SO THE NUMBERS WILL NOT CHANGE FROM WHAT THEY ARE RIGHT THERE IN FRONT OF YOU.

SO THE FIRST THING THAT I WOULD ASK THIS COUNCIL TO DO IS TO MAKE A MOTION TO APPROVE AND ACCEPT THE TABULATIONS THAT ARE PRESENTED BEFORE YOU THIS EVENING.

AND EACH COUNCIL MEMBER UP HERE, WHETHER YOU AGREE WITH THEM OR NOT AGREE WITH THEM.

WHAT YOU NEED TO UNDERSTAND IS THEY'VE DEDICATED SOME TIME AND WHAT YOU SEE IS EVERY FIRST AND THIRD MONDAY, A COUPLE OF HOURS SEEMS PRETTY EASY.

BUT WHAT I WILL TELL YOU IS EVERY COUNCIL MEMBER PUTS IN HOURS AND HOURS AND THEIR FAMILIES UNDERSTAND THAT AND THEIR FAMILIES HAVE SACRIFICED FOR THEM, AND THEY BRING THEM FORWARD AND THEY GIVE US THE BEST THAT THEY HAVE AND THEY GIVE US ALL THAT THEY HAVE.

AND SO FOR THE NEW COUNCIL MEMBERS COMING IN, SORRY, FAMILY, THEY WILL BE TALKING TO ME A LOT MORE THAN THEY TALK TO OTHER PEOPLE.

AND SO IT REALLY AFFORDED US TO BUILD A REALLY GOOD RELATIONSHIP WITH THEM AND TALK WITH THEM ABOUT NEEDS.

AND SO OUR ASSOCIATION GOT TOGETHER AND VOTED TO GO AHEAD AND MAKE T SHIRTS THAT YOU GUYS MAYBE SEEN AROUND THE LIGHT BLUE T SHIRTS WITH THE ASSOCIATION LOGOS ON IT.

AND THEN THE VOTE WAS AFTER THAT TO DONATE THE PROCEEDS FROM THAT 100% TO BACK TO THE CENTER FOR ASD.

PART OF THAT MISSION INCLUDES SAFETY, SO IT IS ALWAYS A FEAR OF MINE THAT HE IS MISUNDERSTOOD IN THE EVENT OF AN EMERGENCY WHERE HE DOES NOT HAVE SOMEONE WHO KNOWS HIM AND IS FAMILIAR WITH HIM TO HELP HIM, HE MAY SHUT DOWN.

HE MAY SEEM NON-COMPLIANT WHEN IN ALL HONESTY, HE'S A GIANT, LOVABLE, SASSY, FUN LOVING KID.

IT'S OUR DUTY AS PARENTS TO EDUCATE THE COMMUNITY ABOUT OUR LOVED ONES NEEDS.

THAT INCLUDES MAKING SURE FIRST RESPONDERS HAVE KNOWLEDGE OF THE RESOURCES AT THEIR FINGERTIPS TO HELP WITH DIFFICULT SITUATIONS.

THERE IS NO OTHER WAY TO SAY THIS, BUT DEPENDING ON THE SITUATION, AN INDIVIDUAL WITH AUTISM OR OTHER SPECIAL NEEDS CAN OFTEN APPEAR TO BE UNDER THE INFLUENCE.

SO WE JUST WE WE ARE HERE TO EDUCATE AND TO MAKE SURE THAT THE CITY OF BURLESON AND OUR KIDS DON'T END UP IN THE HEADLINES.

AND IT'S A CULMINATION OF YOUR LEADERSHIP AND THE HARD WORK AND THE DEDICATION OF OUR ELECTED OFFICIALS AS WELL.

THE PUBLIC SAFETY COMMUNICATIONS.

AS I SAID EARLIER, I CAN'T OVERSTRESS THE IMPROVEMENT THAT UNDER BRYAN'S LEADERSHIP YOU GOT HERE AND YOU SAW THAT THEY NEEDED PEOPLE, THEY NEEDED PROCESSES, THEY NEEDED ULTIMATELY MONEY AND WHICH THE COUNCIL SUPPORTED.

CLEARLY, THE LEADERSHIP UNDER PAUL BRADLEY AND ASHLEY MANNING HAVE BEEN INCREDIBLE.

AND WITHOUT IT, WE WOULD NOT BE WHERE WE ARE RIGHT NOW.

WE HAVE A DEBT OF GRATITUDE TO THEM AND WE'RE JUST NOW REALLY STARTING TO HIT OUR STRIDE.

THEY'RE GOING TO BECOME EVEN MORE IMPORTANT AS WE MOVE INTO OUR FIRE BASED MS AND WE START OUR TRANSPORTATION COMPONENT OF IT.

