Consider approval of a resolution recommending approval of a professional services contract between the City and Kimley-Horn and Associates, Inc. for design of the extension of Lakewood Drive from FM 1902 to Chisholm Trail Parkway in the amount of $1,090,915.00. ASSOCIATES FOR DESIGN OF THE EXTENSION OF LAKEWOOD DRIVE FROM FM 1902 TO CHISHOLM TRAIL PARKWAY IN THE AMOUNT OF $1,090,915.

PRESENTED BY ERIC THOMPSON, DEPUTY DIRECTOR OF PUBLIC WORKS.

GOOD EVENING.

VERY BRIEFLY, I'D LIKE TO WALK YOU THROUGH A QUICK PRESENTATION ON THIS PROPOSED CONTRACT TO EXTEND LAKEWOOD DRIVE.

A LITTLE BIT OF HISTORY.

IN 2021, CITY COUNCIL AND THE CORPORATION APPROVED A CHAPTER 380 ECONOMIC DEVELOPMENT AGREEMENT FOR THE PROPOSED CHISHOLM SUMMIT MASTER PLANNED COMMUNITY.

COUNCIL ALSO PURCHASED APPROXIMATELY 107 ACRES OF LAND FOR FUTURE FOR A FUTURE BUSINESS PARK AND 2022.

YOU BOTH APPROVE THE FINAL DESIGN OF LAKEWOOD DRIVE FROM COUNTY ROAD 1020 TO FM 1902.

COUNCIL ALSO APPROVED THE COMMUNITY FACILITIES CONTRACT WITH RAY DEVELOPMENT LIMITED FOR THE CONSTRUCTION OF LAKEWOOD DRIVE AND CONSTRUCTION BEGAN IN OCTOBER.

FROM THE COVER SLIDE WAS ACTUALLY A PROGRESS PHOTO, BUT IT WAS PROBABLY.

IT'S PROBABLY A COUPLE MONTHS OLD NOW.

BUT IF YOU'VE BEEN OUT IN THAT PART OF THE TOWN RECENTLY, THAT CONSTRUCTION IS WELL UNDERWAY.

SO LAKEWOOD DRIVE, THAT'S CURRENTLY UNDER CONSTRUCTION, INCLUDES A TEMPORARY CONNECTION TO FM 1902.

THAT WAS PART OF THE DESIGN THAT COUNCIL APPROVED BACK IN OCTOBER.

AND THIS EXTENSION THAT WE'RE PROPOSING TODAY WOULD CREATE MORE DIRECT ACCESS TO AND FROM THE CHISHOLM TRAIL PARKWAY TO THE HOOPER BUSINESS PARK AND THE MASTER PLAN COMMUNITY THAT I MENTIONED EARLIER.

THE EXHIBIT AT THE BOTTOM OF THIS SLIDE.

TO THE FAR LEFT OF THE SLIDE IS THE ACTUAL THAT TEMPORARY CONNECTION ON THE WEST SIDE OF THE OF THAT EXHIBIT SHOWS THAT YOU'VE GOT THE FOUR LANES OF LAKEWOOD KIND OF NARROWING DOWN TO FOR THIS TEMPORARY CONNECTION THAT I SPOKE ABOUT.

AGAIN, THE PROPOSED CONTRACT WITH WIDEN DO REALIGNMENT OF FM 1902 TO CONTINUE LAKEWOOD DOWN TO THE TOLLWAY.

THIS EXHIBIT PROBABLY GIVES YOU A LITTLE BETTER IDEA IN GREEN IS THE CURRENT LAKEWOOD DRIVE THAT'S UNDER CONSTRUCTION.

BEGINNING AT THE LOWER RIGHT AT COUNTY ROAD 1020.

UP TO THE HOOVER BUSINESS PARK AREA.

YOU SEE A LITTLE SMALL GREEN KIND OF OFFSHOOT THAT'S THAT TEMPORARY CONNECTION THAT I MENTIONED.

