SO THE FIRST PROCLAMATION IS RECOGNIZING APRIL AS CHILD ABUSE PREVENTION MONTH.

THE RECIPIENTS HERE ARE MADELYN MASHBURN, ALLIANCE FOR CHILDREN, AND TAMMY KING, EXECUTIVE DIRECTOR OF CHILDREN'S ADVOCACY CENTER OF JOHNSON COUNTY, MAYOR FLETCHER.

NOW THEREFORE, I MAYOR CHRIS FLETCHER ON BEHALF OF THE CITIZENS OF BURLESON AND THE ENTIRE COUNCIL, HEREBY PROCLAIM APRIL 2022 AS NATIONAL CHILD ABUSE PREVENTION MONTH IN THE CITY OF BURLESON. WE'RE GOING TO HOLD OFF ON EVERYBODY.

WE GOT TWO PROCLAMATIONS AND WE'LL COME DOWN HERE IN JUST A MINUTE, IF THAT'S OKAY.

I'LL ANNOUNCE THE SECOND PROCLAMATION.

IT'S A PROCLAMATION RECOGNIZING APRIL 3RD THROUGH APRIL 9TH, 2022, AS NATIONAL LIBRARY WEEK. THE RECIPIENT IS SARA MILLER, DEPUTY LIBRARY DIRECTOR AND I BELIEVE SHE HAS OTHER PEOPLE WITH HER. NOW THEREFORE, I MAYOR CHRIS FLETCHER ON BEHALF OF THE CITIZENS OF BURLESON AND THE ENTIRE CITY COUNCIL, HEREBY PROCLAIM APRIL 3RD THROUGH THE 9TH OF 2022 AS NATIONAL LIBRARY WEEK IN THE CITY OF BURLESON.

CITY COUNCIL DO YOU HAVE ANY COMMUNITY INTEREST ITEMS? ALL RIGHTY. I'D LIKE TO SAY JUST A WORD ABOUT [INAUDIBLE].

HE WAS PROBABLY ONE OF THE FUNNIEST, GREATEST EDUCATORS THAT I'VE EVER BEEN AROUND IN MY LIFE, AND I'VE BEEN A LOT OF THEM, BEEN AROUND ON MY SHIP.

[INAUDIBLE] WAS JUST ONE OF A KIND.

IF THERE EVER WAS A GOOD FUNERAL I ATTENDED A GOOD FUNERAL WITH [INAUDIBLE].

WOULD HAVE HAD IT NO OTHER WAY.

WE HAD HIS FAVORITE SINGER WAS ELVIS, AND THEY HAD HIS FAVORITE IMPERSONATOR THERE.

AND IT WAS FANTASTIC.

IT REALLY WAS.

AND I WAS I WILL TELL YOU, I THINK HIS GREATEST ATTRIBUTE WAS HE WAS A FAMILY MAN.

I DON'T THINK YOU CAN SAY BETTER THAN THAT.

BUT EDUCATION WISE, HE WAS FIRST CLASS, FIRST CLASS.

SO I THINK HE DESERVED A WORD ABOUT HIM AT OUR COUNCIL MEETING.

ABSOLUTELY. I HAVE A COUPLE OF THINGS IN CASE ANYONE, ANYONE WAS WONDERING WHY THE STREETS OF BURLESON WERE DESERTED ON SATURDAY MORNING, IT'S BECAUSE THE ENTIRE POPULATION WAS AT THE FARMERS MARKET.

THE OPENING EVENT WAS, I THINK, WELL PAST WHAT YOU'D CALL WELL ATTENDED.

IT WAS JUST ABSOLUTELY A ZOO.

A LOT OF THE VENDORS SOLD OUT EARLY AND WE WERE AFFIRMED THAT WHAT A GREAT EVENT THIS IS AND WHAT A WONDERFUL THING TO HAVE.

THE SECOND THING ON MY LIST OF ITEMS IS APRIL SEEMS TO BE THE MONTH FOR BEING, THE MONTH FOR SOMETHING. AND ANOTHER THING THAT APRIL IS THE MONTH FOR IS AUTISM AWARENESS.

AS A FATHER OF AN AUTISTIC SON, I'M AS AWARE OF AUTISM AS I WISH I WERE OR EVER WOULD HAVE WISHED TO BE. BUT I WANT TO READ FOR YOU SOME WORDS THAT MY WIFE COMPOSED SOMETIME BACK WHEN OUR SON WAS YOUNG.

AND IT GOES LIKE THIS.

I'D LIKE TO ASK YOU, IN HONOR OF AUSTIN'S STRUGGLES, AS WELL AS THOSE OF HIS FRIENDS, THAT IF YOU KNOW SOMEONE WITH AUTISM, CONSIDER LENDING A HAND TO THE FAMILY.

YOU CAN'T IMAGINE HOW MUCH THEY NEED YOUR LOVE AND SUPPORT, ESPECIALLY THE SIBLINGS.

PRAY FOR THEM, MAKE ROOM FOR THEM IN CHURCHES AND OTHER COMMUNITY EVENTS, SPEAK TO THEM ON THEIR AGE LEVEL LIKE THEY UNDERSTAND, BECAUSE THEY PROBABLY DO.

REALIZE THAT MANY ARE HYPERSENSITIVE TO SOUNDS AND CAN HEAR YOUR WHISPERS.

RESPECT THEM, GIVE THE PARENTS A HUG.

THEY NEED IT MORE THAN THEY WILL EVER TELL YOU.

THIS IS AUTISM.

I CHOSE TO CELEBRATE THE BABY STEPS AND ACCOMPLISHMENTS, BUT I THINK IT'S IMPORTANT TO SHARE WHAT SO MANY ARE GOING THROUGH.