AND THE NEXT COUPLE OF MONTHS, OUR EMD THAT'S GOING TO COME ONLINE, EMERGENCY MEDICAL DISPATCH, THEY'RE GOING TO PLAY AN ABSOLUTE KEY ROLE WHENEVER WE SWITCH OVER TO FIRE BASED EMS, THE PHOENIX G-2 ALERTING SYSTEM.

THAT WAS NOT CHEAP AT ALL.

IT WAS ABOUT A HALF $1 MILLION.

BUT AGAIN, IT'S PAYING DIVIDENDS AND LIVES AND IT WILL CONTINUE TO PAY DIVIDENDS IN LIVES WHICH WE ALL KNOW DOESN'T HAVE A PRICE TAG ON.

I'M GOING TO SHARE SOME INCREDIBLY IMPRESSIVE NUMBERS IN JUST A MOMENT OF HOW RAPID THIS DISPATCH TEAM NOW DISPATCHES AND HOW QUICKLY THEY PROCESS CALLS AND JUST THE IMPROVEMENTS AGAIN, THAT HAS TAKEN PLACE OVER THE LAST COUPLE OF YEARS.

OUR POLICE DEPARTMENT, OUTSTANDING DEPARTMENT, WHAT WILL BE TAKING PLACE THERE IS DR.

CORDOVA, OUR MEDICAL DIRECTOR, WILL BE LEADING THE TRAINING THAT THEY'RE GOING TO HAVE.

THEY ALREADY ARE CPR CERTIFIED.

BUT WE'VE GOT SOME NUANCES AND SOME NUANCED TRAINING THAT WE'RE GOING TO NEED TO HAVE THEM DO, BECAUSE THE WAY WE PROVIDE CPR AND IT'S A VERY ORGANIZED IT'S VERY SYSTEMATIC.

AND WHEN WE DO A HANDOFF, SO TO SPEAK, WE'VE GOT TO MAKE SURE THAT EVERYBODY IS TRAINED AND TRAINED TO HOW WE DO CPR IN OUR SYSTEM.

WE'VE GOT TEN AEDS THAT WE'RE GOING TO DEPLOY IN THE PATROL CARS.

INITIALLY. WE'RE GOING TO COUNT ON CHIEF KARDELL AND PD LEADERSHIP TO LET US KNOW IF THEY NEED MORE.

AND WE'LL HAVE A PLAN FOR PROVIDING HOWEVER MANY AEDS THEY ULTIMATELY NEED AS THEY TURN ON MORE POLICE CARS.

WE'RE GOING TO BE ABLE TO SUPPORT THAT.

KEY COMPONENT, AS I SAID EARLIER, IS THE RAPID RESPONSE THAT WE GET FROM OUR PD OFFICERS.

THEY DO A GREAT JOB AT TIMES.

THEY'RE ON SCENE FIRST AND THAT'S A GREAT THING BECAUSE NOW THEY ALREADY ARE DOING CPR, BUT THEY'RE ABOUT TO BE ABLE TO APPLY AN AED.

AS I SAID EARLIER, THAT'S GOING TO HAVE INCREDIBLY POSITIVE OUTCOMES.

THEN OUR SIDE, AS YOU KNOW, WE'RE GOING TO FIRE BASED EMS AND THAT COMPONENT IS NOT ONLY A QUICKER TRANSPORT, WE'RE GOING TO BE ABLE TO PROVIDE ADVANCED LIFE SUPPORT LIKE WE HAVE AND THEN THE RAPID RESPONSE.

SO WHAT ARE OUR NEXT STEPS? WE'RE GOING TO AS I SAID EARLIER, WE'RE GOING TO BE PROVIDING WE'LL BE COORDINATING WITH PD LEADERSHIP TO HAVE OUR FOLKS GET IN AND TRAIN PD FOLKS SPECIFICALLY UNDER OUR PROTOCOLS. WE PURCHASED THE 22 ZOLL AEDS.

AND THIS IS REALLY, I THINK, JUST A GREAT OPPORTUNITY TO KIND OF SHOW HOW WE TRY TO MAXIMIZE EFFICIENCIES.

WE HAD SOME AEDS ABOUT TWO YEARS AGO THAT WE COULDN'T GET BATTERIES FOR, SO WE WENT OUT AND PURCHASED OTHER AEDS BECAUSE WE HAD TO KEEP OUR STOCK GOING.

WE FINALLY GOT THE BATTERIES, THE REPLACEMENT BATTERIES IN.

SO WE PUT THESE TO GOOD USE AND THIS IS HOW WE WERE ABLE TO ALREADY HAVE THE CAPACITY TO EXPAND THIS SYSTEM.

SO I JUST WANT TO SHARE THAT WITH COUNCIL AND OUR COMMUNITY THAT WE, WE, WE USE EVERY TAX DOLLAR APPROPRIATELY AND EFFICIENTLY.

