THE RECIPIENT TODAY ON BEHALF OF THIS MONTH WOULD BE JENNIFER PRUITT, INTERIM DIRECTOR OF DEVELOPMENT SERVICES, ALONG WITH HER STAFF, MAYOR.

NOW, THEREFORE, I MAYOR CHRIS FLETCHER ON BEHALF OF THE CITIZENS OF BURLESON AND THE ENTIRE CITY COUNCIL, HEREBY PROCLAIM THE WEEK OF OCTOBER 2021 COMMUNITY PLANNING MONTH IN THE CITY OF BURLESON.

THE STAFF PRESENTER TONIGHT IS DEANNA PHILLIPS, DIRECTOR OF COMMUNITY SERVICES, MS. PHILLIPS. GOOD EVENING.

HELLO, MAYOR AND COUNCIL.

I'M EXCITED TO STAND IN FRONT OF ALL OF YOU TONIGHT AND PRESENT TO YOU OUR STATE AWARDS.

I WANT TO INTRODUCE COLIN GREGORY.

HE DOES PRAYERS AND VIDEOS, SO COLIN JUST GOT A CHANGE IN TITLE.

HE'S OUR VIDEO PRODUCTION SPECIALIST, WHICH ACTUALLY MAKES MUCH MORE SENSE FOR WHAT HE DOES. AND THIS IS CHRISTINA STAYTON.

SHE WAS OUR 2020 EMPLOYEE OF THE YEAR, AND SHE'S OUR COMMUNICATIONS COORDINATOR.

SO THAT'S THE TEAM.

I JUST WANT IT TO TAKE A QUICK MOMENT AND TALK TO YOU ABOUT THE TAMI AWARDS, WHICH IS OUR STATE PROFESSIONAL AGENCY.

THEY HAD A RECORD BREAKING FOUR HUNDRED AND THIRTY FIVE SUBMITTALS FOR AWARDS THIS YEAR FROM EIGHTY THREE DIFFERENT MUNICIPALITIES.

THERE'S TWENTY SIX CATEGORIES AND WE WERE LUCKY TO TAKE HOME FIRST PLACE IN THREE OF THOSE CATEGORIES, WHICH IF YOU LIKE NUMBERS, THAT'S 11 PERCENT OF ALL CATEGORIES.

SO THE TAMI AWARDS THAT WE TOOK HOME AND WE HAVE THEM HERE.

I DIDN'T BRING ALL SEVEN AWARDS BECAUSE I THOUGHT THAT MIGHT BE TOO SHOWY, BUT YOU CAN SEE OUR OUR FIRST PLACE AWARDS.

WE GOT IT FOR YOUR BULLET, YOUR RESPONSIBILITY.

SO I DON'T KNOW IF YOU'LL REMEMBER, BUT ABOUT A YEAR AND A HALF AGO, WE HAD SOME ISSUES WITH PEOPLE IN THE COUNTY SHOOTING THEIR GUNS AND THEN GOING INTO THE CITY LIMITS.

SO WE LAUNCHED A FULL CAMPAIGN FOR THAT, AND I KNOW A LOT OF THE COUNCIL MEMBERS THAT

WERE HERE THEN AND A LOT OF PEOPLE THAT LIVE ON THAT SIDE OF TOWN, WERE VERY FAMILIAR WITH THAT. SO WE TOOK HOME FIRST PLACE FOR THAT AND WE TOOK HOME BEST USE OF PHOTOGRAPHY FOR THE SNOW CONTEST PICTURES THAT WE HAD.

WE HAD GREAT RECEIVING FROM THE PUBLIC, WHICH THEY THOUGHT WAS SUCH A COOL IDEA WAS TO USE THE PUBLIC IN THAT KIND OF FUN WAY.

AND THEN WE ALSO TOOK HOME FIRST PLACE IN COMMUNICATIONS PLANNING FOR OUR BRANDING BURLESON THAT WE DID.

WE TOOK HOME FOR SECOND PLACE AWARDS.

