AND WE PRAY THAT YOU'LL BESTOW THAT UPON US TONIGHT AS WE DELIBERATE AND LOOK AT THE ISSUES BEFORE US AS A CITY.

WE'RE THANKFUL FOR THE BLESSINGS THAT YOU'VE GIVEN US.

WE'RE THANKFUL FOR THE WEATHER.

THIS IS GOING TO BE CASE 23-044 BARTLEY EDITION, HOLD A PUBLIC HEARING AND CONSIDER APPROVAL OF AN ORDINANCE FOR A ZONING CHANGE REQUEST FROM A AGRICULTURAL TO SFE SINGLE FAMILY ESTATE FOR A THREE ACRE SITE.

JP DUCAY DEVELOPMENT SERVICES PRESENTING CASE 23-44 A ZONING CHANGE REQUEST.

THE OWNER IS LEILANI BARTLEY.

THE SUBJECT PROPERTY IS APPROXIMATELY THREE ACRES AND IS LOCATED AT THE INTERSECTION OF COUNTY ROAD 913 AND COUNTY ROAD 1021.

SO IN ORDER TO BEST UNDERSTAND THIS ZONING CHANGE REQUEST, I THINK IT'S IMPORTANT THAT WE GO BACK TO 2002.

THIS IS WHEN THE MAJORITY OF THE SUBJECT SITE WAS ANNEXED INTO THE CITY OF BURLESON AND SUBSEQUENTLY GIVEN A DEFAULT ZONING OF AGRICULTURAL.

SO IF YOU TAKE A LOOK AT THE IMAGE ON THE SCREEN, YOU CAN SEE THAT ALL OF THE AREA THAT IS HIGHLIGHTED IN GREEN IS NOT ONLY ZONED AGRICULTURAL, BUT THIS IS ALL LAND THAT WAS LIKELY ANNEXED AROUND THAT SAME PERIOD OF TIME.

ANYTHING IN THAT AREA THAT IS NOT HIGHLIGHTED IN GREEN IS LOCATED IN THE EXTRATERRITORIAL JURISDICTION.

THE SUBJECT AREA IS, OF COURSE, WHAT'S HIGHLIGHTED IN THAT TURQUOISE BLUE, WHICH BRINGS US TO THIS YEAR WHEN THE APPLICANT SUBMITTED A REPLAT PROPOSING TO SUBDIVIDE THE PROPERTY BY CREATING THREE SINGLE FAMILY RESIDENTIAL LOTS WITHIN THAT AGRICULTURAL ZONING DISTRICT.

THE AGRICULTURAL ZONING DISTRICT HAS A MINIMUM DEVELOPMENT STANDARD REQUIRING A MINIMUM LOT SIZE OF ONE ACRE PER OR THREE ACRES PER LOT.

I'M SORRY. AND THE APPLICANT OF COURSE, IS PROPOSING THREE LOTS, EACH BEING ONE ACRE.

ULTIMATELY, IF IT IS TO PROCEED AS IT IS CURRENTLY, THOSE LOTS WOULD NOT BE IN COMPLIANCE WITH THE BASE ZONING DISTRICT AND THE APPLICANT IS NOW REQUESTING A ZONING CHANGE TO REZONE THAT THREE ACRES FROM AGRICULTURAL TO SFE SINGLE FAMILY ESTATE IN ORDER TO BE IN LINE WITH THE ZONING DISTRICT.

THE COMPREHENSIVE PLAN DESIGNATES THIS AREA AS NEIGHBORHOODS, AND THE CURRENT ZONING IS OBVIOUSLY AGRICULTURAL.

AS WE JUST DISCUSSED, THE APPLICANT IS PROPOSING SFE SINGLE FAMILY ESTATE, WHICH IS IN COMPLETE COMPLIANCE WITH THAT VISION OF NEIGHBORHOODS IN THE COMPREHENSIVE PLAN. PUBLIC HEARING NOTICES.

A NOTICE WAS MAILED TO PROPERTY OWNERS WITHIN 300FT.

THERE WAS A NOTICE PUBLISHED IN THE NEWSPAPER AND THERE WAS A SIGN POSTED ON THE PROPERTY.

STAFF HAS RECEIVED A COUPLE OF CALLS FROM THE SURROUNDING AREA JUST INQUIRING ABOUT WHAT THE PROPOSAL ENTAILED, BUT NO SUPPORT OR NO RECOMMENDATIONS OF DENIAL FROM THE SURROUNDING AREA.

STRICTLY JUST CURIOSITY OF WHAT THE SIGN MEANT OUT THERE.

STAFF'S RECOMMENDATION IS THAT OF APPROVAL TO REZONE THE PROPERTY FROM AGRICULTURAL TO SINGLE FAMILY ESTATE.

AND THE REASON FOR THIS SUPPORT IS BECAUSE, AS I MENTIONED, IT IS IN COMPLETE CONFORMANCE WITH THE COMPREHENSIVE PLAN AND THE VISION OF THE NEIGHBORHOOD'S DESIGNATION WITHIN THE COMPREHENSIVE PLAN.

AND IT'S GOING TO BRING ALL THREE OF THOSE PROPOSED LOTS INTO ZONING COMPLIANCE.

IF IT'S NOT GOING TO BE REZONED, THOSE THREE LOTS WOULD NOT BE IN COMPLIANCE WITH THE AGRICULTURAL ZONING DISTRICT THAT EXISTS TODAY.