WE'RE GOING TO PROVIDE ADDITIONAL TRAINING TO ALL CITY EMPLOYEES.

WE DID THIS ABOUT A YEAR OR TWO AGO, AND WE'RE GOING TO CIRCLE BACK AND MAKE SURE ALL OF OUR CITY EMPLOYEES ARE KNOW RECERTIFIED, NOT ONLY WITH CPR, BUT I'D USE AND THEN WE'RE GOING TO BE DOING A DEEP DIVE INTO OUR CURRENT FACILITIES TO SEE WHAT FACILITIES MAY NOT HAVE.

AEDS WILL COME UP WITH A PLAN AND A ROLLOUT ON HOW TO GET AEDS IN ALL OF OUR CITY FACILITIES IF WE DO HAVE ANY GAPS.

WE CAN GET OUR OFFICERS TRAINED AND THEN GET OUR AEDS DEPLOYED.

WE'RE HOPING JULY NO LATER THAN AUGUST WOULD BE OUR ROLLOUT DATE IMPLEMENTATION DATE.

THEY IMMEDIATELY WENT INTO OUR PROTOCOLS AND AND AGGRESSIVELY STARTED DOING PROVIDING LIFE SUPPORT, USING AED, WENT THROUGH ALL OF OUR PROTOCOLS. AND AGAIN, THIS IS A SUCCESS STORY.

PD GOT THERE AND THEY ASSISTED WITH THE CHEST COMPRESSIONS.

BUT THIS PICTURE RIGHT HERE IS WORTH A THOUSAND WORDS, SO TO SPEAK.

THERE'S NO PRICE THAT ANY OF US WOULD CAN PUT ON THAT.

BUT THAT'S A SUCCESS STORY.

THAT IS ONE OF THE CLOSE TO 40% THAT WE'RE LOOKING FOR.

AND IT'S ALL ABOUT HAVING THE RIGHT EQUIPMENT, GETTING THERE QUICK ENOUGH, GETTING THE DISPATCH, THIS WHOLE TEAM TOGETHER THAT THIS CITY LEADERSHIP HAS BEEN WORKING TOWARD. WE ARE WE ARE FINALLY ALMOST THERE.

THERE'S $100,000 OF FUNDING IN EACH YEAR THAT'S REALLY TO HELP PLAN AND DESIGN THE FOLLOWING YEAR'S CONSTRUCTION CONTRACT.

YOU CAN PUT DOWN A 50 YEAR PAVEMENT ON ACTIVE SOIL THAT HEAVES EVERY YEAR, THAT SWELLS, THAT BREAKS THAT, THAT MOVES AROUND AND THAT PAVEMENT CAN FAIL WITHIN A MUCH SHORTER PERIOD OF TIME.

I DON'T THINK THE SOILS ALONG SOUTH DOBSON STREET ARE PARTICULARLY ACTIVE FOR BURLESON.

THE ITEM BEFORE YOU TONIGHT IS TO GIVE YOU A BRIEF UPDATE ON THE CURRENT LEGISLATIVE SESSION.

IN THIS PRESENTATION, I'M GOING TO GIVE YOU JUST SOME BACKGROUND ON THE CURRENT SESSION AND THE COUNCIL'S LEGISLATIVE PROGRAM.

WE'LL DISCUSS 14 DIFFERENT BILLS THAT ARE MAKING THEIR WAY THROUGH THE LEGISLATURE, AND THEN AT THE VERY END, COUNCIL WILL HAVE AN OPPORTUNITY TO GIVE STAFF DIRECTION ON ANY BILL MENTIONED OR NOT MENTIONED IN THIS PRESENTATION.

THE PURPOSE OF THIS PRESENTATION IS TO CLOSE THE LOOP.

THIS COUNCIL IN JANUARY, BEFORE THE BEGINNING OF THIS LEGISLATIVE SESSION, PASSED A LEGISLATIVE PROGRAM.

IT SPECIFIED ITS WISHES, ITS DESIRES OF WHAT WOULD OCCUR DOWN IN AUSTIN DURING THIS DURING THIS LEGISLATIVE SESSION.

TWO WEEKS FROM TODAY THIS SESSION WILL CLOSE AT THE LAST DAY IS MAY 29TH.

SO THE PURPOSE OF THIS PRESENTATION IS TO HIGHLIGHT SOME OF THE BIG BILLS THAT FOCUS ADVOCACY AND A COUPLE OF DEPARTMENTS THINK ARE IMPORTANT FOR COUNCIL TO KEEP IN MIND.

LOOKING AT ITS LEGISLATIVE PROGRAM AS THIS SESSION COMES TO A CLOSE.

ALL RIGHT. SO WE'LL JUMP IN.

THE 88TH SESSION BEGAN ON JANUARY 10TH AND LIKE I SAID EARLIER, IT'S SCHEDULED TO END ON MAY 29TH.