IT'S ALWAYS IMPORTANT TO TALK ABOUT OTHER THINGS THAT ARE IMPORTANT TO US AND OUR CITY AND OTHER CITIZENS AND WHAT WE GO THROUGH PERSONALLY.

SO I KNOW THAT IT'S NOT GOING TO CHANGE EVERYTHING, BUT I BELIEVE IN A LAYERED PROCESS TO MAKING CHANGE.

SO WHILE WE ARE GOING TO DO OUR BEST AS A CITY, I THINK IT'S REALLY IMPORTANT FOR US ALL AS CITIZENS TO GET INVOLVED AND TRY TO REMIND PEOPLE THAT WE WANT TO KEEP THE CITY OF BURLESON CLEAN AS WELL AS THE STATE.

TODAY ALSO MARKS THE ANNIVERSARY ON THIS DAY IN 1968, WE LOST A CIVIL RIGHTS ICON IN MARTIN LUTHER KING. SO I JUST WANT TO SHARE THAT AND THANK YOU.

I'M WEARING BLUE TODAY BECAUSE MY DAUGHTER'S SCHOOL SENT OUT A REQUEST FOR ALL THE STUDENTS TO WEAR BLUE TODAY.

WE RECOGNIZED LIBRARY WEEK AND THIS COMING SATURDAY THE LIBRARY BURLESON PUBLIC LIBRARY WILL CELEBRATE ITS 51ST BIRTHDAY.

SO FROM 1:00 TO 3:00 YOU CAN SWING BY THE LIBRARY.

I KNOW THAT THE FRIENDS OF THE LIBRARY HAVE BEEN HARD AT WORK AND MAKING FUN EVENTS AND PLANNING A REALLY COOL, FUN ACTIVITIES AND PLANNING FOR A REALLY COOL EVENT.

SO IF YOU HAVE TIME THAT AFTERNOON, SWING BY.

THERE'S ALSO SOME REALLY COOL EGG HUNTS THIS SATURDAY MORNING, SO THEY'RE SPACED OUT BY AGE GROUP. THERE'S I THINK ONE AGES FIVE AND UNDER WILL BE AT RUSSELL FARM IN THE MORNING. AND THEN THERE'S AN AQUA EGG HUNT AND THERE'S ANOTHER HUGE EGG HUNT WITH BOUNCE HOUSES AND ALL TYPES OF OTHER ACTIVITIES AT CHISHOLM FIELD.

SO FOR THE FAMILIES THAT ARE GOING TO BE IN THE AREA THIS WEEKEND, LOOK OUT FOR THOSE EVENTS. I THINK THEY'RE GOING TO BE SUPER FUN.

AND THEN THE FOLLOWING SATURDAY, THE 16TH, WE'RE HAVING THE RIBBON CUTTING FOR THE PUBLIC ART. AND I KNOW LAST MEETING, COUNCIL MEMBER STANFORD MENTIONED IT.

IT'S REALLY BEAUTIFUL, JUST COLORFUL AND BRIGHTENING.

AND I CAN'T WAIT TO BE A PART OF THAT EVENT.

SO IF YOU HAVE TIME NEXT SATURDAY MORNING, THE 16TH, THE RIBBON CUTTING WILL BE AT 10:00 AND WE'D LOVE TO SEE YOU OUT THERE.

WE HAVE A LOCAL NONPROFIT CALLED THE CENTER FOR ASD.

THESE ARE GOOD PEOPLE.

THE ISD HAS GROUPS AND WHEN YOU TALK ABOUT ASD SOMETIMES YOU THINK, WELL, IT'S SMALL KIDS, THEY HAVE PEOPLE OVER THERE THATS' IN THEIR FIFTIES AND THEY NEED HELP.

SO ANYBODY THAT WANTS TO MAKE A DIFFERENCE, THAT'S A GOOD PLACE TO ASK.

AND BURLESON IS AMAZING FOR OUR NONPROFITS.

I'M REALLY PROUD OF HOW THEY STEP UP AND AND DO WHAT THEY DO.

SO ON THAT, I WANT TO GO DOWN THE ROAD ON ONE OTHER THING.

I GUESS EVERYBODY REALIZES WE'VE GOT A BOND COMING UP.

AND I WANT TO REACH OUT TO OUR COMMUNICATIONS DEPARTMENT ON THE BROCHURE THAT THEY MADE AND HOW INFORMATIVE I WAS SPEAKING THE OTHER NIGHT.

I'M HERE TO SPEAK OUT A LITTLE BIT ABOUT THE APRIL BEING THE NATIONAL CHILD ABUSE PREVENTION MONTH. WE'RE TALKING ABOUT MENTAL, PHYSICAL, EMOTIONAL, SEXUAL AND NEGLECT OF ALL KINDS. IN TEXAS ALONE IN 2020, THERE WAS MORE KIDS THAT DIED FROM ABUSE THAN A TWO PREVIOUS YEARS, IT'S GROWING OUT OF CONTROL.

THERE'S AN AVERAGE OF 7 KIDS DYING FROM ABUSE ABOUT EVERY HOUR, 184 VICTIMS BETWEEN THE AGES OF ZERO AND 17 DAILY.

I'M A GENERAL CONTRACTOR AND I'M IN AND OUT OF HOUSES.

I GET I DO A LOT OF VOLUNTEER WORK.

THERE'S TIMES WHEN I'LL GET A CALL FROM A DOOR BEING KICKED IN.

I'LL GET THERE AND I'LL SEE THESE KIDS ARE SCARED, SCARED TO DEATH.

EVERY NOW AND THEN ONE WILL MENTION TO ME, YOU KNOW, DADDY OR SOMEBODY KICKED THE DOOR IN OR SOMETHING LIKE THAT, I'LL SEE A HOLE IN THE WALL.