WE WON SECOND PLACE FOR BEST USE OF HUMOR IN THE OLD TOWN GET DOWN VIDEO.

WE WON SECOND PLACE FOR BEST RECURRING PROGRAM, WHICH IS SHARKEY TEACHES SWIM SAFETY.

THERE'S TEN LESSONS INVOLVED WITH THAT, AND WE ALSO WON BEST USE OF OUR PROMOTIONAL ITEM WITH OUR BURLESON BABIES.

IT COMES TO THE BOX AND WE PUT TOGETHER THIS PAMPHLET THAT WELCOMES NEW FAMILIES INTO BURLESON, AND IT GIVES THEM INFORMATION ABOUT ALL THE PARKS AND A VARIETY OF DIFFERENT ALL THE LIBRARIES. SO IT JUST KIND OF AS A WELCOME TO BURLESON WITH YOUR NEW FAMILY MEMBER. AND THEN WE ALSO WON SECOND PLACE WITH MOST CREATIVE WITH LEAST DOLLARS, WHICH WAS BTX BEST FEST.

BUT WE KIND OF FEEL LIKE EVERYTHING WE DO IS MOST CREATIVE WITH LEAST DOLLARS.

SO WE TRY TO WE TRY TO BE VERY, VERY SURE ABOUT HOW WE SPEND AND YOU KNOW, OUR BUDGET.

SO I JUST WANTED TO PRESENT MY STAFF.

I KNOW YOU GUYS DON'T GET TO SEE THEM AS MUCH AS YOU GET TO SEE ME, WHICH I APOLOGIZE FOR THAT AND JUST TO SHARE OUR OUR WINNINGS WITH ALL OF YOU.

THIS PARTICULAR ITEM IS BEFORE YOU THIS EVENING REGARDING DIRECTION FROM COUNCIL ON AUGUST 2, 2021.

REGARDING THE COMMERCIAL SITE PLAN PROCESS.

SO THE ITEM THAT'S BEFORE YOU BASICALLY WILL PROVIDE AN APPROVED AND HOPEFULLY A SMOOTHER PROCESS REGARDING OUR COMMERCIAL SITE PLANS.

I WOULD ALSO LIKE TO NOTE THAT STAFF HAS RECEIVED SOME INPUT FROM DEVELOPERS REGARDING THIS PARTICULAR ITEM, AND THEY ARE HAPPY ABOUT THIS PARTICULAR ITEM THAT'S BEFORE YOU.

SO THERE'S ZONING CODE AMENDMENT, AS I NOTED, IS SPECIFICALLY REGARDING THE COMMERCIAL SITE PLAN PROCESS.

CURRENTLY, COMMERCIAL SITE PLANS GO BEFORE PLANNING AND ZONING COMMISSION AS WELL AS THIS COUNCIL AND THE AMENDMENT THAT WE'RE PROPOSING FOR YOU TODAY WOULD ALLOW FOR COMMERCIAL SITE PLANS WITH NO WAIVERS OR VARIANCES TO BE HANDLED ADMINISTRATIVELY AT A STAFF LEVEL.

WE PUT TOGETHER SOME INFORMATION FOR YOU THAT IDENTIFIES SOME PREVIOUS PROJECTS THAT HAVE COME BEFORE YOU WITH VARIOUS WAIVERS AND ZONING AND ALSO A LISTING OF ITEMS THAT WOULD BE ALLOWED OUTRIGHT THAT WOULD BE ABLE TO BE APPROVED AT THE STAFF LEVEL AND THAT WOULD BE ALLSTAR PROPERTIES PROJECT, AMERICAN NATIONAL BANK OF TEXAS, JOHN JONES RETAIL CENTER AND ALSO THE VALVOLINE OIL.

ALL THOSE COMMERCIAL SITE PLANTS HAD NO WAIVERS AND WOULD BE ABLE TO BE APPROVED AT THE DAC LEVEL.