COUNCIL ADOPTED A RESOLUTION THAT CREATED THE CITY'S LEGISLATIVE PROGRAM ON JANUARY 9TH, OUTLINING THE CITY'S POSITION ON BILLS THAT COUNCIL WOULD SUPPORT OR OPPOSE.

COUNCIL'S POLICY SUPPORTS BILLS THAT WOULD ADVANCE THE CITY'S STRATEGIC GOALS AND INTERESTS WHILE IMPROVING HEALTH AND SAFETY AND OPPOSE BILLS THAT WOULD ERODE LOCAL CONTROL. THIS SESSION, OVER 8,000 BILLS WERE FILED.

STAFF HAS BRIEFED COUNCIL AND TRACKED BILLS THROUGHOUT THE LEGISLATIVE PROCESS WITH UPDATES FROM TML AND FOCUSED ADVOCACY.

THE CITY'S LEGISLATIVE CONSULTANT FOCUSED ADVOCACY WAS HIRED BY THE CITY IN 2020 TO REPRESENT OUR INTEREST IN AUSTIN AT THE 88TH LEGISLATIVE SESSION. THE SPECIFIC BILLS THAT ARE PRESENTED TONIGHT ARE SELECTED FROM A POOL OF BILLS THAT FOCUS ADVOCACY HAS PROVIDED TO STAFF AND ARE CONSISTENT WITH COUNCIL'S LEGISLATIVE PROGRAM.

SO FOR THOSE WHO DON'T KNOW, THE TEXAS MUNICIPAL LEAGUE IS AN ORGANIZATION WITH THE PURPOSE OF ADVANCING AND SUSTAINING THE INTEREST OF TEXAS CITIES.

TO ACHIEVE THIS PURPOSE, THE ORGANIZATION REPRESENTS MUNICIPAL INTERESTS BEFORE LEGISLATIVE AND ADMINISTRATIVE BODIES.

WHEN TML REVIEWS ALL THE BILLS DURING THE SESSION AND CLASSIFIES THEM INTO SPECIAL CATEGORIES.

AND THESE ARE THE SAME CATEGORIES THAT WE'LL USE TO CLASSIFY THE 14 BILLS THAT COUNCIL WILL LOOK AT TONIGHT.

THE FOLLOWING CATEGORIES IN NO PARTICULAR ORDER ARE PREEMPTION, LAND USE, DEBT AND PUBLIC SAFETY.

TO NAVIGATE THIS PRESENTATION, STAFF WILL SPEAK TO PRIORITY BILLS IN EACH OF THESE CATEGORIES THAT WERE DEVELOPED BY FOCUS ADVOCACY IN AN EFFORT TO DEMONSTRATE THE GREATEST

THE BILLS ARE CONSISTENT WITH THE CITY'S LEGISLATIVE PROGRAM AND ARE ACTIVELY MOVING THROUGH THE LEGISLATURE.

SO I'M GOING TO GO THROUGH 14 DIFFERENT BILLS.

IT'S GOING TO THIS IS LIKE THE OPPOSITE OF GREATEST HITS ALBUM.

IT'S LIKE THE WORST BILLS FROM FROM OUR STANDPOINT.

A LOT OF THEM ARE THE ONES THAT YOU SUPPORT, OBVIOUSLY WOULDN'T BE THE I'M GOING TO GIVE YOU A BRIEF SYNOPSIS ON EACH BILL AND TELL YOU WHERE IT WHERE IT IS IN THE CURRENT STATUS GOING THROUGH THE LEGISLATIVE PROCESS.

IT'S IMPORTANT TO KNOW, AGAIN, COUNCIL, THAT THIS IS YOUR LEGISLATIVE PROGRAM.

IT'S ENTIRELY UP TO YOU TO DETERMINE WHICH BILLS THE CITY SHOULD SUPPORT OR OPPOSE.

THE PURPOSE OF THIS, AGAIN, IS JUST TO HIGHLIGHT, BASED ON YOUR LEGISLATIVE PROGRAM, BILLS THAT WE THINK ARE IMPORTANT.

ALL RIGHT. SO PREEMPTION IS THE FIRST CATEGORY.

WE ONLY HAVE ONE BILL IN THIS CATEGORY, BUT IT IS A BIG ONE.

PREEMPTION IS THE LEGAL DOCTRINE THAT ALLOWS FOR A HIGHER LEVEL OF GOVERNMENT TO LIMIT OR EVEN ELIMINATE THE POWER OF A LOCAL LEVER, LOCAL LEVEL GOVERNMENT TO REGULATE A SPECIFIC USE.

HOUSE BILL 2127 IS THE SUPER PREEMPTION BILL.

THAT'S THE KIND OF NAME GIVEN TO IT.