AND THEN WE SHOW IN PURPLE WHAT WE'RE CALLING THE EXTENDED LAKEWOOD DRIVE.

SO FROM WHERE THE CURRENT PROJECT ENDS TO.

TO AND THROUGH THE TOLLWAY.

SO THE EXTENSION SINCE FM 1902 IS A STATE HIGHWAY.

IT'S ON THE TXDOT SYSTEM.

WE'LL HAVE TO DESIGN THIS TO A TXDOT STANDARD, AT LEAST IF WE CHOOSE TO OR IF WE'RE IF WE DECIDE TO PURSUE AN AWARD AT ANY FEDERAL FUNDING, WE'D HAVE SOME ADDITIONAL HOOPS TO JUMP THROUGH TO, TO MEET THOSE COMMITMENTS.

UM, SO THERE COULD BE FEDERAL FUNDING FOR CONSTRUCTION.

AND WE'RE PROCEEDING AS IF AT THIS POINT WE'RE GOING TO WE'RE GOING TO START THE DESIGN AS IF, YOU KNOW, WORST CASE THAT WE'LL GET FEDERAL FUNDING TO HELP PAY FOR THE

CONSTRUCTION. AT THE VERY LEAST, IT'S GOING TO HAVE TO BE DESIGNED TO DOT STANDARDS.

SO THERE'S A TON OF COORDINATION AND TXDOT PROCESS ROLLED INTO THE DESIGN CONTRACT.

ESTIMATED CONSTRUCTION COST IS CURRENTLY ABOUT JUST UNDER 17 MILLION.

AND IF WE'RE IF WE'RE USING STRICTLY A TXDOT PROCESS AND IF FEDERAL FUNDS COME INTO PLAY, THERE'S A LITTLE BIT MORE PROCESS THAT GETS ADDED AND THE CONSTRUCTION SCHEDULE PUSHES OUT APPROXIMATELY A YEAR AND THE COST INCREASES TO ABOUT 17.6.

BUT IT'S IMPORTANT TO NOTE THAT IF WE'RE SUCCESSFUL IN GETTING FEDERAL FUNDING, YOU KNOW, THAT COULD POTENTIALLY BE AS MUCH AS 80% OF THAT CONSTRUCTION COST.

SO WE WANT TO MAKE SURE WE'RE KIND OF COVERING ALL OF OUR BASES AND PREPARED TO PROCEED IN EITHER DIRECTION.

KIMLEY-HORN ASSOCIATES WAS SELECTED TO PROVIDE THIS DESIGN AT A NEGOTIATED FEE OF JUST UNDER 1.1 MILLION.

AND THE CONTRACT WAS PROPOSED TO BE FUNDED BY THE FOR ECONOMIC DEVELOPMENT CORPORATION.

AND THE MAJOR CONTRACT ELEMENTS ARE SHOWN HERE ON THIS SLIDE.

AGAIN, IT'S A LOT OF TEXT AND POTENTIALLY FEDERAL COORDINATION, ENVIRONMENTAL PERMITTING AND REVIEW.

A LOT OF FRANCHISE UTILITY FRANCHISE AND OTHER UTILITY COORDINATION.

SO THESE ARE KIND OF THE HIGHLIGHTS OF WHAT MAKES UP THAT 1.1 MILLION NEARLY.

UH KIMLEY-HORN HAS A COUPLE OR A FEW SUB CONSULTANTS ON THEIR TEAM.

SPOONER AND ASSOCIATES TO HELP WITH SURVEY CMJ AND ENGINEERING WITH GEOTECHNICAL EXPERTISE AND THEN STANTEC ENGINEERING TO DO THE HEAVY LIFTING ON THE ENVIRONMENTAL PORTION OF THE WORK.

THIS SLIDE GIVES YOU AN OVERVIEW OF THE SCHEDULE.

