THIS IS 3:31 AND TIME TO CALL TO ORDER THE MEETING OF THE 4A ECONOMIC DEVELOPMENT CORPORATION FOR TODAY MONDAY, JULY 10TH, 2023.

FIRST ITEM ON OUR AGENDA TONIGHT IS TO APPROVE THE MINUTES FROM OUR LAST MEETING, WHICH WAS JUNE 20TH OF 2023.

[2.A. Consider approval of the minutes from the June 20, 2023 Economic Development Corporation (Type A) meeting. (Staff Contact: Amanda Campos, City Secretary)]

IF THE MEMBERS HAVE A MOMENT TO PERUSE THESE AND SEE IF THEY AGREE WITH THE THE WAY HISTORY HAS RECORDED THIS, I'LL BE READY FOR A MOTION.

SO WE'LL MOVE ON TO ITEM FOUR OR ITEM FOUR A TO CONSIDER APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT WITH MYCOSKIE AND ASSOCIATES INC, DBA, MMA

[4.A. Consider approval of a professional services agreement with Mycoskie & Associates, Inc. dba MMA, Inc. in the amount of $206,100. (Staff Contact: Errick Thompson, Deputy Director Public Works – Engineering)]

INC IN THE AMOUNT OF $206,100.

THIS WILL BE PRESENTED BY ERRICK THOMPSON, DEPUTY DIRECTOR OF PUBLIC WORKS ENGINEERING.

GOOD AFTERNOON, SIR. GOOD AFTERNOON.

THERE IT IS. SO THIS AFTERNOON WE HAVE AN AMENDMENT TO AN EXISTING CONTRACT FOR STORMWATER MITIGATION AND SOME ROADWAY DESIGN OUT IN THIS VERY POPULAR HOOPER BUSINESS PARK AREA OF THE WESTERN PART OF TOWN.

THIS AERIAL PHOTO IN THE IN THE TITLE SLIDE HERE IS SHOWING YOUR FOUR LANES OF NEW HIGHWAY, NEW ROADWAY UNDER CONSTRUCTION.

A LOT OF NEW CONCRETE, A LOT OF MOMENTUM OUT THERE SO THAT PROJECTS REALLY MOVING ALONG AND THIS DETENTION OR MITIGATION STORMWATER PROJECT IS REALLY CONNECTED TO IT.

BACK IN 2021, THIS BODY AND THE CITY COUNCIL APPROVED THE PURCHASE OF 106 ACRES OF LAND THAT'S NOW CALLED THE HOOPER BUSINESS PARK. COUNCIL ALSO APPROVED THE ECONOMIC DEVELOPMENT AGREEMENT AND PERFORMANCE AGREEMENT FOR CHISHOLM SUMMIT.

THIS IS ALL PART OF OF THAT MASTER PLAN.

OH, OTHER DIRECTION.

SO AS I MENTIONED, THE LAKEWOOD DRIVE CONSTRUCTION IS CURRENTLY UNDERWAY.

SANITARY SEWER DESIGN IS QUICKLY APPROACHING BEING COMPLETED.

SO WE ANTICIPATE THAT STARTING CONSTRUCTION LATER THIS SUMMER.

OCTOBER OF LAST YEAR, THIS BODY AND CITY COUNCIL APPROVED THE DESIGN CONTRACT WITH MMA FOR STORMWATER FOR THE HOOPER BUSINESS PARK IN THE AMOUNT OF $105,000.

THAT DESIGN HAS BEEN UNDERWAY FOR ROUGHLY SIX 6 OR 8 MONTHS NOW.

EARLIER THIS YEAR, OR ACTUALLY JUST LAST MONTH ACTUALLY YEAR, A NEW AGREEMENT WITH THE CRAFTMASTER DEVELOPMENT WAS APPROVED.

AND YOU MIGHT RECALL THAT PART OF THAT AGREEMENT OBLIGATED THE CITY TO PROVIDE REGIONAL STORMWATER MITIGATION BY SEPTEMBER OF 2026. SO THE PREVIOUS DESIGN CONTRACT WITH MMA INCLUDED DETENTION OR STORMWATER DESIGN FOR THE BUSINESS PARK WITH THE CRAFTMASTER DEVELOPMENT.