NOW, AS I NOTED, THE ZONING CODE HAS NUMEROUS REFERENCES TO THE COMMERCIAL SITE PLAN, SO STAFF HAS REVIEWED THE ZONING CODE THOROUGHLY AND IDENTIFIED ALL OF THE AREAS IN WHICH COMMERCIAL SITE PLAN WAS IDENTIFIED.

IN MANY INSTANCES, IT IDENTIFIES JUST THE APPROVAL PROCESS GOING TO P&Z AND COUNCIL.

SO WE PROVIDED THOSE AMENDMENTS FOR YOU THIS EVENING, AND BASICALLY A MAJORITY OF IT IS JUST MAKING SURE THAT THE INFORMATION IS CONSISTENT FOR YOU.

SO THIS PARTICULAR ITEM WAS BEFORE PLANNING AND ZONING COMMISSION ON SEPTEMBER 14, 2021, THEY RECOMMENDED APPROVAL UNANIMOUSLY.

THERE WAS DISCUSSION REGARDING MASONRY WAIVERS, AND THAT'LL BE AN ITEM THAT WE'LL BRING BACK BEFORE YOU WITHIN THE NEXT COUPLE OF MONTHS TO DISCUSS THAT IN DETAIL REGARDING DIRECTION FROM COUNCIL.

BUT ALSO THERE WAS DISCUSSION REGARDING ZONING IN SUP CASES, SPECIFICALLY THE VOLKSWAGEN ITEM THAT WAS BEFORE YOU RECENTLY HAD A COMMERCIAL SITE PLAN AND ALSO A SUP REQUIREMENT.

AND IN THAT INSTANCE, THOSE PARTICULAR PROJECTS WOULD STILL COME BEFORE YOU AS WELL AS PLANNING AND ZONING COMMISSION.

BUT ONCE WE TYPICALLY COMPLETE THAT PROCESS, THEN WE'RE REQUIRED TO PROVIDE THE ITEM ON PLANNING AND ZONING COMMISSION AGENDA AS WELL AS COUNCIL, SO IT CAN SAVE A COUPLE OF WEEKS TO EVEN A COUPLE OF MONTHS ON A PROJECT.

SO THERE WILL BE SAVINGS FOR THE DEVELOPER.

IS THERE WITHIN YOUR DEPARTMENT AND I'M FOR THIS, BUT WITHIN YOUR DEPARTMENT IS THERE LIKE A CHECK AND BALANCE OF EACH OTHER THAT YOU ALL GO THROUGH? YES, SIR. YES, MAYOR.

WE HAVE A DAC PROCESS THAT'S VERY SPECIFIC.

WE HAVE REPRESENTATIVE OF CITY DEPARTMENTS, WHETHER IT'S PARKS, DEVELOPMENT SERVICES, ENGINEERING, PUBLIC WORKS, NEIGHBORHOOD SERVICES, FIRE DEPARTMENT ARE ALL INCLUDED.

ECONOMIC DEVELOPMENT ARE INCLUDED IN OUR DAC PROCESS.

SO THE REVIEW OF THE PROJECT WILL STILL BE THE SAME AS FAR AS THE REVIEW PERIOD AT A STAFF LEVEL. SO WE HAVE A PRETTY THOROUGH PROCESS ALREADY.

OK. GOOD EVENING, MAYOR AND COUNCIL, MY NAME IS MICHELLE MCCULLOUGH, ASSISTANT DIRECTOR OF PUBLIC WORKS OVER DEVELOPMENT AND AS CITY SECRETARY SAID THIS IS AN ORDINANCE FOR A SCHOOL ZONE FOR THE REALM SCHOOL BISD.

SO MANY OF YOU KNOW. SO THEY RELOCATED REALM FROM JOHNSON AVENUE TO THIS LOCATION THAT USED TO BE THE VENUE 510 BUILDING.

IT IS AN EXISTING BUILDING THAT IS BEING MODIFIED OR WAS MODIFIED.

OUR WHAT THE INFORMATION THAT WE HAVE IS THAT BISD EXPECTS THREE HUNDRED AND FIFTY STUDENTS, BUT ULTIMATELY THEY WILL HAVE SIX HUNDRED STUDENTS AT THIS SITE THAT WILL RANGE FROM SIXTH GRADE TO 12TH GRADE.