WE'RE HERE IN MARCH PROPOSING TO AWARD THE DESIGN CONTRACT.

APRIL THROUGH.

ABOUT THE END OF 23 WOULD BE SCHEMATIC DESIGN.

WELL WITH DETAILED DESIGN BEGINNING APPROXIMATELY JANUARY OF 2024.

AND THIS IS ALL BASED ON THAT FEDERAL FUNDING SCHEDULE.

AGAIN, IF FEDERAL FUNDS DON'T COME INTO PLAY, THEN WE CAN SHORTEN THE SCHEDULE BY ABOUT A YEAR.

BUT AS FOLLOWING THE FEDERAL PROCESS, WE WOULD ANTICIPATE CONSTRUCTION BEGINNING APPROXIMATELY JANUARY OF 2028.

SO IT'S NOT A VERY LONG PROJECT, BUT THERE'S A LOT INVOLVED AND A LOT OF PROCESS DEPENDING ON STATE AND FEDERAL AGENCIES THAT WE NEED TO COORDINATE WITH, WHICH IS ALL DRIVEN BY WHO'S GOING TO PAY FOR THE CONSTRUCTION.

SO A LENGTHY PROCESS, A LOT OF WORK TO BE DONE BETWEEN NOW AND 2027 OR 2028 TO START CONSTRUCTION.

AND THAT'S THAT CORRESPONDS TO THE $1.1 MILLION DESIGN CONTRACT.

SO HERE TODAY TO ASK FOR YOUR SUPPORT OF A RESOLUTION SUPPORTING THE AWARD OF THIS CONTRACT TO KIMLEY-HORN AND ASSOCIATES FOR JUST UNDER 1.1 MILLION.

AND THEN LATER ON THE CITY COUNCIL AGENDA, THERE WILL BE A CORRESPONDING ITEM TO ACTUALLY AWARD THE CONTRACT.

WITH THAT, I'D BE HAPPY TO TAKE ANY QUESTIONS.

OKAY. IS IT ENTIRELY SPECULATIVE THAT WE EXPECT TO GET FEDERAL OR STATE FUNDING FOR THE CONSTRUCTION? WELL, FM 1902 IS A STATE ROUTE, SO WE HAVE TO FOLLOW SOME STATE PROCESS NO MATTER WHAT.

I THINK THERE'S BEEN A BUILDING AND PRODUCTIVE RELATIONSHIP BETWEEN THE CITY AND THE COUNCIL OF GOVERNMENTS THAT PRIMARILY CONTROLS THE FEDERAL MOST OF THE FEDERAL FUNDS THAT COME TO THIS AREA.

SO WE'RE JUST TRYING TO COVER OUR BASES SO THAT IN THE EVENT THAT WE'RE SUCCESSFUL IN SECURING SOME FEDERAL FUNDS, WE WANT TO MAKE SURE THAT WE'VE GOT THE DESIGN PROCESS THAT THAT MEETS ALL OF THEIR REQUIREMENTS.

I DON'T DOUBT THAT THAT'S TRUE.

I'M QUESTIONING WE'RE GOING TO SPEND $1 MILLION TO DESIGN A ROADWAY THAT WILL NOT GET BUILT BY US ALONE.

POTENTIALLY, WE DON'T KNOW THAT YET.

WELL, OKAY. BUT ASSUMING THAT ANOTHER COUNCIL IN ANOTHER YEAR MIGHT AGREE THAT THAT'S AN IMPORTANT ENOUGH ROADWAY TO FUND $18 MILLION WORTH OF CONSTRUCTION TO GO A FRACTION OF A MILE WHEN THERE'S ALREADY A ROAD THERE.

CAUSES ME TO BEG THE QUESTION.

NOW, IF IF THE POSSIBILITY OF GETTING A GRANT IS PREDICATED UPON HAVING A DESIGN IN PLACE NOW,

THEN THAT MAKES SENSE.