I CAN RECOGNIZE A FIST HOLE.

I CAN RECOGNIZE THE SIZE OF A HEAD.

IT MAKES ME SICK.

I DON'T STAND THERE AND TAKE IT.

I COME HOME ONE DAY. CHANNEL FIVE NEWS THEY HAVE THE POLICE ON THERE.

HIS 13 YEAR OLD SON HAD BEEN CHAINED TO A BED.

THEY STARVED HIM. THEY NEGLECTED HIM.

THEY TORTURED HIM. THE BOY WEIGHED 55 POUNDS, MADE ME SICK.

I MEAN, EVERY DAY WHEN I HAD TO WALK IN AND WALK PAST HIS DESK, I MEAN, IT'S JUST ONE OF THE THINGS WHERE YOU JUST WANT TO CHUCK IT OUT THE WINDOW.

I MEAN HIS MOM WHEN I ASKED HIM.

HIS MOM. WHAT DID YOU SAY TO YOUR SON? SHE SAID, OH TELL HIM I LOVE HIM.

THAT WASN'T LOVE. TORTURE IS NOT LOVE.

TAKING FOOD FROM A KID IS NOT LOVE.

I MEAN, IT'S ONE THING WE AS A COMMUNITY, WE GOT TO WATCH OUT FOR THIS STUFF.

A LOT OF PEOPLE KNOW I GOT A SON.

I HAD ANOTHER SON THAT DIED IN 2001 FROM CANCER.

HIS HE DIED RIGHT AFTER HE TURNED FOUR.

WE ARE APPOINTING SOMEONE THAT HAS CAUSED ME TO GET SECURITY TO AND FROM COUNCIL MEETINGS FOR FEAR. WE ARE APPOINTING SOMEONE THAT HAS SAID HATEFUL BEYOND HATEFUL THINGS ABOUT INCREDIBLE AMOUNTS OF PEOPLE IN THE CITY AS WELL AS SITTING IN THIS ROOM.

AND I'M GOING TO SAY THAT I'M DISAPPOINTED AND I BELIEVE YOU AS CITIZENS SHOULD EXPECT MORE OF YOUR COUNCIL MEMBERS THAT YOU ELECTED.

SO JUST KIND OF GOING BACK IN TIME A LITTLE BIT, THE TIMELINE THE CITY PURCHASED THE SITE FROM FIRST UNITED METHODIST CHURCH TO HOUSE HILL COLLEGE BACK IN 2005.

IN 2020, THE CITY BISD AND HILL COLLEGE AGREED TO RENOVATE AND MOVE HILL COLLEGE OVER TO THE OLD KERR OLD HIGH SCHOOL AND JOHNSON STREET, WHICH IS CURRENTLY UNDER CONSTRUCTION IN JANUARY OF 21.

LAST YEAR, BURLESON EDC PURCHASED A SLOT FROM THE CITY WITH THE VISION TO REDEVELOP.

AND WE'RE HERE TODAY TO DISCUSS THE VISION OF THE RFP.

SO THIS IS KIND OF A CONCEPTUAL HIGH LEVEL VIEW ON THE RIGHT LOOKING OVERVIEW ALLOWED FOR THE REDEVELOPMENT TO ALLOW RETAIL, RESTAURANT AND OFFICE USE NO MORE THAN 32 FEET IN HEIGHT. WE GOT THAT 32 FEET IN HEIGHT BASICALLY FROM THE OTHER RFP THAT WE'VE ISSUED DOWN IN OLD TOWN. JUST TO KIND OF TAKE THAT SAME VERBIAGE, THAT SAME HEIGHT RESTRICTION, IT'S USUALLY DEPENDING ON THE LEVELS OF WHAT THEY HAVE IN THE FIRST FLOOR.

IT COULD BE IT'S USUALLY TWO, WITH ARCHITECTURAL STANDARDS.

IT COULD BE THREE DEPENDING ON THE HEIGHTS.

SO RFP KEY ELEMENTS WE'RE LOOKING AT POSSIBLY IF THE DIRECTIONS GOOD WITH COUNCIL IS TO RELEASE THIS RFP BY THE END OF THIS MONTH AND LET IT GO FOR 90 DAYS OUT INTO THE PUBLIC DEVELOPMENT PUBLIC FOR PROPOSALS KIND OF GET A PROPOSAL, PRE-PROPOSAL CONFERENCE DATE IN THERE AND THEN PROPOSALS DO THE END OF JULY OF THIS YEAR AND THEN LOOK TO DO INTERVIEWS AND THEN BRING IT BACK TO COUNCIL.

IF I HAD TO GUESS, PROBABLY THE OCTOBER TIME FRAME FOR YOU GUYS TO DECIDE ON WHICH WAY TO MOVE FORWARD. SO THE SUBMITTALS WILL INCLUDE PROJECT TEAM DESCRIPTION, THEIR SCHEDULE, PROJECT SKETCH, TEAM REFERENCES, INVESTMENT COSTS, TRANSACTION DETAILS AND ALL THE VARIOUS LEGAL FORMS THAT THEY HAVE TO SUBMIT.

SO EVALUATION CRITERIA, THESE THIS IS THE SAME TYPE OF CRITERIA THAT WE'VE USED ON THE OTHER RFPS AND WE PUT A SUBSTANTIAL POINT ON PROJECT VISION AND DEVELOPMENT SCENARIO AND JUST CAPTURING THE VISION OF OLD TOWN AND HOW THEY'RE GOING TO EXTEND THAT EXPERIENCE IS A BIG ONE FOR US AS WELL.

PROJECT COST AND BENEFIT AT 20 POINTS.