THEY ARE USING TWO OF THE PARKING LOTS IN BLUE FOR THEIR PARKING AND PICKUP AND DROP OFF LOCATIONS. AND THEY HAVE.

I'VE BEEN TOLD THAT THEY'RE USING THREE BUSSES FOR DROP OFF AND PICKUP, AND AS FAR AS I KNOW, THEY HAVE NOT INCREASED THAT.

THAT'S WHAT THEY EXPECTED TO USE.

SO SCHOOL ZONES ARE TYPICALLY BETWEEN 15 AND 20 FIVE MILES AN HOUR IN URBAN RESIDENTIAL AREAS. THEY DO.

THEY'RE THERE TO HELP PROTECT CHILDREN TO AND FROM SCHOOLS, AND IT ALSO HELPS REDUCE THE RISK AND SEVERITY OF THE POTENTIAL ACCIDENTS.

BISD DID HAVE A TRAFFIC ENGINEER THAT PERFORMED A TRAFFIC IMPACT ANALYSIS.

THEY ALSO PROVIDED A TRAFFIC MANAGEMENT PLAN AND A SCHOOL ZONE SIGN PLAN.

SO YOU CAN SEE THIS IS MARKET STREET AND 174 IS UP HERE IN THIS CORNER WHERE MY MOUSE IS.

AND SO THEIR TRAFFIC ENGINEER DID RECOMMEND SCHOOL ZONE SIGNS AT THE BEGINNING OF MARKET AND BEFORE BOND STREET, BOND STREET'S OVER HERE.

SO WHAT THEY ALSO RECOMMENDED THAT WE OBSERVE IT FOR SEVERAL WEEKS AND SEE WHAT THE PATTERNS FOR THE PEDESTRIANS WERE AS WELL AS THE VEHICLES.

AND SO THAT PLAN WAS REEVALUATED AND MODIFICATIONS WERE RECOMMENDED.

SO AS YOU SEE IN BLUE, THIS IS THE SCHOOL ZONE THAT IS BEING RECOMMENDED NOW, SO APPROXIMATELY 50 FEET FROM 174 ON MARKET STREET TO I THINK THAT'S TWO HUNDRED FEET FROM BOND STREET. AND THEN WE DID OBSERVE PEDESTRIANS ALSO WALKING DOWN BOND STREET.

SO WE DID INCLUDE A PORTION OF BOND STREET IN THE SCHOOL ZONE.

SPEED LIMIT ON RESIDENTIAL ROADWAYS OR URBAN ROADWAYS ARE 30 MILES AN HOUR, AND MANY OF OUR SCHOOL ZONES ARE POSTED RIGHT NOW AT 20 MILES AN HOUR, SO WE KEPT IT AT 20.

IT IS GOING TO BE FROM FORTY FIVE MINUTES BEFORE SCHOOL TO 15 MINUTES AFTER SCHOOL, AND THEN ALSO 15 MINUTES TO FORTY FIVE MINUTES AFTER SCHOOL TIME.

AND DO YOU WANT ME TO READ THE ENTIRE? NO. OK, SO.

JUST KIND OF GO OVER THE POLICY AND FEE HISTORY.

IT WAS BACK IN NOVEMBER OF 19 THAT WE HAD THE INITIAL WORK SESSION WITH CITY COUNCIL TO LOOK AT PLAZA RESERVATION FEES AND POLICY, MARCH OF 2020 IN THE ORIGINAL POLICY AND FEE THAT WE HAVE IN PLACE TODAY WITH THE FEE WAS APPROVED IN 2020 OF MARCH.

FEBRUARY OF 19 OR FEBRUARY 19TH OF 21.

WE HAD THE FIRST READING OF THE FEE SCHEDULE AMENDMENT BECAUSE I FORGOT TO PUT IT IN THE MARCH AGENDA PACKET AS WELL, SO BROUGHT IT BACK IN FEBRUARY.