THAT'S THE REASON FOR MY QUESTION ABOUT JUST HOW SPECULATIVE THIS UNDERTAKING IS.

YEAH, WE'VE HAD VERY PRODUCTIVE CONVERSATIONS WITH THE COG ABOUT POTENTIAL FUNDING OF THIS PROJECT.

I CAN'T TELL YOU 100% THAT IT'S GOING TO BE FUNDED, BUT THEY FEEL VERY STRONGLY THAT IT COULD BE FUNDED.

ONE OF THE THINGS THAT THEY'VE ASKED US TO DO IN LOOKING AT THIS PROJECT WAS GO BEYOND JUST THE CONNECTION TO THE CHISHOLM TRAIL AND GO UNDERNEATH THAT BRIDGE.

AND I DON'T KNOW HOW FAR OF A DISTANCE THAT IS.

IT'S NOT VERY FAR, BUT THERE'S A LOT OF ENGINEERING TO GO UNDERNEATH THAT AND WIDEN IT TO TWO LANES IN EACH DIRECTION.

SO THERE'S SOME COSTS THERE.

I THINK FROM OUR PERSPECTIVE THAT ALL ALONG IN THIS PROCESS WILL BE GETTING CONTINUAL FEEDBACK FROM COG TXDOT, THE FEDERAL GOVERNMENT.

AND IF IT'S DETERMINED AT SOME POINT IN THE NEXT FEW MONTHS THAT THE FEDERAL FUNDS WON'T BE A PART OF THIS PROJECT, THEN WE'D CERTAINLY CHANGE THE DESIGN AND COME BACK TO YOU AND LOOK AT HOW WE WOULD DO IT.

BUT WE FEEL VERY STRONGLY WE HAVE A GOOD CHANCE TO DO IT.

I THINK YOUR POINT IS WELL TAKEN THAT YOU HAVE TO HAVE SOME ENVIRONMENTAL WORK DESIGN, A SCHEMATIC DESIGN OF HOW IT WOULD EVEN WHAT IT WOULD EVEN LOOK LIKE TO PROCEED WITH LOOKING AT THE GRANT OPPORTUNITIES.

AND THAT'S REALLY KIND OF HOW WE'VE WE'VE PROPOSED TO LOOK AT IT AS TO HAVE A PROCESS IN PLACE TO GO FORWARD.

I GUESS WHERE I'M AT IS I DON'T I DON'T MIND APPROVING THE PROCESS OF OF A COMPLETE DESIGN, IF THAT'S WHAT THE MILLION $90,000 IS DESIGNED TO DO. BUT IF AT SUCH TIME WE SEE THAT THE FUNDING IS NOT LIKELY TO COME THROUGH, I'D RATHER NOT HAVE PAID FOR AN INTRICATE DESIGN OF A ROADWAY THAT TXDOT.

MAY DECIDE TO GO ABOUT DOING A DIFFERENT WAY THEMSELVES.

YOU KNOW, WE'RE NOT GOING TO BE THE ONLY DEVELOPMENT THAT THIS WILL SERVE.

I THINK IT'S REASONABLE TO SPECULATE THAT THERE WILL BE OTHER DEVELOPMENT IN OTHER MUNICIPALITIES, OTHER AREAS THAT IN THE COUNTY AND SO FORTH THAT ARE GOING TO BE USING THIS ROADWAY.

IF I FEEL LIKE IT'S LIKELY THAT SIMILAR TO EAST RENFRO, THAT WE'LL HAVE TO PAY FOR THE DESIGN, AS I RECALL WE DID, TO GET THE THING DONE. BUT I'D LIKE TO HAVE A STOP GAP IN HERE SOMEWHERE WHERE WE DON'T GO ALL THE WAY THROUGH $1 MILLION DESIGN CONTRACT FOR A ROAD THAT WILL NEVER, NEVER GET BUILT OR AT LEAST NOT GET BUILT IF IT'S UP TO US TO PAY FOR IT.