ACCESS TO CAPITAL AND THEN ANTICIPATED PROJECT TIMELINE.

DO YOU? I WAS LOOKING AT THE TIMELINE THING AND AND IS IT JUST ABOUT WHEN THEY THINK THEY CAN FINISH IT? IT'S NOT A SPECIFIC TIME FRAME THAT WE'RE SETTING THEM TO IN THE RFP? NOT IN THE RFP, BUT WE WANT THEM TO SUBMIT, YOU KNOW, HEY, ARE YOU GOING TO SUBMIT ON THIS? AND YOUR PROJECT IS, HEY, I'M NOT GOING TO START IT UNTIL 2025.

WE'VE DONE A GOOD JOB OF DOING THE PEDESTRIAN IMPROVEMENTS AND COUNCIL DIRECTING US ON THE WEST SIDE OF ELLISON HEADING TOWARDS JOHNSON AND ALL THOSE ARE UNDERWAY.

BUT LOOKING AT FROM THE RAILROAD TRACKS ALL THE WAY DOWN TO SCOTT STREET OF PUTTING IN THE SIDEWALKS, THE WALKABILITY, THE LIGHTING, THE LANDSCAPING, ALL OF THAT BACK TOWARDS THE FREEWAY THAT WAY IT'S ALL WE HAVE A GREAT CORRIDOR ACROSS THE OTHER SIDE OF THE TRACKS FOR THAT.

SO ON THAT OTHER SIDE, THERE'S LACK OF SIDEWALKS, THERE'S DRAINAGE CONCERNS.

WE STILL HAVE A LOT OF BAR DITCHES THAT WE WOULD END UP WE'D BE ABLE TO GET RID OF WITH NEW SIDEWALKS AND BEAUTIFY SOME MAJOR INTERSECTIONS ON THE OTHER SIDE.

WITH DOBSON, WITH CLARK, EVEN COMMERCE STREET HAVING THAT ABILITY TO DO THAT.

KIND OF LIKE WHAT WE'VE DONE WITH THE PARKING LOT AT THE OPD.

FINAL DESIGN PRODUCE ALL CONSTRUCTION DOCUMENTS FOR BIDDING AND THEN CONSTRUCTION ADMINISTRATION WOULD COORDINATE WITH GENERAL CONTRACTOR DURING THE CONSTRUCTION JUST FOR THE DESIGN PROJECT COST OF THAT CONTRACT $142,610.

SO IF THIS IS SOMETHING THAT YOU ALL WERE GOOD WITH MOVING FORWARD, WE'D BRING BACK THAT CONTRACT IN A FUTURE MEETING FOR APPROVAL TO GET THE DESIGN MOVING FORWARD.

SO JUST THROWING IT OUT THERE NOW AS AN IDEA, WE MIGHT BE LOOKING AT A COMPLETE STREET REDESIGN INSTEAD OF JUST TRYING TO ADD TRAILS AND STUFF.

WE'LL LOOK AT THAT DRAINAGE AS A PART OF THE SCOPE, ALONG WITH SOME OF THE LANDINGS AND EVERYTHING AT THOSE INTERSECTIONS.

IN 2012, AS YOU MIGHT RECALL, FROM [INAUDIBLE] PRESENTATION, THE CITY CREATED TIFF DISTRICT NUMBER THREE.

AND THEN WE HAD SOME ACTIVITY WITH THE COX MOBILITY 2040 LINE WHERE THEY REMOVED THE W4 LINE AND THEN RE-INCLUDED IT A COUPLE OF YEARS LATER.

NOW, DURING THE COURSE OF THOSE TWO YEARS BETWEEN 2016 AND 2018, THERE WAS SOME ACTIVITY THAT OCCURRED WITH SOME OF THE PROPERTIES WITHIN THE TOD AND THAT THEY CAME TO COUNCIL WITH INDIVIDUALIZED ZONING AND ESSENTIALLY ZONED THEMSELVES OUT OF THE THE LARGER PLANT DEVELOPMENT STANDARDS.

SO THAT WOULD BE SHANNON CREEK AND [INAUDIBLE].

SO WHAT ARE SOME OF THE CHALLENGES THAT WE THINK ARE ASSOCIATED WITH THE W4 LINE? WELL, WE KNOW THAT IT REQUIRES AN ADDITIONAL RAIL TO SUPPORT THE COMMUTER SYSTEM.

WE KNOW THAT THE CONSTRUCTION COSTS WE'RE ESTIMATING TO BE IN EXCESS OF $1.7 BILLION.

THERE'S NO REGIONAL FUNDING IDENTIFIED NOR ANY FORESEEABLE FUNDING IN THE FUTURE FOR THIS PROJECT.

ESTIMATED RIDERSHIP IS LESS THAN 1,000 INDIVIDUALS PER DAY, AND THAT'S LOW.

THAT LEADS TO ESSENTIALLY LOW REGIONAL PRIORITIZATION.

ONE OF THE INTERESTING THINGS IS THAT BNSF WOULD REQUIRE SOME DEGREE OF LIABILITY PROTECTION AGAINST ANY RAIL OPERATOR.

SO WHAT THEY'RE LOOKING AT IS SOME DEGREE OF INDEMNIFICATION.

THERE'S NO LEGISLATION THAT WE'RE AWARE OF THAT WOULD INDEMNIFY BNSF FOR THE USE OF THEIR RAIL LINE. SO THAT'S A BIG ISSUE FOR THEM.

THEY DON'T WANT TO BE HELD LIABLE FOR ANY ACTIVITY THAT WILL OCCUR ON THEIR LINE.