UNDER THE BILL, CITIES AND COUNTIES CANNOT REGULATE ACTIVITIES GOVERNED BY SPECIFIED LIST OF STATE CODES.

THOSE CODES ARE AGRICULTURAL, BUSINESS AND COMMERCE, FINANCE, INSURANCE, LABOR, NATURAL RESOURCES, PROPERTY AND OCCUPATIONS.

UNLESS EXPLICITLY AUTHORIZED, IT ALMOST TURNS HOME RULE ON ITS HEAD.

ADDITIONALLY, IT WOULD AWARD ATTORNEYS FEES TO THOSE WHO SUCCESSFULLY CHALLENGED CITY ORDINANCES.

SO OBVIOUSLY THIS BILL GREATLY REDUCES LOCAL CONTROL.

THE STATUS OF THIS BILL IS THAT IT IS OUT OF SENATE COMMITTEE.

I PROBABLY SHOULD HAVE PUT SOMETHING IN MY PRESENTATION THINKING ABOUT IT, ABOUT HOW A BILL BECOMES LAW.

ESSENTIALLY, THERE'S SIX STEPS FOR A PIECE OF LEGISLATION TO BECOME A LAW IN THE STATE OF TEXAS.

THE FIRST ONE IS YOU HAVE TO BE HAS TO BE FILED.

THEN IT GOES TO A COMMITTEE.

LET'S SAY IT'S A HOUSE BILL, IT'S FILED IN THE HOUSE, AND THEN IT GOES TO COMMITTEE.

THAT'S THE SECOND STEP. IT GETS OUT OF COMMITTEE.

IT GOES TO THE THIRD STEP. IT GOES TO THE FLOOR OF THE HOUSE.

RIGHT. THEN IT'S PASSED BY THE HOUSE.

THAT GOES TO THE OTHER CHAMBER. IT GOES TO THE SENATE START COMMITTEE.

THERE HAS TO GET A CITY.

THAT'S THE FOURTH STEP, GET OUT OF THE SENATE.

THAT'S THE FOURTH STEP. THEN IT GOES TO THE SENATE CHAMBER.

IF IT'S PASSED BY THE SENATE, THAT'S A FIFTH STEP.

THEN IT GOES TO THE GOVERNOR'S DESK AND THEN IT HAS TO BE SIGNED INTO LAW AND THEN IT CAN DANCE ON THE COURTHOUSE STEPS OR WHATEVER IT DOES.

SO THOSE ARE THE SIX STEPS THAT ESSENTIALLY HAVE TO OCCUR FOR A BILL TO BECOME A LAW.

SO WHEN I HAVE STATUS, THAT'S A VERY LONG WINDED WAY OF SAYING WHEN I SAY OUT OF SENATE COMMITTEE, WHAT THAT MEANS IS IT HAS BEEN APPROVED BY THE HOUSE AND IS BEEN TO THE SENATE COMMITTEE, HAS BEEN APPROVED BY THE SENATE COMMITTEE IS NOW IN THE SENATE FLOOR.

SO IT IS ACHIEVED ACHIEVED FOUR OUT OF SIX STEPS NECESSARY TO BECOME LAW.

SENATE BILL 369 IS REALLY MEANT TO ADDRESS A VERY SPECIFIC ISSUE IN THE CITY OF AUSTIN, WHERE THEY HAVE ANNEXED PROPERTIES AROUND LAKE JACKSON.

HOWEVER, TML FEELS THAT THE LAW COULD BE READ TO APPLY IN A MUCH BROADER CONTEXT AND AFFECT OTHER CITIES LIKE OUR OWN.

SENATE BILL 369 WOULD PROVIDE FOR THE AUTOMATIC ANNEXATION ON DECEMBER 31ST, 2023, OF AN AREA IN THE CITY THAT IS NOT RECEIVING FULL MUNICIPAL SERVICES. ALTHOUGH THE SENATE BILL FUNCTIONALLY ONLY APPLIES IN ONE CITY, LEAGUE, ATTORNEYS DO NOT READ THE BILL THAT WAY.

THE BILL IS NOT BRACKETED AND WOULD LEAD TO THE AUTOMATIC ANNEXATION OF AREAS IN CITIES ACROSS THE STATE.

IMPORTANTLY, THE AUTOMATIC ANNEXATION PROVISION APPLIES TO ANY AREA NOT RECEIVING FULL MUNICIPAL SERVICES, NOT JUST ANNEXED AREAS, NOT RECEIVING FULL MUNICIPAL SERVICES PURSUANT TO A PREVIOUSLY ADOPTED ANNEXATION SERVICE PLAN.

FURTHER, THE ANNEXATION REQUIREMENT APPLIES EVEN IF THE PROPERTY OWNER WISHES TO REMAIN IN THE CITY.