I THINK WE HAVE A CONNECTION.

BY THE WAY, HOW. WHERE ARE WE? HAS TXDOT APPROVED OUR TEMPORARY CONNECTION? ARE WE SOLID THERE? YES. IS IT REQUIRED TO BE A SIGNALIZED INTERSECTION OR IS IT GOING TO BE IT WILL INITIALLY NOT BE A SIGNALIZED INTERSECTION.

BUT ONE OF THE ONE OF THE THINGS THAT WE'RE TRYING TO POSITION US FOR IS THAT AS THE DEVELOPMENT, I GUESS, JUST EAST OF HERE STARTS TO DEVELOP, THOSE TWO LANES WILL NOT BE SUFFICIENT TO CARRY TRAFFIC OVER TO.

OF COURSE NOT. RIGHT. SO AND TO YOUR EARLIER POINT, A LOT OF THIS CONTRACT IS IT'S NOT LIKE WE'RE GOING TO DEFINITELY SPEND A MILLION, 90,000 JUST BECAUSE THAT'S THE CONTRACT. WE'VE GOT A LOT OF THE COMPONENTS OF THE CONTRACT THAT ARE KIND OF TIME AND MATERIALS.

SO AS SOON AS WE GET TO THE POINT WHERE WE DECIDE OFFICIALLY THAT NO, THERE WON'T BE FEDERAL FUNDING, THEN A LOT OF THAT EFFORT WILL CEASE TO TO AUTHORIZE AND WILL SPEND SIGNIFICANTLY LESS THAN A MILLION, 90,000.

SO AGAIN, THIS WAS JUST TRYING TO COVER ALL OF OUR BASES, GET US A CONTRACT THAT GETS US THROUGH AT LEAST THE ONE YEAR LONG SCHEMATIC DESIGN PROCESS WITH TXDOT WHILE THE OTHER FUNDING DECISIONS GET MADE.

WHAT I MIGHT SUGGEST, BASED ON YOUR COMMENTS AND THE SCHEDULE THAT ERIC IS PRESENTED IS PERHAPS WE COULD COME BACK AT THE END OF DECEMBER BEFORE THE DETAILED DESIGN BEGINS, GIVE YOU AN UPDATE, TALK ABOUT POTENTIAL OPTIONS OF HOW WE COULD PROCEED UNDER THIS CONTRACT WITH YOU.

BUT YOU KNOW, WE COULD COME OUT EARLIER OR A LITTLE LATER, DEPENDING ON HOW THE PROJECT GOES, BUT MAYBE BY THE END OF THE YEAR, I THINK WE'D HAVE IT BEFORE THE DETAILED DESIGN STARTS.

GIVE YOU AN OUTLOOK OF HOW THAT MIGHT PLAY OUT.

I HAVEN'T HAD THOSE CONVERSATIONS THAT YOU'VE HAD WITH WITH COG AND OBVIOUSLY I'M NOT AS AS SOLID IN MY UNDERSTANDING OF JUST HOW COMMITTED THEY WOULD BE TO THIS PROJECT.

NOW, IF WE WERE LOOKING AT A SITUATION WHERE THIS FUNDING WAS LOCKED IN AND ALL WE HAD TO DO WAS GET THE DESIGN OUT THERE, I'D BE ALL OVER THAT.

BUT SINCE IT IS SOMEWHAT UNCERTAIN, I THINK IT WOULD BE GOOD TO TO TAKE A LOOK AT IT WHEN WE'RE TO THE POINT IN THE PROCESS WHERE WE CAN SHOW A SCHEMATIC AND SHOW THE [INAUDIBLE] AND TXDOT THAT WE'RE OPERATING IN GOOD FAITH AND PUTTING OUR EFFORTS INTO TRYING TO MAKE THIS HAPPEN, NOT JUST SITTING BACK WAITING FOR SOMETHING TO FALL IN OUR LAP.