ADDING SOME FOOTPRINT TO THAT, WE NEEDED TO EXPAND THE SCOPE OF THE CURRENT DESIGN CONTRACT.

FROM LOOKING AT SOME OF THE PRELIMINARY DESIGN, THERE'S A LOT OF OFF-SITE STORMWATER RUNOFF THAT CONVEYS THROUGH THE BUSINESS PARK PROPERTY.

SO IN ORDER TO MAKE AS MUCH OF THE BUSINESS PARK PROPERTY AVAILABLE FOR DEVELOPMENT AS AS POSSIBLE, WE ASKED MMA TO LOOK AT CHANNELIZING THAT OFF SITE RUNOFF SO THEY WOULD TAKE UP LESS SPACE.

THAT WOULD LEAVE MORE SPACE FOR DEVELOPMENT.

RELATED TO THAT COUNTY ROAD 1019 KIND OF TO THE NORTH AND NORTHWEST, I GUESS YOU WOULD CALL IT, OF THE BUSINESS PARK.

THAT ROADWAY EXPERIENCES, EXTREME FLOODING AND MODERATE RAIN EVENTS NOW.

SO WE ASKED MMA TO ALSO LOOK AT, WELL, COULD WE POTENTIALLY MAKE THAT FLOODING SITUATION A LITTLE LESS SEVERE AS PART OF

THIS STORMWATER DESIGN CONTRACT.

SO TO THAT END, WE ASKED THEM FOR AN EXPANDED PROPOSAL THAT WOULD EXPAND THEIR SCOPE.

THE GRAPHIC ON THIS SLIDE GIVES YOU A LITTLE BIT OF A PRELIMINARY IDEA, BUT YOU CAN KIND OF SEE THE THIS AREA IS THE THE CHANNEL FOR ALL THE ALL THAT OFF SITE FLOW THAT NEEDS TO BE CONVEYED THROUGH THE PROPERTY AND OFF THE PROPERTY.

COUNTY ROAD 1019 IS HERE AND IT MAKES THAT 90 DEGREE TURN BACK TO CONNECT TO FM 1902 AT THE NORTH END.

ORIGINALLY WE WERE THINKING THIS WOULD BE ONE DETENTION POND OR ONE STORMWATER POND FOR THE BUSINESS PARK.

IN TALKING WITH MMA AND WORKING THROUGH THIS OVER THE LAST SEVERAL MONTHS, WE THINK WE CAN MAKE IT A LITTLE MORE ESTHETICALLY PLEASING BY DIVIDING IT INTO TWO PONDS INSTEAD OF ONE VERY LARGE POND.

IT ACTUALLY TAKES UP A LITTLE LESS SPACE, BUT IT GIVES YOU A FEW MORE FEATURES TO MAKE THE OVERALL PROPERTY A LITTLE MORE ATTRACTIVE. SO WE'RE CONSIDERING A REALIGNMENT OF COUNTY ROAD 1019 FROM JUST BEFORE THAT 90 DEGREE TURN TO HAVE IT CONNECT TO A NEW TEMPORARY ROAD THAT WOULD CONNECT DOWN TO LAKEWOOD.

SO LAKEWOOD RUNS LEFT TO RIGHT ACROSS THE BOTTOM.

MOST OF THE CRAFTMASTER DEVELOPMENT IS OFF TO THE BOTTOM OF THE PAGE HERE.

FM 1902 HERE AND JUST OFF THE PICTURE HERE IS CHISHOLM TRAIL TOLLWAY.

SO AT LAKEWOOD EXTENSION, THAT'S ANOTHER RELATED PROJECT THAT'S UNDER DESIGN.

AGAIN, THAT'S A STATE ROUTE OR FM 1902 IS A STATE ROUTE.

SO THERE'S A LOT OF TXDOT REVIEW AND PROCESS THAT WE NEED TO GO THROUGH TO GET TO THAT.