AGAIN, IT WOULD HAVE DRASTIC CONSEQUENCES IN THIS CITY.

LOOKING AT WHAT THE STATUS OF THIS BILL, IT HAS PASSED THE SENATE.

IT IS IN COMMITTEE IN THE HOUSE.

SO IT HAS ACCOMPLISHED THREE OF THE SIX STEPS NECESSARY TO BECOME LAW.

CONTINUING ON LAND USE.

YES, SIR. SO THIS HAPPENS IN THIS ANNEXATION.

ARE WE STILL OBLIGATED TO GIVE SERVICES TO THOSE AREAS? NOT IF YOU BECOME DIS ANNEXED.

AND ANOTHER QUESTION.

WHO DEFINES WHAT FULL CITY SERVICES IS? THAT'S ONE OF THE INHERENT DIFFICULTIES WITH THE LEGISLATION THAT'S CURRENTLY PRESENTED.

IT VERY POORLY DEFINES WHAT CONSTITUTES FULL MUNICIPAL SERVICES, AND IT TOTALLY IGNORES THE FACT THAT MUNICIPALITIES DO NOT ALWAYS CONTROL THEIR ABILITY TO PROVIDE THE SERVICE. WATER AND WASTEWATER SERVICES CAN ONLY BE PROVIDED IF YOU HAVE A CERTIFICATE OF CONVENIENCE AND NECESSITY, AND THE STATE APPROVES THOSE THROUGH THE TEXAS PUBLIC UTILITY COMMISSION.

ALTHOUGH AN AREA WE MAY ANNEX, THEY CAN ARGUE THAT THEY'RE ENTITLED TO DIS ANNEXATION BECAUSE THE CITY IS NOT PROVIDING WATER OR SEWER.

BUT WE CAN'T DO THAT WITHOUT THE PUCS AUTHORITY.

AND IN MANY INSTANCES THESE PEOPLE WOULD PREFER TO STAY IN THE CITY AND WORK WITH THE CITY TO GET SERVICES IN THE FUTURE.

BUT THIS REMOVES THAT AUTHORITY ENTIRELY.

AND IF WE TALK ABOUT PROVIDING SERVICES, WHAT LEVEL OF FIRE SERVICE, EMS SERVICE OR POLICE SERVICE MEETS THAT REQUIREMENT AND WHERE? WE HAVE AN EMERGENCY SERVICE DISTRICT IN SOME AREAS, IN COUNTIES IN TEXAS, IF THAT ALREADY EXISTS, WE'RE NOT AUTHORIZED TO PROVIDE SERVICE IF THE EMS IS ASSESSING ATTACKS TO PROVIDE THAT SERVICE, THAT CREATES ANOTHER TRIPWIRE THAT NOBODY CAN SORT OUT.

SO IF THIS BILL BECOMES LAW, WE ARE GOING TO HAVE A GREAT DEAL OF LITIGATION TO SORT OUT WHAT THE EFFECTIVE IMPACTS ARE ON DIFFERENT COMMUNITIES.

SO THIS ANNEXATION WILL GO BACK TO THE COUNTY.

SO THE COUNTIES OUGHT TO BE AGAINST THIS, TOO.

THE COUNTIES ARE QUITE CONCERNED BECAUSE THEY DO NOT KNOW WHAT THEIR SERVICE RESPONSIBILITIES WILL BE.

COUNTIES GENERALLY REQUIRE IN THEIR PUBLIC WORKS INFRASTRUCTURE, THE DEVELOPMENT OF A COUNTY LEVEL SET OF INFRASTRUCTURE.

THEY DO NOT REQUIRE THE SAME LEVEL OF ROADBED, PREPARATION, RIGHT OF WAY, DEDICATION OR ROAD SURFACE ON MOST COUNTY ROADS BECAUSE THEY'RE DESIGNED TO SUPPORT RELATIVELY LOW DENSITY RURAL DEVELOPMENT.

CITIES ARE SUPPORTING URBAN DEVELOPMENT AND HAVE ENHANCED DEVELOPMENT STANDARDS.

AND SO YOU'VE GOT A REAL DICHOTOMY IN THE PLANNING AS TO WHAT KIND OF ROAD SURFACE STORMWATER SURFACE OR WHERE APPROPRIATE WATER OR SEWER SERVICES WILL BE PROVIDED.

AND IT'S IT'S AN ISSUE OF A LOT, A LOT OF CONCERN.

AND THE HOUSE MAY NOT ULTIMATELY COME TO TERMS WITH THE SENATE OVER HOW THIS BILL WILL BE STRUCTURED.

CONTINUING ON LAND USE HOUSE BILL 14 THAT WOULD REQUIRE THIRD PARTY REVIEW OF PLANS, PLATS AND INSPECTIONS BY A CERTAIN TIME PERIOD AFTER A PLAT IS APPROVED IN THE CITY, IT DOES UTILIZE THIRD PARTY INSPECTIONS IN CERTAIN SITUATIONS.

