY FOR SOME PORTION OF THE NEW PUBLIC WATER, WASTEWATER AND ROADWAY INFRASTRUCTURE REQUIRED TO SERVE NEW DEVELOPMENT.

WE OBVIOUSLY HAVE A LOT OF NEW DEVELOPMENT AND GROWTH IN THE CITY OF BURLESON.

THE CPAC MET A SCHEDULED FIVE TIMES FOR A MINIMUM OF TWO HOURS EACH TIME WE LISTENED TO THE RESPECTIVE DEVELOPMENT DEPARTMENT, CITY STAFF, CONSULTANTS, ATTORNEYS, THE CONSULTANTS FROM KIMLEY-HORN REGARDING ROADWAY IMPACT FEES, CONSULTANTS FREESE AND NICHOLS REGARDING WATER AND WASTEWATER IMPACT FEES, I WILL HONESTLY SAY I HAD NO IDEA HOW MUCH WATER RAN THROUGH THE CITY OF BURLESON.

WE GO THROUGH A LOT AND THEN LOOK AT THE WASTEWATER.

WE USED ALL OF THE DATA FROM THE CONSULTANTS AND STAFF AND COMPARED TO OTHER CITIES OF OUR SIZE TO COME UP WITH WHAT WE FEEL IS A FAIR AND OBTAINABLE PLAN FOR FURTHER DEVELOPMENT IN THE CITY OF BURLESON.

THIS WAS TIME CONSUMING AND AN ARDUOUS TASK.

WE TOOK IT VERY SERIOUSLY THAT WE COMMITTED AND VOLUNTEERED TO DO.

NOW, FORT WORTH WILL ASSESS THE PASS THROUGH FEE ON THE UTILITY ENTITY THAT HOLDS THE CERTIFICATE OF CONVENIENCE AND NECESSITY TO SERVE THAT AREA.

THEY MAY JOHNSON SPECIAL UTILITY DISTRICT OR BETHESDA WATER.

THEY'LL HAVE TO PAY THE PASS THROUGH FEE ON AREAS THEY SERVE.

OKAY. ASSUMED IT GOT COLLECTED BY SOMEBODY.

YES. AS A SIDE NOTE, [INAUDIBLE] IS ACTUALLY IMPLEMENTING AN IMPACT FEE AS WELL RIGHT NOW.

SO IF YOU HAVEN'T HEARD, YOU'LL PROBABLY HEAR THAT RELATIVELY SOON.

YEAH. I MEAN, I THINK THE TOUGH NUT TO SWALLOW IS JUST HOW MUCH THESE FEES ARE GOING UP.

BUT CONSIDERING THAT THEY'RE BASED ON 2017 NUMBERS, IT'S OBVIOUSLY GOING TO BE A BIG JUMP.

BUT I'VE SAID FOR A LONG TIME THAT WE WE'RE STEADILY LOSING GROUND ON THE LEVEL OF SERVICE OF OUR ROADWAY INFRASTRUCTURE.

AS ERIC OSCARSON HAS POINTED OUT BEFORE, WE ARE ALREADY BEHIND IN SPENDING ON MAINTAINING WHAT WE ALREADY HAVE BUILT AND RESPONSIBLE FOR KEEPING UP A LEVEL OF SERVICE.

AND I KNOW WE'RE ABOUT TO SPEND A LOT OF EFFORT AND TIME TO TRY TO GET A BETTER HANDLE ON JUST EXACTLY HOW FAR BEHIND WE ARE AND HOW AND WHAT WE NEED TO DO TO CATCH BACK UP.

BUT I THINK WE'RE GOING TO HAVE TO ACCEPT THAT THIS KIND OF A JUMP IS REALLY THE NECESSARY ANSWER THAT WE HAVE TO VOICE TO THOSE PEOPLE IN THE COMMUNITY WHO RIGHTLY CLAIM THAT WE ARE ENGAGING IN DEVELOPMENT ALL ACROSS THE CITY WITHOUT HAVING THE INFRASTRUCTURE IN PLACE TO SUPPORT IT ALREADY.

AND THIS IS NOT GOING TO FIX THAT BY ANY MEANS.

IT'S GOING TO CONTRIBUTE TOWARDS THE FIX, BUT IT'S NOT GOING TO FIX IT.

WE HAVE A LOT MORE THINGS TO CONSIDER.

I THINK IT MIGHT BE TIME AND THIS IS PERHAPS A BIT OFF TOPIC TO BRING UP THE IDEA THAT WE MIGHT BE NEEDING TO REEXAMINE WHY WE ARE THE ONLY COMMUNITY SURROUNDING US THAT DOESN'T CHARGE A STORMWATER IMPACT FEE OR A STORMWATER UTILITY FEE FOR OUR PROPERTIES.

AND WE'VE HAD THAT COME UP BEFORE THIS COUNCIL SOME YEARS BACK AND IT DID NOT GET THE COUNCIL'S APPROVAL.

BUT AT THE SAME TIME, MONEY REQUIRED TO MAINTAIN DRAINAGE IN THE CITY IS JUST AS IMPORTANT AS MONEY REQUIRED TO MAINTAIN TRAFFIC.

EXCEPT NOW WE'RE HAVING TO MAINTAIN THE STORMWATER IMPROVEMENTS AND IMPROVE THEM USING BOND MONEY THAT COULD PROBABLY BE MUCH MORE EFFECTIVELY SPENT AND PERHAPS VISIBLY SPENT IF WE WERE SPENDING IT ON ROADWAYS.

SO THAT MIGHT BE ONE KIT, ONE TOOL THAT WE NEED TO PUT IN OUR KIT GOING FORWARD IF WE'RE GOING TO EVER CATCH UP ON INFRASTRUCTURE EXPANSION AND INFRASTRUCTURE MAINTENANCE OF EXISTING FACILITIES, IF WE'VE GOT ANOTHER REVENUE SOURCE TO DRAW FROM TO TAKE CARE OF SOME OF THE NECESSARIES, NOBODY CARES ABOUT WATER LINES THAT WE PUT IN.

THEY TURN THE TAP ON. THEY EXPECT WATER TO FLOW, THEY FLUSH THE TOILET, THEY EXPECT IT TO GO AWAY.

THERE'S NO IMPROVEMENT IN ANYBODY'S LIFE BY THAT UNLESS SOMETHING BREAKS.

ROADWAYS DIFFERENT STORY.

AND I THINK IF WE'RE GOING TO TRY TO MAKE IMPROVEMENTS THAT PEOPLE WILL SEE AND THAT WILL AFFECT THE QUALITY OF LIFE, AS IT WERE, IN GETTING IN AND AROUND OUR CITY, THAT WE CAN USE ALL THE HELP WE COULD ON THE REVENUE SIDE.

AND SO THIS WILL BE ONE KEY.

PERHAPS WE NEED TO ONCE AGAIN, LIKE I SAID, LOOK INTO THE STORMWATER IMPACT AND UTILITY FEE AS WELL.