THAT'S APPROXIMATELY A $16 MILLION CONSTRUCTION PROJECT THAT STILL NEEDS TO BE FUNDED.

SO BY THIS, BY CREATING THIS REALIGNMENT OF 1019, THAT WOULD ULTIMATELY CONNECT DOWN TO LAKEWOOD, WE POTENTIALLY OPEN UP A COUPLE MORE PAD SITES FOR OTHER SMALL DEVELOPMENTS IN THE BUSINESS PARK.

THIS AN ATMOS GAS EASEMENT THAT WILL COME BEFORE YOU IN THE NEXT COUPLE OF MONTHS THAT WILL OCCUPY A PIECE OF THIS TRIANGLE, BUT THERE WOULD STILL BE A SITE THAT WE COULD POTENTIALLY DO SOMETHING WITH HERE ON ONE OF THESE NEW CORNERS THAT WE WOULD CREATE.

AND IN ADDITION, WE WOULD GET RID OF THIS FLOODING SITUATION ALONG 1019 FOR THIS ONE PROPERTY OWNER UP HERE AND THEN THERE.

THERE'S A LOT MORE RESIDENTIAL DEVELOPMENT OFF TO THE NORTH AND EAST THAT WOULD ALSO BENEFIT FROM REALIGNING 1019 SLIGHTLY THROUGH THE SITE, THROUGH THE BUSINESS PARK, AND THEN DOWN TO LAKEWOOD.

SO CURRENT CITY DESIGN REQUIREMENTS REQUIRE STORMWATER MITIGATION FOR DEVELOPMENTS OVER ONE ACRE IN SIZE.

SO THAT COULD EITHER BE THROUGH DETENTION PONDS OR RETENTION PONDS.

THIS PICTURE, THIS SLIDE GIVES YOU A COUPLE OF EXAMPLES OF DETENTION PONDS THAT ARE BASICALLY DRY WHEN IT'S NOT RAINING.

AND THEN THIS SLIDE GIVES YOU A COUPLE OF EXAMPLES OF RETENTION PONDS.

SO THERE'S TYPICALLY ALWAYS WATER IN THE POND.

IT'S A LITTLE MORE ESTHETICALLY PLEASING.

AND WE'VE PREVIOUSLY HEARD THE PREFERENCE PREFERENCE FROM COUNCIL THAT WE CONSIDER RETENTION SO THAT THIS WOULDN'T BE JUST A DRY HOLE IN THE GROUND.

SO WE'RE PROCEEDING WITH DESIGN OF RETENTION PONDS WITH FOUNTAINS.

THIS WILL TAKE APPROXIMATELY 10 ACRES OF THE SITE, LEAVING APPROXIMATELY 20 ACRES FOR FUTURE DEVELOPMENT.

WE'VE GOT ACCOMMODATIONS FOR WALKING TRAILS WITH LANDSCAPING AS WELL.

AND AS I MENTIONED BEFORE, THIS WOULD GREATLY ALLEVIATE THE FLOODING ACROSS COUNTY ROAD 1019.

ESTIMATED CONSTRUCTION COSTS FOR WHAT I JUST DESCRIBED IS ROUGHLY $6.5 MILLION, AND THAT'S INCLUDED IN THE CURRENT CAPITAL FUNDING PLAN FOR 4A.

SO THE ORIGINAL CONTRACT AGAIN WAS APPROVED OCTOBER 3RD OF 2022.

THAT WAS $105,000.

SO FAR, WE'VE EXPENDED APPROXIMATELY $47,000 OF THAT CONTRACT.

SO THE REMAINING $58,000 PLUS ADDITIONAL $148,000 FOR THE NEW SCOPE BRINGS US TO THE TOTAL OF $206,100.

SO IF APPROVED, THIS CONTRACT WOULD BASICALLY CANCEL THE PREVIOUS CONTRACT AND TRANSFER THE REMAINING SCOPE TO THE NEW CONTRACT.

DESIGN WOULD BE COMPLETED END OF THIS YEAR.