MOVING ON IN THE PRESENTATION, ONE OF THE THINGS THAT WE TAKE NOTE OF WITH THE CHALLENGES ASSOCIATED WITH THE W4 RAIL LINE IS THAT IF THERE IS NO RAIL, DO WE REALLY HAVE THE NEED FOR THE DENSITIES THAT ARE CURRENTLY ALLOWED WITHIN THE TOD.

WITH THE DOWN ZONING OF 141 ACRES, THAT DID MITIGATE SOME OF THE DENSITIES AND THAT IT DECREASED THEM WITH SOME OF THESE SUBSEQUENT ZONING ACTIVITY THAT THE COUNCIL APPROVED.

WHAT WE HAVE LEFT IS A MINIMUM OF UP TO A MINIMUM EXCUSE ME, OF 4,052 RESIDENTIAL UNITS AND THEN IN EXCESS OF 5,712 IF YOU BUILT IN ACCORDANCE WITH THE EXISTING PLANT DEVELOPMENT REGULATIONS. SO THAT'S A VERY DENSE PROJECT WHEN YOU CONSIDER WHAT IS STILL ALLOWED, EVEN WITH THE DOWN ZONING OF 141 ACRES.

WHAT WE HAVE IN YELLOW AND THE [INAUDIBLE].

BUT IN YELLOW IS THE TOD DISTRICT AS IT WAS CONSTITUTED AND IN GREEN IS WHAT REMAINS FROM THE ORIGINAL PLANT DEVELOPMENT ZONING.

SO EVERYTHING THAT YOU DON'T SEE, EVERY PLACE THAT IS NO LONGER SHROUDED IN GREEN IS SOMETHING A PROPERTY, RATHER, THAT HAS BEEN DOWN ZONED OR ZONED OUT OF THE EXISTING PLANT DEVELOPMENT. SO JUST SAY THIS AGAIN WHERE IT MAKES A LITTLE BIT MORE SENSE.

EVERYTHING IN GREEN IS STILL ALLOWED UNDER THE CURRENT PLANT DEVELOPMENT ZONING REGULATIONS OF THE EXISTING TOD.

WE'VE IDENTIFIED SOME OF THE PROPERTIES THAT HAVE DOWN ZONED OUT OF THE TOD.

THAT WOULD BE THE VILLAGES OF WAKEFIELD, SHANNON CREEK [INAUDIBLE], BUT STILL A VAST AMOUNT OF AREA THAT IS STILL CONTAINED WITHIN THE TRANSIT ORIENTED DISTRICT.

ONE OF THE THINGS THAT STAFF CHALLENGED ITSELF WITH DOING WAS LOOKING AT OPTIONS THAT COULD BE CONSIDERED IF THE COUNCIL WERE TO ENTERTAIN MITIGATING SOME OF THE DENSITY IN THE TOD. TWO OF THOSE OPTIONS ARE A MODIFICATION OF THE EXISTING PLANT DEVELOPMENT, ZONING REGULATIONS OR IMPLEMENTATION OF A ZONING OVERLAY.

THAT IS, YOU ESSENTIALLY TAKE A DIFFERENT SET OF STANDARDS AND LAY THEM OVER, ESSENTIALLY OVERLAY OVER THE EXISTING STANDARDS.

SO IT'S IMPORTANT TO POINT OUT THAT THESE ARE NOT MUTUALLY EXCLUSIVE OPTIONS, MEANING THAT IF THE COUNCIL WAS SO INCLINED, YOU COULD DO SOME COMBINATION OF BOTH OF THESE AS A WAY TO GET AT A LESS DENSE PROJECT IN THIS AREA.

WITH REGARD TO THE ZONING MODIFICATION OPTION.

THIS WOULD BE CITY INITIATED EXCUSE ME, CITY INITIATED.

WITH REGARD TO OUR OUTREACH TO THE PROPERTY OWNERS.

IT WOULD BE A PARCEL BY PARCEL APPROACH.

SO INDIVIDUAL PROPERTY OWNERS HAVE THEIR OWN OPINIONS AS FAR AS WHAT THEY THINK IS HIGHEST AND BEST USE FOR THEIR PROPERTY.

WE WOULD ENGAGE WITH ALL OF THOSE INDIVIDUALS AND SEE IF WE COULD FIND SOME UNIFYING VISION THAT WOULD ALLOW SOME FLEXIBILITY IN TERMS OF HOW TO USE THE PROPERTY.

THIS IS VOLUNTARY.

SO IF WE WERE TO MAKE AN APPEAL TO A PROPERTY OWNER TO CHANGE THEIR ZONING, IF THERE WAS NO INTEREST, WE WOULDN'T CHANGE IT.

IT WOULD JUST BE A VOLUNTARY PROCESS.

THESE OWNERS ARE ALREADY ENTITLED TO THE DENSITIES WITHIN THE TOD, SO THERE'S NOT A MECHANISM THERE WHERE WE COULD GET AROUND THAT IS VESTING AS FAR AS THE DENSITY FOR THESE PROPERTY OWNERS. AND WE WOULD HAVE TO BE FLEXIBLE BECAUSE AS WE APPROACH INDIVIDUAL PEOPLE, THEY MIGHT HAVE VERY DISPARATE AND WIDE RANGING OPINIONS AS TO WHAT THEY WOULD LIKE TO SEE THEIR PROPERTY USE FOR.

CONTINUING ON A NEGOTIATED GIVE AND TAKE PROCESS.

AND WHAT I MEAN BY THAT IS IN LINE WITH THAT FLEXIBILITY, THERE MAY BE SOME LAND USES THAT THEY MIGHT WANT TO SEE INCLUDED THAT WE HADN'T THOUGHT OF.

AND WHAT WE'D HAVE TO DO IS LOOK TO SEE IF WE CAN REACH SOME COMMON GROUND WITH REGARD TO GETTING TO YES IN THOSE SITUATIONS.