SO THIS BILL WOULD AFFECT OUR OPERATIONS.

THE STATUS OF THAT BILL HAS CHANGED.

IT IS PASSED THE HOUSE AND IT IS ACTUALLY IN COMMITTEE IN THE SENATE.

SO IT HAS ACCOMPLISHED THREE OF THE SIX STEPS.

SENATE BILL 2037 WOULD ELIMINATE THE APPLICATION OF ANY ELEMENT OF A CITY SUBDIVISION ORDINANCE, AN ORDINANCE RELATING TO ACCESS TO PUBLIC ROADS OR AN ORDINANCE RELATING TO PUMPING, EXTRACTION AND USE OF GROUNDWATER IN THE CITY'S ETJ.

ADDITIONALLY, THE BILL WOULD PROHIBIT THE CITY FROM DIRECTLY OR INDIRECTLY REGULATING USE AND DENSITY OF BUILDINGS IN THE ETJ, INCLUDING A NEW PROHIBITION ON REGULATING MINIMUM LOT SIZES IN THE ETJ.

THE CITY IS THE PLATTING AUTHORITY IN THE ETJ TALKING TO STAFF.

I'LL BE HONEST, WE'RE NOT EXACTLY SURE HOW THIS WOULD AFFECT US AND HOW MANY WAYS IT WOULD AFFECT US, BUT I'M PRETTY SURE THAT IT WOULD LIMIT OUR ABILITY IN THE ETJ.

CONTINUING ON WITH LAND USE.

SENATE BILL 1412 WOULD PROHIBIT POLITICAL SUBDIVISIONS FROM PERMITTING RESIDENTIAL PROPERTY OWNERS, FROM A BUILDING OR FROM BUILDING OR ERECTING AN ACCESSORY DWELLING UNITS BY RIGHT.

THE PROBLEM WITH THIS BILL IS IT COULD DRASTICALLY INCREASE DENSITY IN THE AREA.

WHEN WE WHEN PEOPLE MUCH SMARTER THAN MYSELF PLAN AREAS, THEY'RE EXPECTING A CERTAIN KIND OF DENSITY, THINGS LIKE THAT.

WHEN YOU'RE LOOKING AT A SINGLE FAMILY HOME, IT'S A SINGLE FAMILY NEIGHBORHOOD.

THIS COULD AUTOMATICALLY DOUBLE THE AMOUNT OF DENSITY IN ANY ONE GIVEN AREA.

THE STATUS OF THIS BILL IS PASSED THE SENATE.

IT IS OUT OF COMMITTEE IN THE HOUSE.

SO IT IS ACCOMPLISHED FOUR THE SIX STEPS NECESSARY TO BECOME LAW.

SENATE BILL 1787 WOULD PROHIBIT MUNICIPALITIES WHOLLY OR PARTLY LOCATED IN A COUNTY WITH A POPULATION OF 300,000 OR MORE FROM REQUIRING RESIDENTIAL LOTS TO BE LARGER THAN 1,400 SQUARE FEET, OR FOR DENSITY REGULATIONS TO REQUIRE DENSITY LESS THAN 3.31.1 UNITS PER ACRE.

OBVIOUSLY THE SAME KIND OF PROBLEM HERE.

THIS BILL WOULD CREATE MAJOR PROBLEMS WITH OUR ZONING AND SUBDIVISION ORDINANCE.

OBVIOUSLY, WE WOULD FIT WITHIN THE CONFINES OF OF THIS SENATE BILL.

THE STATUS OF THIS BILL IS THAT IT'S PASSED THE SENATE.

IT IS IN COMMITTEE IN THE HOUSE.

SO IT HAS ACCOMPLISHED THREE OF THE SIX STEPS NECESSARY.

COUNCIL NEEDS TO UNDERSTAND THAT YOU AND YOUR PLANNING AND ZONING COMMISSION ARE GOING TO BE FACED WITH A RUBICON THAT'S IMPOSSIBLE TO ENVISION. WE WILL NOT BE ABLE TO REQUIRE IN OUR ZONING OR SUBDIVISION ORDINANCE LOTS GREATER THAN 1,400 SQUARE FEET.

THAT IS A MOBILE HOME SITE.

I MEAN, THAT'S WHAT YOU'RE BASICALLY LOOKING AT.

THE CITY OF FORT WORTH, WHICH HAS RELATIVELY LAX URBAN DEVELOPMENT STANDARDS.

THE SMALLEST LOT IT WILL ALLOW IN THE CITY IS 5,000FT², 100FT IN DEPTH AND 50FT IN WIDTH.