AND SO TODAY WE'RE RECOMMENDING THAT YOU WOULD APPROVE A MINUTE ORDER.

WELL, THAT YOU WOULD APPROVE A PROFESSIONAL SERVICE CONTRACT WITH MMA FOR $206,100 FOR THE SCOPE PREVIOUSLY DESCRIBED.

OKAY, FIRST OFF, I DON'T HAVE ANY PROBLEM WITH APPROVING THE CONTRACT FOR THEM TO DESIGN, BUT WHAT THEY ARE DESIGNING IS OF CONCERN TO ME.

IS THERE A COMPELLING REASON TO STRAIGHTEN OUT THE DOUBLE CURVES IN 1019 AND BRING IT INTO A TEMPORARY T INTERSECTION PENDING? IN OTHER WORDS, WHAT I'M SEEING ON THIS DRAWING THAT YOU'VE MADE HERE IS THAT YOU HAVE THE CHANNEL BRINGING WATER INTO WHAT APPEARS TO BE A HEADWALL AND SOME SORT OF A CONDUIT.

I'M CALLING IT A BOX CULVERT, FOR LACK OF A BETTER UNDERSTANDING AT THIS TIME.

AND THAT WOULD BE REQUIRED TO GET THE WATER ACROSS AND UNDER 1019 AND THEN AT THE INTER INTERSECTION BETWEEN THE TWO PONDS, IT APPEARS THAT WE HAVE A MULTI BARREL CULVERT SET UP THERE.

BUT I'M INTERPRETING PERHAPS MORE THAN IS THERE AND WE'RE LOOKING AT A PRICE TAG OF $6.5 MILLION.

AND I'M NOT SURE EXACTLY WHAT THAT'S FOR, BUT IF ALL THAT'S GOING TO DO IS DIG A COUPLE OF PONDS.

IT SOUNDS LIKE AN AWFUL LOT OF MONEY.

IT FEELS LIKE TO ME WE'RE SPENDING MOST OF THE MONEY IN ORDER TO CREATE MASSIVE CULVERTS TO CARRY 1019 ACROSS IN A STRAIGHT LINE WHERE IT'S GETTING TO 1902 VIA A COUPLE OF 90 DEGREE TURNS.

IS THERE A COMPELLING REASON TO DO THAT? WELL, PART OF THIS GREAT QUESTION, PART OF THIS IS TO, AGAIN, MAXIMIZE WHAT'S GOING TO BE LEFT OF THE SITE THAT CAN BE DEVELOPED.

SO IF WE DIDN'T CHANNELIZE THE OFF SITE FLOW TO BASICALLY CONCENTRATE IT INTO A SMALLER FOOTPRINT, THIS WOULD HAVE TAKEN UP FAR MORE THAN THE 10 ACRES THAT'S SHOWN NOW.

THE TWO PONDS INSTEAD OF ONE POND, TWO SMALLER PONDS INSTEAD OF ONE LARGER POND AGAIN, WAS ANOTHER MEASURE TO MAXIMIZE DEVELOPABLE SPACE AFTER THE DETENTION WAS TAKEN INTO CONSIDERATION.

AT THIS POINT, IT'S PRELIMINARY, BUT THAT'S KIND OF ENVISIONED AS MULTI BARREL BOXES, AS YOU MENTIONED, TO CONNECT FROM ONE POND TO THE OTHER.

BUT THESE THIS ALL HAS TO BE DESIGNED AS A SYSTEM IN SERIES.

AND BY REALIGNING 1019, IT ALSO GIVES US A LITTLE BIT MORE AREA TO THE TO THE NORTH.

WHICH DIRECTION IS THE FLOW COMING FROM THAT THE CHANNEL, IS IT COMING FROM THE NORTHWEST? IS IT COMING FROM THE EAST? NORTHEAST, NORTH EAST.

OKAY. SO BY IN THIS REALIGNING 1019 ALSO GIVES US THE OPPORTUNITY TO POTENTIALLY SHIFT THIS POND A LITTLE BIT MORE TO THE NORTH AND EAST TO WHAT'S NOW THE FLOODED COUNTY ROAD 1019, WHICH ONLY GIVES US MORE POTENTIAL SPACE FOR POTENTIAL PAD SITES ON CORNERS, SMALL DEVELOPMENTS, BUT DEVELOPMENT NONETHELESS.