SO WHAT WOULD A PROPERTY WANT IN EXCHANGE FOR A VOLUNTARY CHANGE IN ZONING? SO SOME OF THE OPTIONS AND SOME OF THE EXAMPLES THAT WE'VE LISTED THERE ARE INCREASED FLEXIBILITY FOR HOME BASED BUSINESSES WITH COVID A NUMBER OF INDIVIDUALS WHO ARE NOW WORKING ALMOST EXCLUSIVELY OUT OF THE HOME PLACE.

AND OUR CODE COULD BE UPDATED TO ALLOW A MORE FLEXIBLE APPROACH TO THIS TYPE OF WORK ENVIRONMENT. INCORPORATION OF ADDITIONAL LAND USES.

OUR REDUCTION IN CERTAIN STANDARDS.

FOR INSTANCE, A REDUCTION IN MAXIMUM LOCK COVERAGE FOR ANY NON SINGLE FAMILY RESIDENTIAL PROPERTY, INCLUDING LANGUAGE THAT ONLY ALLOWS OWNER OCCUPIED TOWNHOMES AND CONDOS AS OPPOSED TO TRADITIONAL MULTIFAMILY RENTAL UNITS.

SO THOSE ARE THE THINGS THAT WE'RE LOOKING AT IN TERMS OF FLEXIBILITY WHEN WE IF WE ENGAGED INDIVIDUALS HERE WITH THE ZONING MODIFICATION OPTION.

THE SECOND OPTION I WANT TO PRESENT TO YOU IS THE ZONING OVERLAY OPTION.

SO THIS IS A TOOL THAT ALLOWS FOR AN ADDITIONAL LAYER OF LAND USES AND STANDARDS IN PLACE OF THE BASELINE PLANT DEVELOPMENT ZONING.

SO WHAT WE TRY TO DO WITH A ZONING OVERLAY IS PROMOTE DESIRED LAND USES THAT FURTHER THE VISION OF THE AREA.

WHILE THIS IS THE TOD AND WE'RE LOOKING AT POSSIBLY REDUCING DENSITY, WE ALSO WANT TO CAPTURE THE GOOD PORTIONS OF THE TOD, WHICH IS MIXED USE DEVELOPMENT AND HIGH DEGREE OF DIVERSIFIED RETAIL USES.

WE MAY HAVE TO INCENTIVIZE THIS OPTION.

WE MAY HAVE TO DO THAT THROUGH INCREASED FLEXIBILITY AND LESS STRINGENT REGULATIONS, FOR INSTANCE, COMMERCIAL PARKING STANDARDS.

IT MAY NOT BE SUCCESSFUL IN REDUCING THE RESIDENTIAL DENSITY IF IT'S NOT ALLOWED.

REMEMBER, ALL OF THIS IS VOLUNTARY, SO WE COULDN'T ESSENTIALLY REQUIRE SOMEBODY TO USE A

TOD OVERLAY OPTION, BUT IT'S SOMETHING THAT WE WOULD TRY TO INCENTIVIZE TO GET IT REDUCING THE DENSITY IN THE AREA.

SO IN OUR REVIEW OF SOME OF THE THINGS THAT WE'VE SEEN OTHER CITIES DO, WE LOOKED AT POSSIBLY ESTABLISHING MINIMUM THRESHOLDS.

ESSENTIALLY, IF YOU REDUCE DENSITY BY X PERCENT, THE CITY WOULD IN TURN CONSIDER DOING OTHER THINGS TO GET THIS TO BE A MORE PALATABLE PURSUIT FOR YOU.

SO IF WE WERE, FOR INSTANCE, ENGAGED WITH A DEVELOPER AND WE'RE LOOKING AT SEEING IF THERE WOULD BE SOME INTEREST IN REDUCING THEIR DENSITY BY 40% AND RESIDENTIAL DENSITY, THE CITY WOULD LOOK AT EMPLOYING A NUMBER OF THINGS THAT WOULD BE AVAILABLE TO US WITH REGARD TO PARTICIPATION IN INFRASTRUCTURE.

AGAIN, INCREASED ZONING FLEXIBILITY, WAIVER OF DEVELOPMENT PERMITS A REFUND OF IMPACT FEES, THINGS OF THAT NATURE, AND IT WOULD BE ON A THRESHOLD.

SO THE MORE DENSITY THAT YOU WOULD LOOK AT REDUCING THE CITY WOULD COME WITH A MENU OPTION ESSENTIALLY OF THINGS THAT WE COULD DO TO MAKE IT MORE OF AN INCENTIVE BASED APPROACH IF YOU WERE TO DO THIS OPTION.

SO THIS TABLE IS A PRETTY BASIC TABLE THAT WE PUT TOGETHER WHERE WE HAVE ON THE LEFT OF THE SCREEN THE PERCENTAGE REDUCTION IN CERTAIN TYPES OF LAND USES.

IN THIS CASE, YOUR ALLOWABLE END CAP APARTMENTS TO LIVE, WORK, URBAN UNITS AND THEN TO THE RIGHT, WHAT WOULD BE SOME OF THE REDUCTION INCENTIVES? SO THE CORRELATION IS BETWEEN THE PERCENTAGE INCREASE AND THEN THE RAMPING UP OF THE INCENTIVE. SO YOU GO FROM YOUR BASELINE INCENTIVES, WHICH WOULD BE THE WAIVER OF PERMITTING AND INSPECTION FEES AS YOU GO INTO 40% REDUCTION.

YOU INCLUDE ALL OF THOSE ABOVE MENTIONED REFERENCE INCENTIVES AND THEN INCLUDE ALSO REFUND OF IMPACT FEES. AND THESE ARE JUST EXAMPLES THAT WE PUT TOGETHER FOR YOU TO CONSIDER.