SO I REALIZE YOU DON'T GET ANYTHING AT ALL WITHOUT PUTTING SOMETHING INTO IT.

RECOMMENDING APPROVAL OF DEMOLITION AGREEMENT BETWEEN THE CITY AND GARRETT DEMOLITION INC FOR ASBESTOS ABATEMENT AND DEMOLITION OF 130 EAST RENFRO STREET IN THE AMOUNT OF $201,462.

THIS WILL BE PRESENTED ALSO BY ERIC THOMPSON.

GOOD AFTERNOON AGAIN.

JUST A COUPLE OF SHORT BLOCKS EAST OF HERE IS THE HILL COLLEGE SITE AT 130 EAST RENFRO STREET.

WE ADVERTISE FOR BIDS FOR ASBESTOS ABATEMENT AND DEMOLITION OF THIS SITE IN FEBRUARY.

WE ALSO HAD AN OPTIONAL PRE-BID MEETING FOR POTENTIAL CONTRACTORS TO COME OUT AND TAKE A LOOK INSIDE AND AROUND THE GROUNDS.

SOLICITATION CLOSES FEBRUARY 23RD, AND WE ALSO ASK FOR OPTIONAL PRICING TO TAKE ADDITIONAL CARE FOR THE STAINED GLASS WINDOWS THAT YOU SEE IN THE LOWER RIGHT.

THERE'S ANOTHER ITEM ON YOUR AGENDA A LITTLE LATER THAT WILL SPEAK A LITTLE MORE TO THAT.

UM. SO IN THE END, WE RECEIVED FOUR COMPLETE BIDS FOR BOTH THE ASBESTOS AND THE ABATEMENT.

A FEW VENDORS DECIDED TO ONLY GIVE PRICING ON THE ABATEMENT PORTION OF THE WORK, BUT OF COURSE WE NEEDED A TURNKEY CONTRACT AND IT ACTUALLY TURNED OUT THAT GARRETT DEMOLITION PROVIDED THE LOWEST COST FOR BOTH COMPONENTS.

SO WE'RE RECOMMENDING.

THAT THE FULL CONTRACT OF $201,462 BE AWARDED TO GARRETT DEMOLITION, WHICH INCLUDES AN ADDITIONAL 8500.

FOR THE STAINED GLASS WINDOW REMOVAL.

THE OTHER THREE BAYS ARE SHOWN HERE.

THIS PROJECT IS TO BE FUNDED FROM FOUR OPERATING FUNDS.

WE ALSO HAVE JUST UNDER 36,000 IN ASBESTOS SURVEY AND ENVIRONMENTAL CONSULTING.

AS YOU'RE PROBABLY AWARE, THERE ARE A LOT OF STATE AND FEDERAL REGULATIONS THAT COME INTO PLAY WHEN DOING ASBESTOS ABATEMENT.

THAT'S REQUIRED TO BE DONE BEFORE THE BUILDING CAN BE DEMOLISHED.

THERE'S A LOT OF PAPERWORK, A LOT OF AIR MONITORING AND OTHER ACTIVITIES THAT NEED TO TAKE PLACE.

IN DECEMBER OF 22, WE HIRED THE ENVIRONMENTAL CONSULTANT AND THEN.

ASSUMING CITY COUNCIL APPROVES THE CONTRACT LATER TODAY.

THE PLAN WOULD BE TO HAVE A CLEAN SITE READY FOR REDEVELOPMENT IN MAY OF 2023 AND A COUPLE OF SHORT MONTHS FROM NOW WE SHOULD HAVE A CLEAN SITE. YOU MIGHT ALSO RECALL THAT HILL COLLEGE VACATED THE PROPERTY AT THE END OF JANUARY, ALMOST TWO MONTHS AGO NOW.

SO WE'RE PRIMED AND READY TO GO.