WE'RE TALKING SOMETHING A THIRD OF THAT SIZE IS THE MAXIMUM WE CAN REQUIRE.

AND THAT THAT PUTS US IN A REAL BOX.

AND THE DIFFICULTY IS YOUR CITIZENS WILL COME TO YOU COMPLAINING ABOUT CHANGES IN THE CHARACTER OF THEIR NEIGHBORHOODS, IN ADJOINING PROPERTIES, IN DENSITY, LOADING AT SCHOOLS, ON ROADWAYS.

WE CAN'T TELL PEOPLE THE SIZE OF THE LOTS.

THIS WOULD PREEMPT US TOTALLY.

AND WE COULD NOT HAVE A REGULATION THAT WOULD CONTRAVENE THIS PROVISION.

THE ORIGINAL BILL, THE ORIGINAL SUPER PREEMPTION BILL THAT MATT ADDRESSED AT THE FRONT END.

IS AS DANGEROUS AS ANY PIECE OF LEGISLATION WE'VE SEEN, BECAUSE THE WAY IT IS WORDED, IT SAYS IF THE STATE HAS ADOPTED A REGULATION WITHIN FINANCE CODE, AGRICULTURAL CODE, INSURANCE CODE, LABOR CODE, OCCUPATIONAL CODE, THEN WE ARE PREEMPTED FROM REGULATING.

NO ONE CAN YET DEFINE THE PARAMETERS OF THE IMPACT OF THE BILL, BECAUSE IN SOME OF THESE CODES, THEY ADDRESS ISSUES ABOUT LOCAL ACTIVITIES, SALES ACTIVITIES IN AN OCCUPATION CODE THAT MAY TAKE AWAY OUR ABILITY TO REGULATE GARAGE SALES. IT MAY TAKE AWAY OUR ABILITY TO REGULATE PAYDAY LENDING, ANYTHING OF THAT NATURE, WHICH A LOT OF CITIES HAVE CHOSEN TO NOT PROHIBIT, BUT TO SIMPLY REGULATE. ALL OF THAT WILL BE GONE BECAUSE THE STATE HAS CHOSEN TO REGULATE IN THAT AREA.

SO IT TAKES AWAY OUR AUTHORITY.

AND AS MATT POINTED OUT, THE MORE FRIGHTENING ASPECT IS THEY'VE TAKEN AWAY OUR IMMUNITY AND THEREFORE CITIZENS CAN BRING SUIT WHERE BEFORE THAT SUIT WOULD HAVE BEEN PROHIBITED UNDER THE DOCTRINE OF SOVEREIGN IMMUNITY.

THE LAST ONE THERE IS HOUSE BILL 2455, AND IT AMENDS THE LOCAL GOVERNMENT CODE TO REQUIRE FIRE, DEPARTMENT OF MUNICIPALITY, COUNTY OR SPECIAL PURPOSE DISTRICT TO OFFER TO EACH FIREFIGHTER EMPLOYED THE FIRE DEPARTMENT AN ANNUAL OCCUPATIONAL MEDICAL EVALUATION AT NO COST TO THE FIREFIGHTER.

AND IT HAS CERTAIN INCLUSIONS.

THIS HAS PASSED THE HOUSE.

IT'S IN COMMITTEE IN THE SENATE.

IT IS ACCOMPLISHED THREE OF THE SIX STEPS TO BECOME LAW.

IT WOULD REQUIRE THEM TO DO THAT.

AND I WOULD SAY FROM MY EXPERIENCE, IT IS MONEY WELL SPENT BECAUSE ONE OF THE MAIN ADVANTAGES FOR COMMUNITIES LIKE OURS WHO DO PROVIDE THE FULL SCREENING, THERE ARE SOME ENHANCEMENTS THAT WE'LL BE TALKING ABOUT, PROBABLY IN MY STRATEGIC PLAN IS IT'S MONEY WELL SPENT BECAUSE WITH THE HIGH RATE OF INCIDENTS OF CANCERS THAT THE FIREFIGHTERS ARE HAVING THROUGHOUT THE NATION, A 3 OR $400 SCREENING THAT COULD PREVENT MAYBE $1 MILLION OR A HALF $1 MILLION MEDICAL BILL OR EVEN MORE.

AND THEN MORE IMPORTANTLY, THE SAVING OF A LIFE.

YOU REALLY CAN'T PUT A VALUE TO IT.

SO I THINK FROM A TAXPAYER STANDPOINT AND, YOU KNOW, I'M A TAXPAYER, TOO, IT'S MONEY WELL SPENT BECAUSE THE KEY IS TO BE PREVENTATIVE AND BE PROACTIVE IN THESE TYPES OF SCREENINGS, PLUS THE BENEFITS THAT YOU GET THAT WE HAVE FOR MAINTAINING A HIGH HEALTH OF AEROBIC CONDITIONING.