AND YOU CAN SEE HOW WE ESSENTIALLY WENT THROUGH THIS AND PUT IN EVEN A MINIMUM ACREAGE THRESHOLD. THE POINT BEING IS YOU'RE NOT GOING TO GET A GREAT DEAL OF REDUCTION IF IT'S A SMALL BUILDING SITE.

SO WHAT WE'VE PUT TOGETHER IS A DUAL PRESENTATION WHERE WE GIVE YOU SOME BACKGROUND REGARDING THE COMPREHENSIVE PLAN AS WELL AS THE CITY'S MID-POINT UPDATE TO THAT PLAN.

SO WE'VE BROKEN THE PRESENTATION INTO THE FOLLOWING TOPICS JUST WHAT IS A COMPREHENSIVE PLAN? ITS RELEVANCE TO STATE LAW? HOW IS THE PLAN USED AND INFORMATION REGARDING THE 2020 MIDPOINT UPDATE? OUR PLAN, THE COMPREHENSIVE PLAN, WAS ADOPTED ON APRIL 19TH OF 2010, AND AT THAT TIME IT WAS IMAGINED BURLESON 2030.

AND THEN SUBSEQUENT TO THAT, BACK IN DECEMBER 14TH OF 2020, YOU ALL ADOPTED THE IMAGINE BURLESON 2020 MIDPOINT.

SO ONE OF THE REASONS FOR THE MID-POINT IS THAT THESE PERIODIC UPDATES SUCH AS A MIDPOINT, ARE NEEDED TO GIVE YOU A SNAPSHOT OF HOW WE'VE PROGRESSED SINCE THE PLAN'S INCEPTION. SO CHAPTER 213 OF THE LOCAL GOVERNMENT CODE ESSENTIALLY ESTABLISHES THE LEGAL FRAMEWORK FOR THE CITY'S COMPREHENSIVE PLAN AND ALL COMPREHENSIVE PLANS HERE IN TEXAS.

SO PLACEMAKING PLACES.

HOW DO WE VALUE GREAT PLACES TO GATHER THROUGHOUT THE CITY? A LOT OF THAT IS INFLUENCED BY SOME OF THE DECISIONS YOU MAKE AS IT RELATES TO SOME OF THE DOWNTOWN EVENTS THAT WE HAVE.

COUNCILMAN MCCLENDON, MAYOR PRO TEM MCCLENDON MENTIONED HOW SUCCESSFUL THE FARMER'S MARKET WAS. THAT'S ESSENTIALLY PLACEMAKING, BRINGING PEOPLE TOGETHER IN CERTAIN AREAS OF THE TOWN. SO WE WANT TO CONTINUE TO REFINE THESE PLANNING AREAS, DEVELOP OUR CULTURAL AND ARTISTIC PROGRAMS TO ENHANCE OUR COMMUNITY CHARACTER.

SO IF WE SEE THAT THERE IS A SUDDEN CHANGE OR A TREND TOWARDS SOMETHING IN A PART OF TOWN THAT WE WANT TO CAPTURE, WE CAN EVALUATE THAT, SEE IF THERE IS A BENEFIT TO UPDATING THE FUTURE LAND USE MAP AND THEN MAKING THE MINIMUM CHANGE NECESSARY IN A COMPREHENSIVE PLAN TO FURTHER PROMOTE WHAT WE'RE SEEING THE MARKET DOING.

SO HOW DOES THE PLAN WORK WITH THE ZONING ORDINANCE? AGAIN, THE PLAN IS THE ROAD MAP.

THE ZONING ORDINANCE IS THE ENFORCEMENT OF THAT ROAD MAP.

AND SO THE ZONING ORDINANCE GETS TO THOSE DISCRETE STANDARDS IN PLACE TO FACILITATE DEVELOPMENT. AND THE PLAN DOESN'T SPEAK TO THAT SPECIFICALLY.

LIKE I SAID, IT'S A COOKBOOK IS A MORE OF A BROAD BASED APPROACH TO HOW THINGS ARE DEVELOPED. AND SO OFTENTIMES WE'LL HAVE TO UPDATE THE ZONING ORDINANCE TO MAKE SURE THAT IT IS FURTHERING THE GOALS OF THE COMPREHENSIVE PLAN.

SO WE LISTED SOME EXAMPLES FROM RECENT CASES, AND ONE OF THE THINGS THAT WE LOOKED AT WAS STANFORD FARMS ANNEXATION CASE.

AND SO IF YOU TAKE A STEP BACK FROM THE ULTIMATE ACTION, WHICH WAS DISAPPROVAL OF THE ANNEXATION AND GO BACK TO HOW DOES THAT INFLUENCE DECISION MAKING? ONE OF THE THINGS THAT YOU CONSIDER NOW IS SO AN ACTION HAS TAKEN PLACE.

WHAT? COULD YOU CONSIDER HAPPENING ON THIS PROPERTY FROM THE STANDPOINT OF THE COMPREHENSIVE PLAN? IS THERE A DIFFERENT TYPE OF DEVELOPMENT CHARACTER THAT YOU WANT TO SEE ON A PROPERTY SUCH AS THIS? AND THIS IS FOR ANY NEAR-TERM AREA OF THE CITY IN AND AROUND THE EXISTING CITY BOUNDARIES. OFTENTIMES WE FOCUS ON WHAT'S IN THE CITY AND THE FUTURE LAND USE MAP MAYBE CROPPED RIGHT TO THE CITY LIMITS.

