PURSUANT TO SECTION 551.071 OF THE TEXAS GOVERNMENT CODE.

SO WE'LL MOVE ON TO ITEM THREE A TO CONSIDER APPROVAL OF THE MINUTES FROM THE OCTOBER 3RD, 2022 ECONOMIC DEVELOPMENT CORPORATION MEETING.

Consider approval of a resolution authorizing the enforcement of a contract dated July 18, 2022 with James Crouch and Katherine Hawles to acquire a 30.76 acre tract of land in Johnson County, Texas, commonly known as 2140 SW Hulen St, authorizing the Board President to direct and oversee the filing of a lawsuit, and authorizing the expenditure of funds. (Staff Contact: Matt Ribitzki, Deputy City Attorney/Compliance Manager)]

NEXT ON THE AGENDA IS ITEM THREE B TO CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE ENFORCEMENT OF A CONTRACT DATED JULY 18TH, 2022, WITH JAMES CROUCH AND KATHERINE HAWLES TO ACQUIRE A 30.76 ACRE TRACT OF LAND IN JOHNSON COUNTY, TEXAS, COMMONLY KNOWN AS 2140 SOUTHWEST HULAND STREET.

AUTHORIZING THE BOARD PRESIDENT TO DIRECT AND OVERSEE THE FILING OF A LAWSUIT AND AUTHORIZING THE EXPENDITURE OF FUNDS.

THIS WILL BE PRESENTED BY MATT RIBITZKI, DEPUTY CITY ATTORNEY.

ALL RIGHT, GOOD EVENING, BOARD.

AS THE MAYOR PRO TEM MENTIONED, THIS IS REGARDING A CONTRACT FOR THE PURCHASE OF REAL PROPERTY AT 2140 SOUTHWEST HULAND STREET.

THE TYPE A CORPORATION ENTERED INTO THIS CONTRACT TO PURCHASE THIS PROPERTY.

IT'S ABOUT 30 ACRES IN JULY ON THE IN THE PICTURE THERE IT'S OUTLINED IN YELLOW.

THE TYPE A CORPORATION IS FULLY PERFORMED ON THE CONTRACT, BUT THE SELLERS HAVE NOT CLOSED THE TRANSACTION IN ACCORDANCE WITH THE CONTRACT.

THE RESOLUTION, BEFORE YOU DENIED, AUTHORIZES THE FILING OF A LAWSUIT TO ENFORCE THE CONTRACT.

AND AGAIN, THE ACTION REQUEST IS TO APPROVE OR DENY THE RESOLUTION AUTHORIZING THE ENFORCEMENT OF THE CONTRACT AND STAFF RECOMMENDS APPROVAL.