THAT GOT TABLED, BACK IN MARCH EARLIER THIS YEAR THAT AMENDING PRICING OPTIONS POLICY WAS APPROVED BY COUNCIL, CITY COUNCIL APPROVED ADDING THE HALF DAY RENTAL.

THEN IN APRIL, WE HAD THE FIRST READING OF THAT FEE AMENDMENT.

THE SECOND READING OF THAT FEE AMENDMENT FAILED, SO WE HAD TO BRING IT BACK IN MAY EARLIER THIS YEAR IN 21 FOR THE FIRST AND SECOND READING, AS YOU SEE THERE.

SO THERE'S BEEN SOME HISTORY ON THE PLAZA FEE.

PAST DIRECTION IN MAY.

EARLIER THIS [INAUDIBLE] THIS YEAR, COUNCIL DID APPROVE THE AMENDMENT TO THE CITY'S FEE SCHEDULE TO INCLUDE, YOU KNOW, SEPARATING OUT FULL DAY TO HALF DAY.

DURING MULTIPLE PUBLIC MEETINGS RESERVATION COSTS FOR NONPROFIT ORGANIZATIONS HAVE BEEN MENTIONED AS A TOPIC AMONG INQUIRING CITIZENS AND COUNCIL MEMBERS.

COUNCIL GAVE DIRECTION TO STAFF TO OPERATE THE PLAZA WITH THE CURRENT POLICY FEES AND BRING AN UPDATE WITH PROPOSED AMENDMENTS TO COUNCIL AT A LATER DATE.

SO CURRENT POLICY AS OF MAY OF 21 JUST KIND OF SOME BULLET POINT ITEMS, NO MORE THAN ONE PRIVATE EVENT PER MONTH WITH A MAXIMUM OF SIX PRIVATE EVENTS PER YEAR.

CHILDREN'S PLAY AREA AND THE PAVILIONS PICNIC TABLES MAY NOT BE RESERVED INDEPENDENTLY.

THE PLAZA PROMENADE SHALL REMAIN OPEN TO PEDESTRIAN TRAFFIC AT ALL TIMES AND MAY BE INCLUDED AND MAY NOT BE INCLUDED IN THE PERIMETER FENCING FOR EVENTS.

BTX BREWFEST WE DID GIVE AN EXCEPTION TO THEM BECAUSE THERE'S NO BUILDINGS OVER THERE YET. SO FOR THAT EVENT THIS YEAR WE ALLOWED THEM TO.

THE PROMENADE WAS KIND OF FENCED OFF, BUT THE SIDEWALK WAS OPEN ON THAT FAR SIDE AND

A HUNDRED AND FIFTY THOUSAND PLUS THAT WAS MADE FOR THE PLAZA.

ANY DAMAGES AND OR NORMAL WEAR AND TEAR ON THE PROPERTY SHOULD BE CONSIDERED WITH RESERVATION COSTS AND DEPOSITS.

IN ACCORDANCE WITH THE CURRENT POLICY.

PLAZA RESERVATIONS ARE LIMITED TO SIX PER YEAR FOR THE PRIVATE.

STAFF CAN YOU KNOW THERE'S FOUR EVENTS THAT WE KNOW THAT ARE GOING TO HAPPEN EVERY YEAR THROUGH THE ANNUALLY THROUGH THE CALENDAR.

CITY PARTICIPATION SPONSORSHIP OPPORTUNITY HAS BEEN SET THROUGH THE HOTEL MOTEL TAX GUIDELINES. IF AN ORGANIZATION DOES NOT MEET THOSE GUIDELINES.

THEY'RE NOT INELIGIBLE FOR THE GRANT.

SO JUST KIND OF SOME POLICY AMENDMENT OPTIONS AND KIND OF GET SOME DIRECTION FROM COUNCIL. LEAVE THE POLICY AS IS, AMEND THE POLICY SO THAT PRIVATE EVENTS HOSTED IN THE PLAZA ARE LIMITED TO JUST THE HOT/MOT GRANT RECIPIENTS AND CITY ORGANIZED EVENTS.