BUT ONE OF THE THINGS THAT YOU WANT TO DO IS LOOK AT THESE AREAS THAT ARE PROBABLY GOING TO BE COMING FORWARD FOR VOLUNTARY ANNEXATION AND MAKE SURE THAT THE COMPREHENSIVE PLAN FUTURE LAND USE MAP IS A COMMUNITY CHARACTER THAT YOU WANT TO CONSIDER, SO THAT WHEN THEY COME IN AND PETITION YOU FOR ANNEXATION, YOU CAN HAVE SOME ASSURANCE THAT IF I ZONED IN ACCORDANCE WITH THE COMPREHENSIVE PLAN, I CAN EXPECT THIS TYPE OF DEVELOPMENT IN THE CITY. IT DOESN'T MEAN THAT THEY MIGHT WANT TO GO ALONG WITH THE DECISION, BUT IT HELPS YOU FRAME YOUR THINKING WHEN THESE TYPES OF PROPERTIES COME FORWARD.

WE JUST TALKED ABOUT THE TOD AND AS CHANGES ARE MADE, IF CHANGES ARE MADE TO THE TOD, THEY MOST LIKELY MAY HAVE AN IMPACT ON THE COMPREHENSIVE PLAN.

WE WANT TO MAKE SURE THAT EVERYTHING IS CONSISTENT AS WE GO FROM PLANNING TO SOME OF THE STREET STANDARDS THAT WE HAVE IN OUR ZONING DISTRICT.

SO WHAT ARE WE DOING IN HOUSE? STAFF HAS STARTED IMPLEMENTATION EFFORTS OF THE MIDPOINT UPDATES, SHORT TERM ACTION STRATEGIES. A NUMBER OF DEPARTMENTS HAVE THEIR OWN INDIVIDUALIZED GOALS AND ACTION

WHAT THE PLANNING STAFF'S JOB IS TO COUNT US, SHEPHERD THOSE EFFORTS, AND MAKE SURE THAT WE STAY ON TARGET, AND MAKE SURE THAT WE ACTUALLY IMPLEMENT THE PLAN.

BECAUSE OTHERWISE WE'VE GOT A PLAN THAT DOESN'T WORK BECAUSE IT'S STUCK ON A SHELF.

TWO OF THE THINGS THAT WE'RE WORKING ON IN THE HOUSE RIGHT NOW, THE ZONING ORDINANCE UPDATE AND SUBDIVISION REGULATIONS UPDATES WE'RE GOING TO LOOK AT, SEE HOW WE CAN COORDINATE OUR BUDGET WITH SOME OF THE LONGER TERM ACTION STRATEGIES IDENTIFIED IN THE COMPREHENSIVE PLAN AND ALSO BRINGING FORTH PERIODIC REVIEWS.

WE DON'T WANT US TO WE DON'T WANT TO COME TO YOU IN A REACTIONARY MODE.

PART OF WHAT WE ARE SUPPOSED TO DO IS BE PROACTIVE THAN BRING TO YOU THESE DISCUSSION POINTS ON THE COMPREHENSIVE PLAN PERIODICALLY SO THAT YOU CAN KEEP PACE WITH WHAT YOU'RE SEEING IN THE COMMUNITY. THOSE ARE THE HEAVILY TRAFFICKED AREAS OF THE CITY WHERE YOU COULD EXPECT TO SEE MORE OF A DENSE TRAFFIC FLOW.

WE'RE LOOKING TO HAVE LIGHT TO MEDIUM INTENSITY COMMERCIAL USES.

SO WITH YOUR COMMUNITY COMMERCIAL, WHAT'S NOT BEING CONSIDERED IS A HIGH DEGREE OF RESIDENTIAL. THERE IS THE POSSIBILITY TO DO SOME MIXED USE, BUT THE MIXED USE PORTION, MEANING THE RESIDENTIAL, WOULD BE MINIMAL COMPARED TO THE OVERALL COMMERCIAL ACTIVITY THAT IS SUPPOSED TO OCCUR ON THESE TYPES OF PROPERTIES.

YOUR NEXT THE OTHER URBAN MIXED USE.

YES. SO WHAT'S UNIQUE ABOUT THIS IS THAT THE PLAN SPECIFICALLY CALLS OUT CERTAIN STREETS, CALLS OUT JOHN JONES AND HULEN STREET.

AND SO THAT'S WHAT WE'RE TRYING TO DO, THE VALUE CAPTURE OF THE MIXED USE, WHERE YOU CAN DO SOMETHING THAT ALLOWS FOR YOU TO HAVE CERTAIN PERCENTAGES.

SAY, FOR INSTANCE, IF YOU WANT TO HAVE THE BOTTOM FLOOR AS COMMERCIAL ACTIVITY, MAYBE THE BOTTOM TWO FLOORS IS COMMERCIAL ACTIVITY WITH SOME OF THE MORE MULTI-STORY BUILDINGS TO CAPTURE SOME OF THE RESIDENTIAL AT TOP.

WHEN I THINK OF MIXED USE IN THIS COMMUNITY, I DON'T THINK OF IT AS STANDALONE PAD SITES FOR COMMERCIAL WITH RESIDENTIAL BEHIND IT.

TO ME, THAT'S NOT MIXED USE.

IT MAY BE ON THE SAME PROPERTY, BUT THE PLAN IS TRYING TO PROMOTE A DESIGN ELEMENT.

WHEN WE SAY MIXED USE, WHERE YOU TRULY HAVE INTEGRATED BUILDINGS TO ALLOW THAT EXPERIENCE FROM RESIDENTIAL TO COMMERCIAL WITHIN THE BUILDING.

SO WE'RE LOOKING AT VERTICAL INTEGRATION.

THAT'S WHAT I WOULD SAY WHEN WE COME AND TALK ABOUT THOSE TYPES OF COMMUNITY AREAS.