AND IF DOING THIS CREATES ENOUGH DEVELOPABLE LAND THAT THERE'S A JUSTIFICATION FOR THE SIZE OF THE CONSTRUCTION CONTRACT, THEN FINE.

BUT I PERSONALLY, BEFORE I LIKE I SAID, I DON'T HAVE A PROBLEM WITH WITH APPROVING THE DESIGN CONTRACT WITH MMA.

WHAT I WHAT I'D LIKE TO DO IS HAVE THEM DEVELOP A COUPLE OF ALTERNATIVES FOR MANAGING THE COUNTY ROAD 1019 TRAFFIC AND MAXIMIZING THE SPACE AVAILABLE WITHOUT THE EXORBITANT EXPENSE OF MASSIVE UNDERGROUND CONDUIT CONSTRUCTION IS THAT IF THEY'RE COMMITTED TO THIS DESIGN AND THAT'S WHAT IT HAS TO BE, THEN I WANT TO DO AN ANALYSIS ON THAT TO SEE JUST HOW MUCH VALUE WE'RE GETTING OUT OF SPENDING THAT MUCH MONEY TO STRAIGHTEN OUT A KINK IN A ROAD THAT ONE PERSON LIVES ON.

WELL, AGAIN, WELL, I THINK WE CAN PUT A FINER POINT ON THE, I GUESS, THE COST BENEFIT OF STRAIGHTENING OUT THE KINK IN THE ROAD.

AND TRUE, THERE IS ONE PERSON WHO LIVES ALONG 1019 IN THIS AREA.

BUT JUST OFF TO THE NORTHEAST, THERE ARE A BUNCH OF OTHER PEOPLE THAT LIVE THERE THAT ARE ALSO POTENTIALLY TRYING TO GET BACK TO FM 1902 AT TIMES.

AND WE HAVE TO KEEP IN MIND THAT LAKEWOOD EXTENSION, WE'RE PROBABLY A DECADE OFF FROM THAT BECOMING REALITY.

SO IN THE MEANTIME, THIS NEW TEMPORARY ROAD ALLOWS BETTER ACCESS TO AND THROUGH THE BUSINESS PARK.

ANY OTHER QUESTIONS, GUYS? THE ONLY QUESTION I GOT, ERRICK, IS IN OUR PROCUREMENT POLICY AND OUR FINANCE POLICY, IS THERE ANYTHING ABOUT CANCELING A CONTRACT WITH SAID COMPANY AND REISSUING CONTRACT WITH SAME COMPANY? THIS HAS ALL BEEN VETTED THROUGH THE LEGAL.

SO WE'RE WITHIN POLICY.

I FEEL COMFORTABLE [INAUDIBLE].

ANYONE ELSE? OH, THE ONLY THING THAT I HAVE I'VE BEEN CONCERNED JUST ABOUT WITH A LOT OF PROJECTS ON THE DRAINAGE ITSELF.

AND, YOU KNOW, LIKE DAN SAID, IF WE'RE GOING TO SPEND THIS MUCH MONEY, WE WILL MAKE DANG SURE THAT IT'S GOING TO DO IT PROPERLY.

SO IF WE DAN IF WE NEED TO GO BACK TO THE DRAWING BOARD, LET'S, LET'S GO BACK.

LET'S DON'T DO IT WRONG.

THAT'S MY POINT. YEAH, I THINK I'M WITH YOU ON THAT.

ALL I'M SAYING IS MAYBE WE DON'T HAVE TO GO BACK TO THE DRAWING BOARD.

IF WE APPROACH THE DRAWING BOARD WITH THE IDEA THAT WE WANT THE MOST EFFICIENT DESIGN THAT MAXIMIZES THE SPACE THAT WE CAN DO SOMETHING WITH.