WE COULD AMEND THE FEE SCHEDULE TO ALLOW NONPROFIT ORGANIZATIONS TO RECEIVE THE REDUCED RESERVATION COSTS.

JUST KIND OF OUR PROPOSAL PUT IN THERE, NONPROFIT ORGANIZATIONS.

THE HALF DAY WOULD BE REDUCED TO A THOUSAND DOLLARS PLUS A FIVE HUNDRED DOLLAR REFUNDABLE DEPOSIT OR A FULL DAY TWO THOUSAND FIVE HUNDRED DOLLARS, PLUS THE THOUSAND DOLLAR REFUNDABLE DEPOSIT.

AND IF YOU'RE GOING TO MAKE IT OPEN FOR ANY OF THOSE, YOU'VE GOT TO MAKE IT OPEN FOR ALL OF THEM. I THINK, THOUGH, THAT ANY EVENT OR ORGANIZER THAT THE COUNCIL WOULD APPROVE DISCRETIONARY FUNDS FOR HOT/MOT WOULD FIT.

I'M STILL NOT IN FAVOR OF ALLOWING NONPROFITS TO HAVE A REDUCED RATE OR EVEN TO USE IT.

IT'S JUST IF WE JUST STICK TO THE THE GRANT APPLICATIONS WE KNOW THOSE ARE, THEY ARE VETTED AND WE WE CONSIDER THE IMPACT THAT IT WILL BE ON OUR COMMUNITY AS A WHOLE.

I REALLY THIS IS COMMUNITY SPACE AND IT'S OUR COMMUNITY'S LIVING ROOM AND THE I TRULY BELIEVE IT'S ITS PURPOSE WAS SO THAT EVERYONE COULD GATHER FREELY AND ENJOY THE SPACE.

AND THERE ARE SO MANY DIFFERENT OPPORTUNITIES FOR TAKING ADVANTAGE OF IT AND YOU DON'T HAVE TO RESERVE IT. YOU CAN JUST SHOW UP WITH YOUR PICNIC OR PLAY GAMES WITH YOUR KIDS.

I THINK THAT THERE'S A LOT OF OPPORTUNITY EVEN WITHIN THE CITIES, WHETHER THE CITY'S ORGANIZING OR ALLOWING FOR PROFESSIONALLY MANAGED OPPORTUNITIES THAT WOULD BRING BUSINESS TO OLD TOWN DURING THE WEEK.

I THINK THAT THERE'S STILL SO MUCH THIS SPACE IS STILL NEW TO US, AND I REALLY DON'T WANT

I DON'T BELIEVE ON ON EVENTS THAT CAN THAT CAN COME BEFORE COUNCIL AND RECEIVE SPECIAL EXEMPTIONS OR EXCEPTIONS TO TO HAVE THE SPACE.

MOST OF OUR EVENTS ARE HOSTED BY LOCAL ORGANIZATIONS, WHETHER THEY'RE FOR PROFIT OR NONPROFIT. THE MAJORITY OF OUR HOTEL MOTEL PEOPLE, BY THE WAY, THE PEOPLE THAT WE GAVE MONEY TO, THE MAJORITY OF THEM ARE ACTUALLY FOR PROFIT BUSINESSES THAT WE'RE GIVING MONEY TO FOR PROFIT.

OK, SO WE ARE WILLING TO GIVE AWAY MONEY TO FOR PROFIT INDUSTRIES AND THEN LIMIT WHAT PEOPLE CAN USE THE CITY'S LIVING ROOM FOR.

AND LET'S BE HONEST WITH YOU, WE ALREADY HAVE LIMITATIONS ON THIS.

IT CAN ONLY BE USED SIX TIMES A MONTH.

PREFERENCE GOES TO HOTEL MOTEL EVENTS, SO WE'RE POSSIBLY LOOKING AT TWO TO THREE EVENTS AN ENTIRE YEAR.
