C. Community Interest Items This is a standing item on the agenda of every regular meeting of the City Council. (The Texas Open Meetings Act effective September 1, 2009, provides that "a quorum of the city council may receive from municipal staff, and a member of the governing body may make, a report regarding items of community interest during a council meeting without having given notice of the subject of the report, provided no action is taken or discussed." The Open Meetings Act does not allow Council to discuss an item concerning pending City Council business unless it is specifically, appropriately posted on the agenda). An "item of community interest" includes the following: expressions of thanks, congratulations, or condolence; information regarding holiday schedules; honorary recognitions of city officials, employees, or other citizens; reminders about upcoming events sponsored by the city or other entity that is scheduled to be attended by city official or city employee; and announcements involving imminent public health and safety threats to the city.

D. Changes to the City Council Agenda At times the agenda order may be changed to better serve the public. This includes request for items to be withdrawn or moved to another meeting.

3. CITIZEN APPEARANCES Other than public hearings, citizens in attendance who desire to speak to City Council may speak during this section. Each person will be allowed three (3) minutes to speak and will not be interrupted by City Council or staff. If you would like to speak, please fill out a speaker card and give the completed card to the City Secretary prior to addressing City Council. Please note that City Council may only take action on items posted on the agenda. The Texas Open Meetings Act prohibits the City Council from deliberating or taking action on an item not listed on the agenda. City Council may, however, receive your comments on the unlisted item, ask clarifying questions, respond with facts, and explain policy.

4. CONSENT AGENDA All items listed below are considered to be routine by the City Council and will be enacted with one motion. There will be no separate discussion of the items unless a Councilmember or citizen so requests, in which event the item will be removed from the consent agenda and considered in its normal sequence. Approval of the consent agenda authorizes the City Manager to implement each item in accordance with staff recommendations.

B. Consider approval of a minute order for a final plat of residential Lots 3 and 4, Block 1, Garza Addition, located northeast of the intersection of Linda Drive and White Marlin Road. (Case 19-125) (Staff Contact: Mandy Clark, Development Services Director) (The Planning and Zoning Commission recommended approval by unanimous vote.)

C. Consider approval of a minute order adopting a list of preferred consultants for engineering and architectural services to be used through Fiscal Year 2024-2025. (Staff Contact: Aaron Russell, Director of Public Works)

D. Consider approval of an ordinance amending Chapter 34, "Environment," of the Code Of Ordinances by repealing Article IX, "Public and Semipublic Pools and Spas," in its entirety and adopting a new Article IX, "Public and Semipublic and Spas, Public Interactive Water Features and Fountains," to update the ordinance regarding the construction, operation and maintenance of public and semipublic pools and spas, and make the ordinance applicable to public interactive water features and fountains, to be consistent with the most recent state laws; and current with State law for pool yard enclosures; to include language for additional signage for drowning prevention; and establishing the City of Burleson as the Regulatory Authority for the Inspection and Permitting of Public and Semipublic Pools and Spas, Public Interactive Water Features and Fountains in the City; providing that this ordinance shall be cumulative of all ordinances; providing a severability clause; providing a savings clause; providing for a penalty for violations hereof; providing for publication in the official newspaper; providing an effective date. E. Consider approval of an ordinance amending Chapter 14, "Businesses," of the Code of Ordinances by repealing Article V, "Food and Food Establishments," in its entirety and adopting a new Article V, "Food and Food Establishments," regulating food establishments, including food services establishments, retail food stores, temporary food establishments, mobile food units, and roadside vendors; adopting by reference the provisions of the current rules or rules as amending, 25 Texas Administrative Code, Chapter 228, also known as the Texas Food Establishment Rules; and establishing the City of Burleson as the regulatory authority for the inspection and permitting of food establishments in the City of Burleson; providing that the ordinance shall be cumulative of all ordinances; providing a severability clause; providing for a penalty for violations hereof; providing for publication in the official newspaper; providing an effective date. A. The Parks at Panchasarp Farms located on Lakewood Drive east of SH 174 (Case 19-038): Hold a public hearing and consider approval of an ordinance amending ordinance B-582, the Zoning Ordinance of the City of Burleson, Texas, by repealing and replacing ordinance CSO#560-01-2017 for approximately 220.887 acres of land situated in the H.G. Catlett Survey, Abstract No. 178 and the H.G. Catlett Survey, Abstract No. 179, City of Burleson, Johnson County, Texas, and amending the official zoning map, making this ordinance cumulative or prior ordinances; providing a severability clause; providing for the violation of this ordinance; providing a penalty clause; and providing an effective date. C. Shipman Properties Office and Retail Building located at 225 W. Ellison Street (Case 19-098): Consider approval of a minute order for a site plan and associated waivers for an office and retail building within Burleson’s Old Town. (Staff Presenter: Jennifer Pruitt, Assistant Development Services Director) (The Planning and Zoning Commission recommended approval by a unanimous vote.)

D. Caliber Collision Commercial Site Plan located at 320 and 340 SE John Jones Drive (Case 19-117): Consider approval of a minute order for a site plan for a collision repair facility. (Staff Presenter: Mandy Clark, Development Services Director) (The Planning and Zoning Commission recommended approval by 5-1 vote.)

6. GENERAL

A. Consider approval of a minute order for a one year extension of an existing contract for the purchases of Janitorial Services from Members Building Maintenance, LLC in the amount not to exceed $131,122.77. (Staff Presenter: Aaron Russell, Public Works Director)

B. Consider approval of an ordinance amending the city budget for fiscal year 2019-2020 by increasing appropriations in the cemetery landscaping project fund in the amount of $20,000 for the purpose of funding a cemetery expansion plan; by increasing appropriations in the court technology special revenue fund in the amount of $55,000 for the purpose of funding court software; incorporating the recitals into the body of the ordinance; finding that this ordinance may be considered and approved at only one meeting; finding that the meeting at which this ordinance is passed is open to the public; and, providing for a repealer clause, a severability clause, and an effective date.