BUT WITH THAT THOUGHT IN MIND, I DON'T I DON'T CONSIDER AN IMPETUS TOWARDS REALIGNING 1019 TO BE OF MUCH BENEFIT AT THIS POINT.

YOU KNOW, AT SOME FUTURE TIME, MAYBE WE NEED TO RELOOK AT THAT.

BUT THAT'S A LOT OF DRAINAGE WORK.

THIS REMINDS ME OF THAT PENDING PROJECT WE HAVE ON ALSBURY BOULEVARD TO CONNECT THE ROUNDABOUT AT HULAND TO EXISTING COUNTY ROAD 1020.

WE'RE GOING TO SPEND AN ENORMOUS AMOUNT OF MONEY TO BUILD A SHORT SECTION OF ROADWAY SIMPLY BECAUSE WE HAVE SO MUCH DRAINAGE CONSTRUCTION TO HAVE TO FACE IN ORDER TO DO THAT.

AND THIS JUST IS REMINISCENT OF THAT SITUATION.

THAT PROJECT IS OBVIOUSLY MORE NECESSARY THAN THAN REALIGNING 1019 FOR A LOT OF GOOD REASONS.

BUT I JUST WANT TO LOOK AT WHAT OPTIONS ONCE THEY GET INTO THE DESIGN PROCESS THAT WE CAN PURSUE.

IF THIS DOES HAVE TO BE THIS MASSIVE MULTI BARREL CULVERT THAT THEY'VE GOT SHOWN HERE, FINE.

IF NOT, THEN MAYBE I'M OVER EXAGGERATING.

I DON'T INTENTIONALLY DO IT, BUT MAYBE I'M OVER EXAGGERATING THE AMOUNT OF MONEY THAT'S GOING TO COST.

BUT WITH AN ENGINEER'S ESTIMATE OF $6.5 MILLION FOR A SECTION OF ROADWAY, ABOUT 500 FOOT LONG AND A COUPLE OF PONDS, I'M KIND OF SCRATCHING MY HEAD. YEAH ONE THING I'LL ADD IS THAT.

SINCE WE STARTED RECEIVING THE PRELIMINARY CONCEPTS FROM THE INITIAL DESIGN WORK.

THAT'S KIND OF HOW WE ENDED UP HERE, TRYING TO MAKE IT AS EFFICIENT AS WE COULD TO MAKE IT FROM A DEVELOPMENT OR REMAINING DEVELOPABLE SITE PERSPECTIVE AS EFFICIENT AS POSSIBLE.

SO THAT'S HOW WE'VE WORKED THROUGH A NUMBER OF SCENARIOS TO GET TO WHERE WE ARE NOW.

THERE HAS BEEN SOME TALK ABOUT A SMALL YOU'D ALMOST CALL IT A BRIDGE INSTEAD OF THE CULVERTS.

SO THIS IS, AS I SAID, VERY PRELIMINARY.

BUT IN GENERAL, THIS IS WHAT WE'RE RECOMMENDING AS THE GENERAL PATH FORWARD.

LET'S DEAL WITH 1019 TO DEAL WITH THAT FLOODING SITUATION AND IMPROVE CIRCULATION THROUGH AND AROUND THE BUSINESS PARK, CREATE MORE PAD SITES FOR FUTURE SMALL DEVELOPMENTS ON THE ON THESE CORNERS BECAUSE IT WILL BE CLOSE TO A DECADE BEFORE THE FULL PERMANENT LAKEWOOD EXTENSION TO FM 1902 BECOMES REALITY.

RIGHT. AND I MEAN, AT THAT TIME, THEN THIS MAYBE LOOKS BETTER ON PAPER THAN IT DOES RIGHT NOW.

BUT I DON'T KNOW.

I DON'T HAVE ANYTHING ELSE TO SAY ABOUT IT.

I JUST WOULD LIKE TO SEE IF THERE ARE OTHER OPTIONS THAT CAN MAXIMIZE OUR WE HAVE TO BUILD THE PONDS.

I GET THAT. THAT WAS PART OF THE CRAFT MASTER AGREEMENT.
